PC Minutes 1980-11-0426 ARROYO GRANDE PLANNING COMMISSION November 4, 1980 The Arroyo Grande Planning Commission met in regular session with Chair- man Gorsline presiding. Present are Commissioners Cole, Fischer, Gerrish, Pilkington and Sebastian. Commissioner Moots, is absent. Planning Director Castro is also in attendance. MINUTE APPROVAL On motion by Commissioner Gerrish, seconded by Commissioner Sebastian, and unanimously carried, the minutes of the regular meeting of October 7, 1980 were approved as peepared. REVIEW COMMITTEE ACTIONS - LOT SPLIT CASE NO. 80-338, HUASNA ROAD. (BRENNAN) Planning Director Castro advised that the matter before the Commission is reapproval of a previous tentative map which the Commission had approved some- time ago, regarding the Brennan property and, because of the expiration period reapproval by the Commission is necessary. Mr. Castro referred to the Minor Subdivision Committee Action, dated Oct- ober 29, 1980, noting the three conditions of approval. He noted that the City Engineer had requested improvements on both Huasna Road and Fortuna Court. His reason for requesting improvements stems from a complaint received from the ad- joining property owner regarding drainage. Mr. Ed Dorfman, representing Mrs. Brennan, stated that Mr. Nelson waters and it does run down the street.and pond's by her neighbor, Ralph Beck, and he called and talked to Joe Anderson on the matter one time. He stated he would not call again. Commissioner Sebastian stated that if Mrs. Brennan completed the curb, gutter and sidewalk at this time, it couldn't alleviate the problem; it could only shift it 163 ft. to the east. After a brief discussion, on motion by Commissioner Sebastian, seconded by Commissioner Fischer, and unanimously carried, Lot Split Case No. 80 -338 was ap- proved subject to the three conditions listed in Minor Subdivision Committee Action, dated October 29, 1980. COMMISSIONER MOOTS ENTERED THE MEETING DURING THE ABOVE DISCUSSION. ELECTION OF OFFICERS AND COMMITTEE APPOINTMENTS FOR 1980 -81. Chairman Gorsline opened the nominations for Chairman of the Planning Com- mission for the year 1980 -81. Commissioner Cole nominated Commissioner Gerrish as Chairman. Commissioner Sebastian nominated Commissioner Gorsline as Chairman. Commissioner Fischer moved that nominations be closed. On motion by Commissioner Sebastian, seconded by Commissioner Fischer, and carried with one "no" vote, Com- missioner Gorsline was elected Chairman of the Planning Commission for the year 1980 -81. On motion by Commissioner Sebastian, seconded by Commissioner Cole, and unanimously carried, Commissioner Gerrish was elected Vice Chairman of the Plan- ning Commission for the year 1980 -81. After a brief discussion, Commissioner Gerrish and Chairman Gorsline agreed to serve on the Lot Split and Architectural Review Committee. Commissioner Moots was appointed as the alternate to serve on both Committees. PUBLIC HEARING - USE PERMIT CASE NO. 80 -306 - 27 UNIT AIR SPACE CONDOMINIUM UNITS IN AN "R - G" GARDEN APARTMENT DISTRICT, 1100 BLOCK OF ASH STREET, (WILLIAMS) Planning Director Castro reviewed the staff report dated October 30, 1980. He advised the reason this development is before the Commission again is because at the time Mr. Newdoll was proposing the project, he had advised that he was not interested in an air space condominium project. At that point, Mr. Castro had advised that a Use Permit would not be necessary, which was an error; a Use Permit is required regardless of whether it is an air space condominium project or a townhouse project. He further advised that the Architectural Review Committee has again reviewed the plans and, with the exception of the guest parking area, the plans are identi- cal to what the Commission had previously approved. He stated that the guest parking is 9' x 20' and should be 10' x 20'. He further stated that the condit- ions for this project have been previously recommended by the Commission and this is merely an informational matter as far as the plans are concerned. Upon being assured by Planning Director Castro that public hearing for Use Permit Case No. 80 -306 had been duly published, posted and property owners noti- fied, Chairman Gorsline declared the hearing open. Arroyo Grande Planning Commission, 11 -4 -80 Page 2 In answer to Chairman Gorsline's question regarding price range, Mr. Williams stated they are projecting prices to be in the range of $65,000 to $75,000 depend- ing on what the economy does in the next six months. There being no further comments from the public, Chairman Gorsline declared the hearing closed and the following action was taken: RESOLUTION NO. 80 -780 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 80 -306. On motion by Commissioner Gerrish, seconded by Commissioner Moots, and by the following roll call vote, to wit: AYES: Commissioners Cole, Fischer, Gerrish, Moots, Pilkington, Sebastian and Chairman Gorsline. NOES: None ABSENT: None the foregoing Resolution was adopted this 4th day of November, 1980. PUBLIC HEARING - USE PERMIT CASE NO. 80- 30 FIVE CITIES RENT ALL, 100 TRAFFIC WAY, REQUEST FOR EXPANSION OF EXISTING USE. (MEINERT). - - Planning Director Castro briefly reviewed the staff report, dated October 10, 1980. Commissioner Sebastian noted that the map on the Notice of Public Hear- ing does not show the two properties being proposed for expansion of the use. After a brief discussion, on motion by Commissioner Moots, seconded by. Commissioner Cole, and unanimously carried, the matter was continued to the next regular meeting pending re- advertisement of the public hearing. PUBLIC HEARING - REZONING CASE NO; 80 -147, ZONE CHANGE FROM "R -G" GARDEN APARTMENT DISTRICT TO "R -3" MULTIPLE FAMILY DISTRICT. Planning Director Castro advised that the action tonight is to bring into compliance the previous action of the Planning Commission regarding the General Plan Amendment, which has also been endorsed by the City Council. Upon, being assured by Planning Director Castro that public hearing for Rezon- ing Case No. 80 -147 had been duly published, posted and property owners notified, Chairman Gorsline declared the hearing open. - Mr. Fischer stated he is a resident of Crown Hill #6 and he is in favor of the proposal as a resident of the Crown Hill Apartments. Kirby Gordon, 405 Indio Drive, Pismo Beach, spoke in favor of the zone change, stating he would reserve further comments until the public hearing for the Use Permit is opened. There being no further discussion for or against the proposed zone change, Chairman Gorsline declared the hearing closed. After a brief discussion the following action was taken: RESOLUTION NO. 80 -781 Z RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING APPROVAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32, OF SAID CODE. On motion by Commissioner Gerrish, seconded by Commissioner Pilkington, and by the following roll call vote, to wit: AYES: Commissioners Cole, Fischer, Gerrish, Moots, Pilkington and Chairman Gorsline. NOES: Commissioner Sebastian ABSENT:, None the foregoing Resolution was adopted this 4th day of November 1980. 265 266 Arroyo Grande Planning Commission, 11 -4 -80 Page 3 PUBLIC HEARING - USE PERMIT CASE N0. 80 -308 TO ALLOW FOR CONVERSION OF APARTMENTS TO AIR SPACE CONDOMINIUM UNITS, 523 CROWN STREET. (IRVINE /GORDON). Planning Director Castro. requested that if the Commission is disposed in granting the Use Permit, that it be made subject to the certification of the zon- ing process. Mr. Castro advised that if the Commission is disposed in with the condominium conversion, then the conditions that are listed in the staff report, dated October 30, 1980 would be proper. He noted that the deficit in the personal storage area noted in Item #1 is approximately 20 square feet per dwell- ing unit, instead of 200 ft. With regard to Item #4 he advised that the plan sub- mitted by the applicant for the guest parking will not work. Planning Director Castro• further• commented that he could not support relocation of the trash area to the front portion of the property. Mr. Mitch Walker, Engineer for the applicant reviewed the proposed parking plans for the project. Upon being assured by Planning Director Castro that public hearing for Use Permit Case No. 80 -308 had been duly published, posted and property owners noti- fied, Chairman Gorsline declared the hearing open. Mr. Kirby Gordon, 305 Indio Drive, Pismo Beach, one of the general partners of the project, spoke in favor of the Use Permit being granted. He pointed out that they have been before the Commission a number of times on the project, and . the conversion was first proposed before there was a Condominium Conversion Ord- inance. He further noted that they have gone through every item in the Condo- minium Conversion Ordinance, which came through after the fact; they have hired sound engineers to test for sound, and have met those qualifications; they have the open space; the private areas; washer and dryer hook -ups in each unit; how- ever, they are short 20 square feet of storage space. With regard to the guest parking, Mr. Gordon stated they have never had a guest parking problem up there. Sixteen of their tenants have signed a letter of intent to purchase the units and, in his opinion, it is a way to provide moderate cost housing to individuals. He further noted that they have a tentative map approval on the project, and now all of a sudden there is a new requirement that can be feasibly applied to vacant land, but"for them to come in now and comply with another condition of guest park- ing is unreasonable. He asked that the Commission look at their project in light of the City's Ordinance and in light of the fact that they have a tentative map approval, and support the application for a condominium conversion. Mr. Mitch Walker, Engineer for the applicants, stated that the issue of guest parking should be judged on the fact that this is an• "as built" development and how it is working. He stated there is no parking problem because of the types of residents and the types of cars. Judith Wheeler, Rt. 2, Box 653, Arroyo Grande, stated in her opinion the kind of project Mr. Gordon is proposing is greatly needed and it fills a need for young families to own their own homes. One of the tenants of the Crown Hill Apartments stated a condominium is more affordable and she would be interested in buying a condominium unit. There being no 'further comments, for or against the proposed Use Permit, Chair- man Gorsline declared the hearing closed. Mr. Castro reviewed the previous action of the Commission regarding the General Plan change and the zone change. He stated that staff has proceeded with all of the investigation relative to the conversion process and have found only problems with the storage, the front doors and with the parking. He further stated that the problem of the guest parking is a policy of the Commission and, in his opinion, he doesn't feel it is a sacred thing of the Commission that couldn't be reviewed and discussed, imposed or deleted from the project. After considerable discussion, the following action was taken: RESOLUTION NO. 80 -782 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF • ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 80 -308. Arroyo Grande Planning Commission, 11 -4 -80 Page 4 PUBLIC HEARING - PROPOSED ORDINANCE - CULTURAL.HERITAGE COMMISSION Planning Director Castro briefly reviewed.the staff report, dated October 30, 1980, pointing out that basically, in his opinion, there are merits to the suggest- ions being offered by the Historical Society in the adoption of the Ordinance, and the benefits that can be derived from its approval is the preservation of.histori- cal buildings which have some significance to the history of the community and the Village area. He stated that one of the negative aspects would be the implementa- tion of the ordinance to the number of dollars it may reflect on the community. Mr. Castro recommended that prior to any recommendation being forwarded to the Council, the Commission request a reconnaissance report or survey from the Historical Society indicating what properties or buildings are anticipated to be addressed by the pro- posed ordinance. Upon being assured by Planning Director Castro that public hearing for proposed Ordinance on the Cultural Heritage Commission had been duly published and posted, Chairman Gorsline declared the hearing open.. Beth Garner, 11531 Pike Lane, Oceano, stated she is a member of the Historical Society. She advised the Commission that the wording of the proposed ordinance came from a model ordinance put out by the State. As an example of how the ordi- nance would work, Ms. Garner stated that if there was a building that the Heritage Commission felt should be preserved and if the owner wished to modify it, then the Ordinance would provide at least an option to bring it before the Planning Commis- sion and the public and there would be a chance for some kind of public input to know what the people of the City wanted to do. She further stated that, hopefully, the Ordinance would make it a lot easier to get around City building codes to modi- fy an older building and bring it up to standard, but not'necessarily up to the City standards for a new building. Also, it would make it easier to apply for a grant of any kind in that other governmental bodies would be a little more amiable to cooperate if there was a Historical Ordinance. Arnold Teague, San Luis Obispo, stated he is °the President of the Historical Society. He stated the Planning Commission would have some control in the Commis- sion in an advisory capacity, in that the Historical Commission would suggest a historical area, and then it would be in the Commission's power to control what would be done to the property. Judy Wheeler, Corbett Canyon Road in Arroyo Grande, stated she is a part owner of a 90 year old house in the Village area which is presently for sale, and inquired what the Ordinance would entail. Planning Director Castro advised that if the Ordi- nance were to be implemented by the Council and if the house she is referring to happens to fall within a designated historical area, then whatever took place on the property would have to be reviewed by the Historical. Commission, or it could be de- leted from the district. Mrs. Wheeler stated she would be in favor of such an ordi- nance. Mrs. Garner advised that the proposed ordinance would give the Planning Commis- sion a frame work within which to work. The Planning Commission would refer to the Cultural Heritage Commission anything that fell within the purview of the Cultural Heritage Commission, and a recommendation would then be made back to the Planning Commission, which would then go'to the City Council. This would give plenty of time for a public reply. Faith T. Berkely, and Jane Hubbard spoke in favor of the proposed Ordinance. After considerable discussion by the Commission, the matter was continued pending further investigations by Mr. Castro and the Historical Society regarding a survey of proposed historical buildings and amendments to the proposed ordinance. REVIEW COMMITTEE ACTION - ARCHITECTURAL REVIEW CASE NO. 80 -233, HUASNA ROAD, "LAKE WAY CONDOS ", 16 AIR SPACE CONDOMINIUM UNITS, HUASNA ROAD. (RANELLETTI). Planning Director Castro briefly reviewed the staff report dated October 30, 1980, pointing out some of the of the Committee noting the driveway lengths being inadequate and unrealistic for the needs of families that may be purchasing in the development, and the present treatment of the rear elevation of the units. He stated it was the Committee's recommendation also that the rear portions of the units be architecturally treated to blend with the English Tudor style of architecture pro- vided on the front elevations. Another concern of the Committee related to the ex- tent of the landscaping by the applicant. 267 268 Arroyo Grande Planning Commission, 11 -4 -80 Page 5 On motion by Commissioner Sebastian, seconded by Commissioner Fischer, and unani- mously carried, the overall conceptual plans as presented, Architectural Review Case No. 80 -233, were denied without prejudice. After considerable discussion by the Commission, Planning Director Castro ad- vised applicants of the Commission findings being.basically their concern about the driveways opening on to Huasna Road; the concern about the 20 ft. width in the .. garage areas opening to one another;. the English Tudor architecture appears to be too busy; and the lack of available open space. Also, the concern that design -wise, the length of the property is inadequate for 16 units. REVIEW COMMITTEE ACTIONS - LOT SPLIT CASE NO. 80 -339, ALDER STREET. (RICE). Planning Director Castro briefly reviewed the Minor Subdivision Action, dated October 29, 1980. After a brief discussion, on motion by Commissioner Sebastian, seconded by Com- missioner Fischer, and unanimously carried, approving Minor Subdivision Committee Action, dated October 29, 1980, on Lot Split Case Ng. 80 -339. DISCUSSION BY THE PLANNING COMMISSION REGARDING ANNEXATION /DEVELOPMENT POLICIES AND /OR.RECOMMENDATIONS.- .
