ARROYO GRANDE PLANNING COMMISSION
June 19, 1979
The Arroyo Grande Planning Commission met in regular session with Vice Chairman
Gorsline presiding. Present are Commissioners Vandeveer, Simmons, Moots and Cole.
Chairman Harris and Commissioner- Fischer are absent. Also in attendance are Planning
Director Castro and Planner Sullivan.
MINUTE APPROVAL
Upon hearing no additions or corrections, the minutes of the regular meeting
of June 5, 1979 were approved by the Vice Chairman as submitted.
ADDITIONS OR DELETIONS TO AGENDA
Planning Director Castro requested that the matter of the Condominium Con-
version Ordinance be added to the agenda after Item No. 1 as it had been continued
to this meeting by the Commission. Also, he advised that Vick Pace Construction
has resubmitted plans for the office building on Halcyon Road, and requested that
this item be considered after Agenda Item No. 7.
Mr. Castro also requested that Item No. 5, the public hearing for rezoning of
Oak Park Acres be deleted from the agenda, in that the requested change to "RA -B3 -D"
is the wrong designation and the matter will have to be re- advertised. He further
requested that Item No. 6, "Subdivision Review - Tentative Tract No. 824, Oak Park
Acres" be continued in view of the fact that it ties in with. Item No. 5.
REVIEW - REZONING CASE NO. 77 -101, BRANCH MILL ROAD (GREENWOOD).
Planning Director Castro reviewed the Council's action of March 27, 1979, advis-
ing that the action stems from the request made by-Messrs. Poole and Head to divide
their property currently within the Greenwood Subdivision. Mr. Castro further-ad-
vised it is his interpretation, when reading the Council's action, it appears that
they are, on one hand, advising the Commission that it was also their understanding
that there was to be no further division of the land. On the other hand, it could
be interpreted that the Commission-take action to recognize that was the implied
intent when this matter was considered some years ago. If the Commission is so
disposed in approving said action, he recommended that they find that theaction:
of the City previously taken on this subject property specifically conditioned the
approval of Tract No. 600 with the findings that the " -D" Override was.to prohibit
any further division of the subject property.
COMMISSIONER FISCHER ENTERED THE MEETING AND IS NOW PRESENT.
Mrs. Elizabeth Jackson, 208 Fair View Drive, stated she has the tapes from
that Council meeting, and the stipulation laid down on that 11 acres was that there
would be no further subdivision. As a matter of clarification, the Council'in-
structed the City Attorney to write up some kind of a form or statement to be put
into that folder on this particular piece of land so that this question would not
arise again, and that any future Council or Planning Commission would definitely
and clearly understand without going through what we are now going through.
After further discussion among the Commissioners, on motion by Commissioner
Simmons, seconded by Commissioner Fischer, that the Commission concur with the
City Council's action and that their interpretation of the " -D" Override was to
prohibit any further division of Tract No. 600. Motion lost with two "no" votes
and one abstintion.
CONTINUATION OF PUBLIC HEARING - CONDOMINIUM CONVERSION ORDINANCE
Planning Director Castro reviewed the proposed Ordinance and explained the
suggested phasing plan for the next 15 years. In addition, in line with the
Commission's previous suggestions, he recommended that the item regarding Noise
resistance and the shock mounting of mechanical equipment be added as items k and
1 on Page 5, which is part of the required conditions of approval. As far as the
$400.00 surcharge is concerned, staff is recommending this be included since it
is a conversion into a single family dwelling unit; also, the park dedication fees
are being recommended in conjunction with conversions.
In outlining the phasing plan, Mr. Castro advised, in his opinion, the concept
would provide the opportunity to begin a conversion program under pre - established
goals and policies, and it:was suggested that the program also require that at least
25% of all conversions be deed restricted and reserved for low income families.
Vice Chairman Gorsline advised that the public hearing on the proposed Condo-
minium Conversion Ordinance would now be continued. Mr. William Lackey, 1270
Longview, Pismo Beach, suggested that instead of making it a set 25% for low cost
housing, to make it up to 25% at the Council's discretion. In that way, you would
be giving the City Council or Commission, whoever controls it, the opportunity to
look at each case individually.

Mr. Kirby Gordon, 405 Indio Drive, Pismo Beach, commented he is in favor of
the phasing idea, and suggested that the phasing start right away and not start
in 1983. He further commented that, in his opinion, using the 25% for low cost
housing as a guideline is satisfactory for a project by project review. He also
pointed out that the idea that this is only applicable to conversions and not to
new construction is a mistake. It was his opinion that if you are going to use
this guideline for conversions, it should be used also for all condominiums across
the board.
Mr. Seigfred Baden, Brighton Avenue, spoke generally in favor of the proposal.
There being no further comments from the audience, Vice Chairman Gorsline
declared the hearing closed. After considerable discussion by the Commission,
the following action was taken:

PUBLIC HEARING - USE PERMIT CASE NO. 79 -283, CONSTRUCTION OF CONDOMINIUMS IN A
"P -C" PROFESSIONAL COMMERCIAL DISTRICT, 321 AND 327 SO. HALCYON ROAD. (FILER).
Planning Director Castro advised the matter before the Commission tonight
is consideration of a Use Permit to allow the condominium project to proceed, and
also the number of units should be specified by the Commission. He referred to
the exhibit on the board, which is the proposal by the developers. He noted that
under the "R -G" Residential District, the plan exceeds the development standard
by one unit, so that if one unit is deleted, it would meet the standards of the
District. He pointed out some of his concerns with regard to the property. He
recalled this was an area where there had been some controversy with regard to
Indian burial grounds. There was also some concern with regard to circulation.
Upon being assured by Planning Director Castro that public hearing for
Use Permit Case No. 79 -283 had been duly published, posted and property owners
notified, Vice Chairman Gorsline declared the hearing open.
Elizabeth Jackson, 208 Fair View Drive, stated she was neither for or against
the requested use, but she wanted to point out that at the time this was reviewed
two years ago, it was proven then by the Indians that the whole area was full of
Indian artifacts and was sacred grounds, not just the rear portion. Mike Johnson,
223 So. Alpine Street, also reviewed the action of two years ago and indicated he
would be in favor of "R -1" zoning for the So. Alpine area.
Mr. Nash Brown, Project Architect, representing the petitioner, stated they
have no intention to develop the rear portion of the property, and their design
did not indicate any kind of circulation through the property, in fact, in his
opinion, the road could not be built through the area, and Mr. Filer has no
intention of developing any further than this in this particular area. He further
pointed out that two years ago, this project was approved for 30 units and, be-
cause of a personal tragedy, Mr. Filer was unable to continue on with the project
and, consequently, the Use Permit ran out. He stated it is their feeling that the
project as it stands today is a much better project for the community and for the
people that live there. Judy Weingard, 251 So. Alpine, stated she personally does
not have any real strong objections to it, although she would like to see it de-
signed so that it is obvious that there will be no through traffic towards the
Alpine area at all. Peggy Langworthy, Printz Road, stated that a friend of hers
who is in archaeology advised that the best way to preserve Indian burial grounds
is to asphalt the whole thing over, however, the Indians feel that if you put
anything over it, you are desecrating it.
There being no further comments from the audience, Vice Chairman Gorsline
declared the hearing closed.

Commissioners Moots, Fischer and Gorsline indicated they would be in favor
of leaving the area in Professional Commercial use because it is in the area of
the hospital, which makes it ideal for future expansion of the Professional
Commercial uses. Commissioners Vandeveer, Cole and Simmons indicated their feel-
ings that this would be a good area for the condominium units, in that it is
within walking distance to shopping, medical facilities, churches, etc., and the
location would be very adequate for the type of housing proposed.
With regard to the proposed density, Planning Director Castro suggested that,
in his opinion, approval of the Use Permit could be granted subject to design re-
view. He also suggested that a thorough investigation be provided by the applicant
with regard to the Indian burial grounds.
After considerable discussion, the following action was taken:

PUBLIC HEARING. - ..PROPOSED. LAND USE AND /OR ZONING RECLASSIFICATION - THAT. AREA
EASTERLY OF BRISCQ.ROAD,FRONTING ON GRAND AVENUE, AND BEING APPROXIMATELY 100
FEET IN DEPTH NORTH OF GRAND AVENUE.
Planning Director Castro advised staff is recommending that the split use
of the property in question be eliminated. It is their feeling that the industrial
use is not really an appropriate one because the predominant uses in the area are
commercial and will probably continue to redevelop on a commercial basis, therefore,
staff is suggesting that the area between Brisco Road and the property line along
Grand Avenue be rezoned from "P -M" to "H -S" District. Mr. John Bainer, 1148 Grand
Avenue, inquired how the zone change to the "H -S" District would effect his key
shop, which is now classified as a manufacturing use. The Planning Director and
Commission were of the opinion that the key shop would be a permitted use within
the "H -S" District, but further assurance could be given by adding the "Locksmith"
use as a permissable use under the Highway Service District. Mr. Ron Benz stated
he owns a piece of property at 1164 Grand Avenue which is rather narrow and runs
pretty far back and, in his opinion, by changing the zoning to Highway Service,
he would not be able to utilize the whole piece of property as he would be able
to under the "P -M" District. Mr. Castro pointed out that manufacturing normally
requires larger type vehicles for operations in order to exist there, and the
turning radius is one of the big concerns with narrow properties.
There being no further discussion, Vice Chairman Gorsline declared the hear-
ing closed. After discussion by the Commission, the following action was taken:

Planning Director Castro recommended that the Planning Commission adopt a
Resolution of Intention to hold a public hearing to consider amending the Zoning
Ordinance to include locksmithing as a permitted use under the "H -S" Highway
Service District. After a brief discussion, the following action was taken:

PUBLIC HEARING..- ..PROPOSED ZONING ORDINANCE AMENDMENT - ADDITION OF RESIDENTIAL
SUBURBAN DISTRICT.
Planning Director Castro defined the boundaries of the proposed new district,
and reviewed the draft of the proposed Zoning Ordinance amendment. Mr. Castro ad-
vised that he has been able to discuss City services and /or utilities with the
Public Works Department, however, he would suggest that: Wells be permitted for
irrigation of the land. That for domestic use, this would be subject to the same
policy that we have now, which is subject to the City Council granting permission
subject to health requirements, etc. There are also other provisions whereby if
the water line is available within so many feet, property owners would be required
to connect at that point in time. The same would be true for the sewer system.
He stated, in his opinion, there is no way we could exempt the District from those
normal requirements of the City. Also, he will be suggesting that any water system
should be engineered with the proper documentation showing that the system will work,
rather than just being presented by the applicant.
Upon. beingH.assured byt:Planning.Director Castro that public hearing for pro-
posed Zoning Ordinance Amendment had been duly published and posted, Vice Chairman
Gorsline declared the hearing open.
Mr. Bill Lackey and Mr. B. J. Burke, property owners in the area of the
proposed district, stated their objections to the building site and lot width
required set forth in the proposed ordinance. Mr. Kirkpatrick, Mr. Nooker and
Peggy Langworthy spoke in favor of the proposed ordinance.
Mr. Castro suggested that possibly the Optional Design Standards could be
included in the review process. He also advised that the Variance procedure would
be a means of relief with regard to the setbacks and dimensions due to topography
of the land, etc.
After considerable discussion regarding the proposed ordinance, the matter
was continued to the next regular Planning Commission meeting.
III REQUEST FOR NEGATIVE DECLARATION - AMENDMENTS TO THE PLANNED DEVELOPMENT DISTRICT OF
THE ZONING ORDINANCE.
Planning Director Castro briefly reviewed the Request for Negative Declaration
on the amendments to the Planned Development District and, after discussion, the
following action was taken:

Planning Director Castro reviewed the changes that have occurred in the plans,

noting that the .roof.1 ine has. been changed, giving more of a complete roof design,
and also the window design in the rear has been changed. After a brief discussion,
on motion by Commissioner Vandeveer, seconded by Commissioner Cole, and carried
with one "no" vote, Architectural Review Case No. 79 -192 was approved subject to
previously approved conditions.
ORAL COMMUNICATIONS
Commissioner Vandeveer noted that this would be his last Planning Commission
meeting and expressed his appreciation for being able to serve on the Commission.
After a brief discussion regarding absences at the next regular meeting, on
motion by Commissioner Moots, seconded by Commissioner Cole, and unanimously carried,
the regularly scheduled meeting of July 3, 1979 was cancelled.
