PC Minutes 1977-10-04a Arroyo Grande Planning Commission October 4, 1977 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Cole, Harris, Moots, Ries and Vandeveer. Commis- sioner Hitchen is absent. Also in attendance are Planning Director Castro and Planner Sullivan. MINUTE APPROVAL There being no additions or corrections, the minutes of the regular meeting of September,' -20, 1977 were'approved by the Chairman as submitted. REVIEW COMMITTEE ACTIONS - LOT SPLIT CASE NO. 77 -278, 141 TALLY HO ROAD (LaVINE) Planning Director Castro advised that this is a proposed four lot'split on a parcel that presently has three residences on the property. He advised that the Lot Split Committee had recommended approval, subject to the conditions.of the Minor Sub- division Committee Action, dated September 28, 1977. Commissioner Harris inquired as to the City policy regarding easements vs. flag lots, stating it was his understanding that flag lots are favored over easements. Planner Sullivan explained that all four lots would have legal access to Tally Ho Road, 3 of them would be with flags, however, there is an existing 20 ft. wide im- proved road that serves the top parcel; and in lieu of developing side by side drives, they are going to use the one existing drive. We are not just allowing an easement access; they have legal flag lots that connect to Tally Ho Road. There being no further discussion, Lot Split Committee Action, dated September 28, 1977, was approved as submitted. REQUEST FOR NEGATIVE DECLARATION - LOT SPLIT CASE NO. 77 -278, 141 TALLY HO ROAD ( LaVINE). After a brief discussion, the following action was taken: RESOLUTION NO. 77 -561 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION. On motion by Commissioner Cole, seconded by Commissioner Vandeveer, and by the following roll call vote, to wit: AYES: Commissioners Cole, Harris, Moots, Ries, Vandeveer and Chairman Gerrish NOES: None ABSENT: Commissioner Hitchen the foregoing Resolution was adopted this 4th day of October .1977. LOT SPLIT CASE NO. 77 -279, SO. TRAFFIC WAY EXTENSION (SULLIVAN) Planning Director Castro pointed out that this is the same land division that was considered a few weeks ago, and was being re -filed by Mr. Sullivan. The problem was that Mr. Sullivan wanted to appeal some of the conditions of approval, however, his request to the City Council was late and, therefore, the City Council's action was that they couldn't consider his appeal and they recommended that he re -file the lot split request. He advised that the split was reconsidered by the Lot Split Com- mittee and the conditions of approval are the same as previously approved by the Commission. He further advised that Mr. Sullivan was concerned about the improve- ments that the City required, such as sidewalks, and also the fact that he has to provide a drainage plan for the area. There being no further discussion, Lot Split Committee Action, dated September 28, 1977, was approved as submitted. REQUEST FOR NEGATIVE DECLARATION - LOT SPLIT CASE NO. 77 -279, SO. TRAFFIC WAY EXTENSION (SULLIVAN). Mr. Deane stated he lives across the street from the property being developed and he was concerned about the road. He stated his son -in -law surveyed the property, and found that his property runs to the middle of the road, and he felt the road is in the wrong place. Planner Sullivan explained that on both sides of that road, the property lines go to the middle of the street because Traffic Way Extension is a private street. 407 408 Arroyo Grande Planning Commission, 10 -4 -77 After a brief discussion, the following action was taken: RESOLUTION NO. 77 -562 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION. ARCHITECTURAL REVIEW CASE NO. 77 -149, SO. ELM STREET, 22 UNIT APARTMENT (PACE). Planning Director Castro advised it is recommended that this matter be continued until the next regular meeting, in that the Committee is asking for a re- submittal of the design plans. ARCHITECTURAL REVIEW CASE NO. 77 -150, TENTATIVE TRACT MAP NO. 672, "OAK PARK LEISURE GARDENS" (O'NEAL AND KVIDT). Planning Director Castro pointed out the area on the map, and advised there will be open space provided surrounding the area. Mr. Castro read the recommended conditions of approval of the Architectural Review Committee, dated September 28, 1977. He advised that the construction plans will be made an exhibit to the approval, so that they will tie in with the building permit so there will be no misunderstanding on the construction details. Mr. Kvidt, the developer, described the proposed development, stating that basically there are three types of units. The largest building has six units and these are meant for older people who perhaps don't want to climb stairs. He ad- vised these are quality units, with fireplaces and balconies. The sizes are around 1,000 and 1,100 square feet, and all have one car garages inside the house. He stated the recreation complex is about 3,800 square feet, and since they plan to have older people in, they will offer garden plots just for the cost of the water. In answer to Commissioner Vandeveer's question regarding age restrictions, Mr. Kvidt advised the minimum age of a buyer would be 40 years, and no children under 16 years permitted. Commissioner Vandeveer advised with regard to street naming, he had received a request sometime ago tieing in with the Historical Society requesting that in the new developments that are being put in, we consider pioneer familys' names for some streets. Mr. O'Neal advised they would be open to that suggestion. In answer to Mr. Al Jackson's question as to how long it will take for the development to look like the pictures, Planning Director Castro advised that the landscaping plans for the project are forthcoming, and they will be looking into that detail very shortly, probably within the next 30 days. He stated the pri- mary thing to look at is the style of architecture, and the kind of materials being used. Mr. Bill Langworthy, Printz Road, stated this looks like a good project. He stated he was confused about Ordinance C.S. 140 accepting 110 units and then also included as an Appendix that suggested maybe the number of units could be higher if it was an adult community, but the developers have come in with 117 units, which is 7 more than was in the Ordinance. Planner Sullivan advised that the principal reason is that the size of the units range to 1,300 square feet. Mrs. Ella Honeycutt stated she attended the water meeting held yesterday, and at that meeting, Mr. Butch kept quoting a 3 -1/2% growth figure, and if the Commission approves this development, she would question how it would affect this figure. There being no further discussion, Architectural Review Committee Action, dated September 28, 1977, was approved as submitted. ARCHITECTURAL REVIEW CASE NO. 77 -151, 1169 MAPLE STREET, TRACT NO. 667, "AUTUMN GARDENS ", A CONDOMINIUM (CURTIS). Planning Director Castro advised that this matter has been before the Arroyo Grande Planning Commission, 10- 4- 7;7;:,: Paye 3 Commission under a Minor Subdivision and a Use Permit, and what is being considered now is the Architectural Review process that wi1lcomplete the review of this de- velopment. He advised there are ten units proposed on this property, and reviewed the recommended conditions of the Architectural Review Committee. There being no discussion by the Commission, Architectural Review Committee Action, dated Septem- ber 28, 1977, was approved as submitted. PUBLIC HEARING - USE PERMIT CASE NO. 77 -267, TENTATIVE TRACT NO. 672, LOT 8 OF OAK PARK ACRES, CONDOMINIUM UNITS IN AN "R -G" GARDEN APARTMENT DISTRICT (O'NEAL AND KVIDT). Upon being assured by Planning Director Castro that public hearing for Use Permit Case No. 77 -267 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Planning Director Castro advised that in accordance with the Ordinance, the development would need a Use Permit, and staff is recommending that the permit be granted subject to the conditions previously attached to the Architectural Review plans and the Subdivision Review that is coming up on the agenda. Mr. O'Neal, petitioner for the development, advised that, technically, this is a townhouse development; not a condominium. He advised it is their goal to sell all of the units and not rent them, as the banks are requiring them to be owner occupied. There being no further discussion for or against the proposed Use Permit, Chairman Gerrish declared the hearing closed, and the following action was taken: RESOLUTION NO. 77 -563 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 77 -267. On motion by Commissioner Vandeveer, secoi#ded by Commissioner Cole, and by the following roll call vote, to wit: AYES: Commissioners Cole, Harris, Moots, Ries, Vandeveer and Chairman Gerrish NOES: None ABSENT: Commissioner Hitchen the foregoing Resolution was adopted this 4th day of October 1977. PUBLIC HEARING - REZONING CASE NO. 77 -109, 571 AND 579 SO. TRAFFIC WAY, FROM "RA-B3" RESIDENTIAL AGRICULTURAL DISTRICT TO "R -1" SINGLE FAMILY RESIDENTIAL DISTRICT (RITCHIE AND KIRTLEY). Planner Sullivan advised the request is to rezone two parcels of property from "RA -B3" to "R -1 "District, and that both parcels are under the minimum size in an "RA -B3" District, and the rezoning is consistent with the General Plan requirements. He pointed out that one potential additional building site is all that probably would be created by the rezoning. Upon being assured by Planning Director Castro that the public hearing for Rezoning Case No. 77 -109 had been duly published, posted and property owners noti- fied, Chairman Gerrish declared the hearing open. 111 Mr. Stanley Kerr, 535 Traffic Way, stated he was representing E. Q. and L. M. King, who own the acreage immediately in back of the property to be rezoned. He advised that Mr. King is at the present time working on the development of his acreage, and he was assured that by granting this rezoning, it would not affect any change that Mr. King would want on his property a little later on. He further stated he believed it is a good thing for the City and a good thing for the area. Marie Cattoir, 195 Orchid Lane, inquired if Mr. Ritchie is granted a lot split, what improvements will he be required to make, and if the existing roads would change. Planner Sullivan advised that Mr. Ritchie has very little frontage on Traffic Way itself and, at this point in time, he could not say what off-site improvements would be required. Mrs. Ella Honeycutt referred to Mr. Butch's statement at the water meeting about 3 -1/2% growth rate, and he was saying that we need fiscal . responsibility, and it was her feeling that it has to start with the Planning Commission and the Council. She stated she was very surprised to hear Mr. Butch say these things, and she really felt the City is going in the right direction now, and she is really proud of the 409 410 Arroyo Grande Planning Commission, 10 -4 -77 Page 4 Planning Commission right now. Chairman Gerrish stated that, gathering from her comments, there is some additional information this Commission needs now, and re- quested that Mr. Castro take care of this. There being no further discussion for or against the proposed zone change, Chairman Gerrish declared the hearing closed and the following action was taken: RESOLUTION NO. 77 -564 Z RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PRO- VIDED BY CHAPTER 4 ZONING, ARTICLE 32 OF SAID CODE. SUBDIVISION REVIEW BOARD RECOMMENDATIONS - TENTATIVE TRACT MAP NO. 672, "OAK PARK LEISURE GARDENS ", 120 UNIT ADULT COMMUNITY, LOT 8 OF OAK PARK ACRES (O'NEAL AND KVIDT) . Planning Director Castro displayed a copy of the Tentative Subdivision Map, and read the recommendations of the Subdivision Review Board. After a brief dis- cussion, the following action was taken: RESOLUTION NO. 77 -566 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE SUBDIVISION MAP FOR TRACT NO. 672, "OAK PARK LEISURE GARDENS ", AND REFERRED TO THE CITY COUNCIL. On motion by Commissioner. Cole, seconded by Commissioner Vandeveer, and by the following roll call vote, to wit: AYES: Commissioners Cole, Harris, Moots, Ries, Vandeveer and Chairman Gerrish NOES: None ABSENT: Commissioner Hitchen the foregoing Resolution was adopted this 4th day of October 1977. 1 1 Arroyo Grande Planning Commission, 1074777 SUBDIVISION REVIEW BOARD RECOMMENDATIONS - RESUBMITTAL, TENTATIVE MAP TRACT NO. 553, "TERRA DE ORO UNIT 3" (GRANT AND KUDEN). Planning Director Castro advised this is a resubmittal of a tentative map that :had previously been granted two extensions, and the map being displayed represents the tentative as well as the final map. Mr. Castro pointed out some changes that have been made from the original plans, stating in his opinion they are to the bene- fit of the project. Mr. Castro reviewed the recommendations of the Subdivision Review Board, dated September 28, 1977. He further advised there was a Negative Declaration approved for the original tract, and that he has looked at the Negative Declaration, and the tract that was previously approved is substantially in line with the resubmittal. After a brief discussion, the following action was taken: RESOLUTION NO. 77 -567 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE SUBDIVISION MAP FOR TRACT NO. 553, "TERRA DE ORO UNIT 3 ", AND REFERRAL TO THE CITY COUNCIL FOR INFORMATIONAL PURPOSES ONLY. ORAL COMMUNICATIONS Planning Director Castro advised that on the Landini application for Archi- tectural Approval, the staff still hasn't been contacted regarding the joint parking agreement between the Fair Oaks Pharmacy and Scolari's Market, and he hopes to have this information at the next meeting. Mr. Castro further advised that with regard to the apartments on Crown Hill, he has received a verbal opinion from the City Attorney and has used that in con- junction with the granting of the final occupancy, and his written opinion will be forthcoming. With regard to development impact on schools, Chairman Gerrish commented he has asked Mr. Castro to see if he can get some enrollment information from the School District, as well as capacity, so that the Commission will have this information to help them in their decisions.
