PC Minutes 1976-09-21272 Arroyo Grande Planning Commission September 21, 1976 The Arroyo Grande Planning Commission met in regular session with Chairman Pope presiding. Present were Commissioners Cole, Gerrish, Hitchen, Mathews, Moots, and Ries. Also present were City Administrator Butch and Planning Director Gallop. MINUTE APPROVAL Commissioner Gerrish asked about the revision that had been made on the Request for Negative Declaration on The Pike Annexation No. 1. Director Gallop stated that it was included in the resolution. There being no additions or corrections, Chairman Pope approved the minutes as prepared. CHAIRMAN'S AGRICULTURAL COMMITTEE Chairman Pope announced hie'appointments to the Agricultural Lands Committee', which were as follows: Gene Moots and Hugh Pope, representing the Planning Commission; Tom Runels and Ben Dohi, representing the farmers who farm small parcels within the City and large parcels outside the City Limits; Ella Honeycutt and Fred Wolf, members of the Council of Concerned - Citizens, but serving as individuals; and Karl Hogan, serving as a member - at -large from the community. He stated that the meeting dates would be every Monday at 4:00 P.M., with the first meeting.date to be September 27. The meetings will be.in the Council Chambers. He requested that there be•a secretary present to take the minutes, as well as the Planning Director, the City Engineer, the City Administrator, and the City Attorney, if possible. He added that he hoped to have a written recommendation for the Commission by the end of about four meet- ings: He stated that the Committee members would receive a packet of informa- tion prior to the first meeting, which would contain all the written corres- pondence received.from the City Council and the Planning Commission, and necessary background information.. Fred Wolf asked if it would be possible to receive a letter of his appointment so that he could present it to his employer in asking for time off to attend the meetings; Chairman Pope instructed Planning Director Gallop to do so. PUBLIC. HEARING.. - ..USE. ,P,ERMIT..CASE. ,NQ....7.6- 249,., ,1524, ,GRAND..AVENUE,,..:TO. ALLOW, FOR A PERMANENT AUCTION OF FURNITURE AND ANTIQUES IN A "C -N" DISTRICT (GARRISON) Director Gallop stated that the property is just easterly of the Young Brothers Market property. The property is currently developed with a series of structures. He stated the request was originally for a two -day permit, but upon hearing that he would have to apply for a Use Permit, the petitioner decided to amend his request to a permanent auction. He noted that two years ago, there had been a determination by the Planning Commission that auctions are a permissive use in commercial districts, subject to Use Permit procedure, and that is why the petitioner was applying for a Use Permit. He also added that he had no objections to the proposed auction, but felt that a two -day permit should be granted and then a review of the proceedings prior to any additional sales so that the Commission could review it for any problems. J. C. Garrison, the petitioner, stated he had amended his original request when he found out that he would need a Use Permit to have an auction. He stated this would not be a junk auction. He has tentatively set the first two dates for the auction on October 8 and 9, or October 9 and 10. He questioned the two -day temporary Use Permit, stating he did not feel this would be a long enough period of time. He noted he had five acres for parking. Upon being assured by Planning Director Gallop that public hearing for the proposed Use Permit had been duly published, posted, and property owners notified, Chairman Pope opened the public hearing. Fred Wolf, 540 Gaynfair, stated he thought the idea of a review was an excellent idea; however, he felt that the two -day period was too short. He felt two or three weeks would be better. Karl Hogan, 1255 Poplar, stated he felt a six month review period would be good. He also thought there was adequate area for parking. Arroyo Grande Planning Commission, 9 -21 -76 Page 2 Madeleine Steele, 1598 Hillcrest, asked about the frequency of the auctions. Mr Garrison stated they would be one or two days at a time. Mrs. Stinchcomb, 308 Courtland, commented on the traffic problem on Courtland. She stated she would like the City to do something about stop signs controlling the traffic there. She stated she would agree with the auction if something could be done about the traffic and controlling the parking. Mrs. Bright, 301 Courtland, stated she was concerned about the park- ing from the auction, and traffic on Courtland to Grand. Chairman Pope directed the Secretary to write to the Parking and Traffic Commission about the traffic problems to see if something could be done. Elizabeth Jackson, 208 Fairview, asked about the definition of "per- manent". Chairman Pope stated that it was never - ending. He added that any Use Permit is permanent unless it has a specific time limit. He stated that when the character of the land changed and another building is built, the petitioner must come in and get another Use Permit. He added that the permit is issued to the property, not an individual. The Commission had the option of holding a public hearing to terminate the Use Permit if the condi- tions were violated. Director Gallop stated he had two additional conditions he would recommend with regard to the Use Permit: that the property on the northerly end be cleaned of debris, and that there be no direct access from this prop- erty to Courtland. There being no further discussion for or against the proposed Use Permit, the Chairman closed the public hearing. Commissioner Ries stated he was in favor of more than a two -day permit; he thought 90 days would be better. Commissioner Moots questioned the petitioner about the type of mer- chandise that would be involved in the auctions. The Police Chief's memo had made a statement about serially numbered merchandise. Mr. Garrison stated that this would refer to appliances, which he did not propose to auction. Commissioner Mathews suggested a one -year permit, with a year to year extension. Chairman Pope stated he would like to see it granted with the proviso that total off- street parking be provided during the auction, that all access to Courtland be denied during the auction, that the northerly end'of the prop- erty be cleaned of debris, and that the permit be granted with a six month staff review. After discussion, the following action was taken: RESOLUTION NO. 76 -465 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 76 -249. Chairman Pope stated that the City staff would report to the Commission for their consideration; the petitioner could also testify if there were any problems. Fred Strong, Santa Margarita, representing the South County Citizens for Environmental Balance, asked how the City could hold the petitioner responsible for customers parking onthe street. Commissioner Ries stated the intent of his motion was that the petitioner must make every effort to contain the parking on his property during auction hours. PUBLIC HEARING, . -, .USE ..PERMIT ..CASE ..NO, ., .76- 250,...1200.. GRAND . ,AVENUE TO, ALLOW FOR STORAGE, OF RECREATION TRAILERS, BOATS, AND SIMILAR VEHICLES IN A "P -M" DISTRICT (McCOY) Director Gallop stated this request is for the property behind the old Sunset lumber retail sales building. It involved several old lumber sheds and a flat area which is adjacent; it has direct access to Brisco Road. He recommended that sidewalks be continued from the existing side- walk, up Brisco Road in front of the property, and also a solid fence to screen the business from the residential area adjacent on the west. Upon being assured by Director Gallop that public hearing for the proposed Use Permit had been duly published, posted, and property owners notified, Chairman Pope opened the public hearing. Mr. McCoy, the petitioner, asked for clarification about the location of the fence, which Director Gallop provided. Mr. McCoy stated the sidewalk would be completed before too long. He said the property contained enough parking area for storage of about 120 pieces. J. C. Garrison, P. 0. Box 408, Grover City, stated he was in favor of granting this Use Permit; and that a facility such as this is needed in the City. Peggy Langworthy, Printz Road, San Luis Obispo County, asked for clari- fication of the property in question. Chariman Pope explained that it is adjacent to the old Sunset sales building, on Brisco Road. Fred Wolf, 540 Gaynfair, asked about adequate off - street parking for the adjacent business. Chairman Pope explained that all the stored vehicles would be within a fenced area, and would not eliminate any of the parking for the adjacent business. There being no further discussion for or against the proposed Use Permit, Chairman Pope declared the public hearing closed. Commissioner Gerrish asked what the petitioner meant by "similar vehicles ". Mr. McCoy explained that he meant dune buggies, motor homes, camper shells, etc. Commissioner Gerrish asked about the hours of operation. Mr. McCoy replied that they would be from 8:30 a.m. to about 6:00 p.m. There would be flood lights at night. Director Gallop stated that in view of the flood lights, he would also recommend a condition that the flood lights be oriented onto the property and not onto abutting properties or public rights of way. Mr. McCoy asked if all conditions must be . met before he can open his business. Director Gallop stated that the Use Permit is not in effect until ten days after its approval. During that ten day period, the petitioner can start advertising, and if the contractor has not completed the work, the City will, under certain conditions, accept a written contract between he and his contractor as a sign of good faith. . NOISE ELEMENT OF THE GENERAL PLAN Director Gallop stated that the State had mandated that every govern- mental jurisdiction adopt as part of their General Plan the Safety and Noise Elements. Because of the nature of these two considerations, the six cities and the County of San Luis Obispo entered into a contract for these elements. He added that Joe Johns, president of Envicom, the contracting consultant, was present to speak about the two elements. Mr. Johns reviewed in detail the various sections of the Noise Element, stating that in terms of Arroyo Grande, there were only two conflicts: ^E1 Camino and Dower Wayside Parks. However, they are conflict areas strictly from noise from Highway 101. Upon being assured by Director Gallop that public hearing on the pro- posed Noise Element had been duly published and posted, the Chairman opened the public hearing. Ella Honeycutt, 560 Oak Hill Road, expressed concern about the noise on Huasna Road from traffic to the lake, and potential traffic when Strother Park is developed. She suggested a sign in town saying when the lake is full. Chairman Pope stated that there was a sign at one time, but that it had not proved effective. Mrs. Honeycutt also asked if these Elements must be completed to receive federal funding. Director Gallop stated that this was not true at this time. Peggy Langworthy, Printz Road, San Luis Obispo County, asked if the Noise Element was adopted, would there be a section which would then require future development along the freeway to be provided with noise abatement. Mr. Johns stated that this is just a background document that points up the problems. The next step would be to make a noise ordinance which would be law. Don Curzon, 133 East Branch, asked about the decibel rating in the Central Business District. There being no further discussion for or against the proposed Noise Element, Chairman Pope closed the public hearing. Commissioner Gerrish asked about Policy 5.1, which says to develop an information release program. Mr. Johns stated that the primary document for that is the Noise Element itself. The Element and the maps should be available to the public. After discussion, the following action was taken: RESOLUTION NO. 76 -467 G RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ADOPTING THE NOISE ELEMENT OF THE GENERAL PLAN. PUBLIC HEARING - SAFETY ELEMENT OF THE GENERAL PLAN Joe Johns, president of Envicom, stated that the Safety Element covers three primary hazards: geologic and earthquake; flooding; wildland. One -third of the document has already been reported on and adopted in the Seismic Element. He reviewed the Natural Hazards Map for the Commission and the audience. He then reviewed in detail all the pertinent sections of the Element. Director Gallop stated that with reference to the requested changes from P. G. & E., the matter had been presented to the Area Planning Council Coordinator and the other cities; and if they are generally in agreement, he would have no objections to the requested changes. He felt that similarity of action was more important than specific wording. Mr. Johns agreed with this recommendation, noting Envicom also recommended including Southern California Gas Company. Director Gallop then reviewed the recommended staff revisions to the Safety Element of the General Plan. Mr. Johns stated he agreed with the staff recommendations, which should be included as an addendum. Upon being assured by the Planning Director that public hearing on the proposed Safety Element had been duly published, Chairman Pope opened the public hearing. Fred Wolf, 540 Gaynfair, asked about Diablo Canyon and its inclusion in the Element. Ella Honeycutt, 560 Oak Hill Road, expressed concern over the water supply if an earthquake should occur. She also suggested that the sewer pipe that is above ground on Huasna Road be red - flagged in case of a flood. She asked about the Huasna Fault. Mr. Johns stated that Envicom was familiar with this situation and would resolve it in about 1k months, through an on- site investigation now underway. Their determination will be available to the U. S. Geologic Survey and the California Division of Lands and Geology. Peggy Langworthy, Printz Road, San Luis Obispo County, asked about the section dealing with one- hundred year flood protections, lack thereof. Mr Johns stated this was covered in the Technical Report. Mrs. Langworthy also asked about the flood problems on undeveloped lands. Mr. Johns stated that the hazards shown on a set of policies call for regulation of land use in areas of significant hazards. He pointed out the flood hazard areas on the map, noting that this was not an inflexible document and could be amended if more information were forthcoming. Elizabeth Jackson, 208 Fairview, asked if the City couldn't state it was a dangerous place to build directly in the path of Lopez Dam. Mr. Johns stated that Section 3.1 speaks to this in terms of prohibiting critical facilities in the 100 year flood plain area and in potential dam inundation areas. However, he stressed that he was not saying that Lopez Dam was not safe. What they were saying was that the dam should be inspected, using the Seismic Element requirements as criteria. Bill Langworthy, Printz Road, San Luis Obispo County, stated he was not sure that the 100 year flood was a valid figure to use. He felt that any erring should be on the cautious side. Mr. Johns stated that Section 7.1 deals specifically with updating the Element every five years. There being no further discussion for or against the proposed Safety Element, Chairman Pope closed the public hearing. Commissioner Gerrish asked if untreated shake roofs are allowed; Director Gallop stated that the City is all Fire Zone 3, which allows these. Director Gallop stated that if there is anything in the final County document which would affect the City, he would recommend to the Commission thatithey consider amending the Element to reflect these changes. After a lengthy discussion, the following action was taken: Arroyo Grande Planning Commission, 9 -21 -76 Page 6 RESOLUTION NO. 76 -468 G RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ADOPTING THE SAFETY ELEMENT OF THE GENERAL PLAN. On motion by Commissioner Gerrish, seconded by Commissioner Mathews, and by the following roll call vote, to wit: AYES: Commissioners Cole, Gerrish, Mathews, Moots, Ries, and Chairman Pope NOES: None ABSENT: None ABSTAINING: Commissioner Hitchen the foregoing Resolution was adopted this 21st day of September 1976. OFF - STREET PARKING REQUIREMENTS IN HIGH DENSITY ZONES Director Gallop stated that the Parking and Traffic Commission feels that there may be a potential problem with off- street parking in areas of the City. He suggested placing these with other potential zoning change recommendations for study at a later date. After discussion, the Commission agreed to discussing this item at a °later date. NORTH HALCYON PLAN LINE Director Gallop stated that the Commission, at its meeting of May 18, had recommended to the City Council and the Parking and Traffic Commission that the. North Halcyon Plan Line be abandoned. The Parking and Traffic Com- mission did a survey of all property owners involved, and they received al- most unanimous approval of the abandonment. On motion by Commissioner Gerrish, seconded by Commissioner Moots, and unanimously carried, to accept the recommendation of the Parking and Traffic Commission to abandon the North Halcyon Plan Line. Director Gallop stated that he had. Public Hearing Notices - Fred Wolf, 540 Gaynfair, asked that all public hearing notices regarding written documents contain information about where copies of the documents are available for the public's information. Director Gallop stated that State laws require that they are placed in public places: the City Clerk's Office, Library, County Office, etc. These documents are always available to the public. Chairman Pope stated he thought this matter should be referred to the City Administrator before more money is spent in advertising. Use Permit Case No. 76 -249 - Fred Wolf, 540 Gaynfair, stated he believed that the City had taken away his personalprivi'leges in telling him where he must park if he were to attend this auction. Director Gallop stated it was the Commission's intent to encourage Mr. Garrison to provide all off - street parking possible and to encourage his customers to use it. However, as long as there is adequate parking on the street, there is no way the City can prohibit customers from using it. He is required to provide off- street parking; but the City can't force him to use it. WRITTEN CORRESPONDENCE Land Use Element Amendments - Director Gallop noted that the Commis- sion had received an analysis of'the'Commission's recommendations on areas of the General Plan. He suggested that the Commission proceed with all items but that of the agricultural lands. He felt that should wait until the Agri- cultural Committee comes up with.suggestions. He noted that these recommenda- tions were just minor terminology changes that the. has -regiested "the -- 2.77 278 Arroyo Grande ,Planning Commission, 9 -21 -76 Page 7 Commission to consider; these would comprise the second of the three General Plan change options for this year.
