PC Minutes 1976-05-17240 Arroyo Grande City Council /Planning Commission Joint Meeting May 17th, 1976 The joint meeting of the Arroyo Grande City Council and Planning Commission was called to order by Vice Chairman Moots. Present were Commissioners Cole, Gerrish and Ries. Commissioners Pope, Sandoval and Mathews were absent. Councilmen Millis, Schlegel, Spierling, and Mayor de Leon were present. Councilman Gallagher was absent. Also present were City Administrator Butch, Planning Director Gallop, Public Works Director Anderson, and City Engineer Garcia. REZONING CASE NO. 75 -83, (RANCHO LA BARRANCA) Director Gallop stated that this item was on the agenda at the request of the City Council. There had been some question as to whether or not the Lovett property on James Way, which was originally in the rezoning request, had been dropped. He stated that from what he could find in the minutes, etc. it had not. He also had received letters from both Mr. Lovett and Mr. Garing stating they had never withdrawn this property from the requested rezoning. The property consists of a 1260 ft. frontage, which could yield a maximum of 13 lots. COMMISSIONER POPE ENTERED THE MEETING AND IS NOW PRESENT. Councilman Millis stated he had no objection to including this property; but when they had considered the rezoning, he thought they were only considering Rancho La Barranca. He felt that from now on when the City Council had a second reading, they should see the ordinance in writing before voting. He also felt that when a Commissioner is present at a Council meeting and hears an error in a Commission recommendation, he should point it out, and vice versa. COUNCILMAN GALLAGHER ENTERED THE MEETING DURING THE ABOVE DISCUSSION AND IS NOW PRESENT. Administrator Butch stated that the Council had already had the second reading of the original rezoning request and the first reading on a second ordinance which withdraws the Lovett property. This item would be on the Council agenda for May 25 for action. Lee Lovett, owner of the property in question, stated he had never withdrawn the property and that he had been present at several of the meetings, stating he owned the property and that he was requesting the rezoning. LAND USE PLAN, Director Gallop reviewed a packet of information which included recommendations from the public about changes to the Land Use Plan, a memo from Mr. Butch regarding Council recommendations for changes, a memo from himself to the Planning Commission regarding the Council recommendations, and a recommendation for rewriting the "P -D" section of the Land Use Plan. Vice Chairman Moots stated he felt the zoning should be very precise on a "P -D" plan when it comes in. Commissioner Cole stated she felt that there should be some right of appeal. Councilman Gallagher stated he was concerned about the standards in a Planned Development, such as open space. He said he felt open space was "people space"; he felt buildings should be bunched up to leave more space for people. Director Gallop stated that in a large development of land, par- cels would be required to be set aside for open space; these could never be developed for residential use or commercial use. This might mean permanent pasture, a golf course, a park, etc.; but no permanent buildings unless for public use. If the demand for open space was substantial, he felt the owner was entitled to density transfer. He stated that "people space" is a smaller area adjacent to living quarters; a percentage on a lot not allowed to be covered by walks, driveways, etc. The idea of the open space concept, as set up in the "R -G" District in 1969, was designed for separation of buildings, sunlight, etc., and to preserve a certain amount of privacy. The developer has the option of putting all the apartments into one building and putting the rest into some type of recreation use. 1 City Council /Planning Commission, 5 -17 -76 Page 2 Councilman Millis stated hi s'concerns %faith Planned Development is the part that says any mix of the permissive uses will be allowed. Director Gallop stated he felt that his rewrite would take care of this. He also reviewed the permissive "P -D" uses. He stated that the total density for the Planned Development could not exceed the land use shown on the Land Use Map. Vice Chairman Moots stated he would like to have a predetermined density and use on each parcel in a Planned Development. Councilman Gallagher stated that he would like to see on large acre development what the costs to the City would be, and what they involve. He also felt that the City should have some type of priority listing for development. He added he felt it was important that the Council and Commissions share any citizen input they receive. Councilman Spierling corrected the memo from Mr. Butch regarding his suggested change to the school section. It should have read "... should recognize their responsibility to provide education facilities and'programs for children." He then presented a suggested policy state- ment regarding agricultural lands within the City. Councilman Millis and Gallagher felt that the statement should include both Class I and II on the section dealing with properties containing more than one soil type. Councilman Gallagher stated that agriculture is the number one industry in this area and that it has already'been compromised by developments on the valley floor. He felt that we have a large.,amount of unemployment and that a majority of people living here are adapted to this industry, and that it shouldn't be compromised further. Councilman Spierling stated that he felt that if the City shut down development on both Class I and II, it would be faced with an inverse condemnation suit. Ella Honeycutt, 560 Oak Hill Road, stated there is a State'law now that prohibits such a suit. After, further discussion, the Council and Commission discussed the school section. Councilman Gallagher noted that Administrator Butch had written to all the governmental agencies within the School District to see about a meeting to try to solve some of the problems, and that so far he has only heard from the School District itself. Director Gallop stated that unless Grover City, Pismo Beach, and the County all required some kind of compensation to the School District for development at the same time as Arroyo Grande, then Arroyo Grande would be subsidizing the schools when it had a lesser per- family effect on the District than the other three did. He added that he was in favor of some method of assessing per dwelling unit to help the School District, but not where Arroyo. Grande underwrites the complete District. Ella Honeycutt, 560 Oak Hill Road, stated she wished to commend the City; she said she believed the people felt they could still "touch" the City. ADJOURNMENT There being no further business, on a motion by Councilman Spierling, seconded by Councilman Gallagher, and unanimously carried, the City Council adjourned to a budget study session at 4:00 P.M., May 24.
