PC Minutes 1975-12-02186 Arroyo Grande Planning Commission December 2, 1975 The Arroyo Grande Planning Commission met in regular session with Chairman Calhoon presiding Present are Commissioners Cole, Gerrish, Mathews, Moots, Ries, and Sandoval., Also present. are Planning Director Gallop and City' Attorney Shipsey. M,NUTE APPROVAL The minutes of the regular meeting of November 18, 1975 were approved by the Chairman after hearing no additions or corrections. LAWLR_CASE The Planning Director stated that City Attorney Shipsey was present at the City Council's request, to explain the court decision on. the Lawler case_ Copies of this decision had been given to the Commission members for their information, Mr, Shipsey briefly discussed the opinion and stated that he felt that the judge was saying that the City must either amend its Land Use Plan to comply with the zone change denial, or change the zoning to con- form to the Land Use Plan, The Planning Director stated that if he understood the Attorney correctly, he was saying that it would be necessary for the Com- mission to hold a public hearing to allow public input into reconsideration of the Land Use Element of the General Plan_, which would then be referred to City Council After discussion, on motion by Commission Moots, seconded by Com- missioner Gerrish, and unanimously carried, the public hearing on the Land Use Element of the General Plan was set for January 20, 1976. LOT_SPLIT CASE N. 75 -227, AND NEGATIVE DECLARATION OF_ENVIRONMENTAL IMPACT {RICHARD_LEMONZ The Planning Director read a letter from Mr,: Paul Sturges, agent for Mr. La,mon requesting that this matter be held over to a later date because owner and agent had not been able to analyze the Subdivision Review Committee's report, After discussion on motion by Commissioner Gerrish, seconded by Commissioner Mathews, and .rantmous ly carried, the matter was carried over to the regular meting of January 6, 1976, LOT SPLIT_CASE,NO_ ^ 15_2 1,_199 TALLY HO_ROAD (HAROLD E, LEE) The Planning Director stated that case was a matter of review of action only,. Errors had been found in the map as well as a previous illegal split, and the Committee had recommended the map be redrawn to correct the illegal action and therefore nothing could be done on the matter at this time ABOH'I.T'ECTTRAL_R y,J WA :E. S TU.PI_..$QN Ordinance No The Planning Director briefly reviewed the Ordi- nance, which deals primarily with the reorganization of the Commission, appointments, and terms of office of its members,: He stated that there were several previous ordinances under which problems had arisen over appointments and reappointments, and this ordinance was adopted May 31, 1966 to eliminate these problems., Resolttion No.. j5 - P - They resolution, which provides for the rules and regulations of the Commission, was briefly reviewed;. The Planning Director stated that, although some of these rules were not used on a day -to -day basis, they were available to the Commission in cases where they were needed or of advantage in the conducting of Commission business, There were several ques- tions pertaining to the matter which the Planning Director answered„ Resolu4onNo_:13_313 - The Planning Director stated that State legis- lation had req,.red, by action in 1972 or early 1973, that every Planning Commission adopt specific procedures in the conduct of public hearings and required that certain documents be made available to the public under reason- able conditions. These: were reviewed for the Commission by the Planning Director ;. ;and after review and a number of questions which were answered, the matter was tabled., 1 1 Dir ctor 187 Arroyo Grande Planning Commission, 12 -2 -75 • Page 2 AGRICULTURAL PRESERVE COMMITTEE The Planning Director reviewed a memo from the City Council asking that two members of the Commission be selected to serve on the Agricultural Preserve Committee. He noted that Councilman Millis and Mr. Ben Dohi were appointed by the City Council; they and two members from the Commission and the Planning Director would make up the Committee,, Commissioners Ries and Moots volunteered to serve on this Committee, and the recommendation was approved by the Chairman and forwarded to the City Council for their accep- tance ADJOURNMENT The Planning Director reminded the Commission of the special meeting set for Monday, December 8, at 7:30 P,M_ for discussion on the Greenwood matter, On motion by Commissioner Mathews, seconded by Commissioner Sandoval, and unanimously carried, the Commission adjourned at 8:15 P,M, to a special session to be held December 8, at 7:30 P,M in the City Council Chambers; the regular meeting of December 16 will be cancelled upon adjournment of the special session,
