PC Minutes 1975-11-18184 Arroyo Grande•Planning Commission November 18, 1975 The Arroyo Grande Planning Commission. met in regular session with Chairman. Calhoon. presiding. Present are Commissioners.Cole, Gerrish, Mathews, Moots, Ries, and Sandoval., Also present is Planning Director Gallop, MINJTE APPROVAL The minutes of the regular meeting of November 4, 1975 were approved as prepared by Chairman Calhoon, CONSIDERATION OF ZONING ORDINANCE CONSISTENCY WITH THE GENERAL Director Gallop stated that several years ago the State Legislature passed a requirement that every city's zoning plan and map be in compliance with their Land Use Plan. He added that they asked for consistency, and this term had caused considerable problems and discussion. He noted that he had attended a conference last summer where one of the speakers was a co- author of the legisla- tion and that he had had tapes of this speech transcribed and copies distributed to the Commission, In the speech, it was indicated that the word "consistency" is meant to indicate that the Zoning Map is compatible, rather than consistent; the words are more or less inter- changeable. Therefore, they would be consistent so long as the zoning did not allow heavier land use or impact than the Land Use Plan in- dicated, The Director then reviewed the Zoning Map, noting various changes which have taken place over the years_ He noted that the boundaries in the Land Use Plan must have some flexibility; the lines should not be considered permanent. Be also noted that the "C -N" Districts are floating districts until such a time as they are actually zoned. All they indicate in the Land Use Plan. is the projected need for this type of development. ' Commissioner Mathews asked if an individual requested a zone change that was compatible with the Land Use Plan and the City denied the request, could that individual sue., Director Gallop stated that this was basically true; however, a requested zone change that was compatible could conceivably be denied for several reasons, such as availability of public services, need, etc.. Bill McCann, 428 Tanner•Lane, asked that the Commission change the Land Use Element to match the present zoning to protect the City in the interim period while the courts make a decision on a lawsuit concerning a previous rezoning request. He stated that he felt the City may have other problems similar to this in the future, and that they should make the Land Use Plan and the Zoning Map identical in order to protect themselves, Director Gallop replied that state law required that they be different; the Land Use Plan is a projection over a twenty year period„ Joe Moore, 200 Nelson, asked that the resolution state that this is a twenty year framework; the Director replied that this is already stated in the Land Use Plan,. After further discussion, the following action was taken.: RESOLUTION NO. 75 -422 On motion by Commissioner Cole, seconded by Commissioner Sandoval, and by the following roll call vote, to wit: AYES: NOES: ABSENT: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DETERMINING THAT THE ZONING ORDINANCE IS CONSISTENT WITH THE GENERAL PLAN, Commissioners Cole, Gerrish, Mathews, Moots, Ries, Sandoval and Chairman Calhoon None None the foregoing Resolution was adopted this 18th day of November, 1975. 1 1 Arroyo Grande Planning Commission,' 11 -18 -75 Page 2 ORAL COMMUNICATIONS Director Gallop requested a study session following the next meeting, dependent upon agenda items, to discuss correct Commission procedure and conduct during meetings.
