COUNCIL: Director.Ga:11.ovrew;i.ewed• the • case.:for.the.Planning :Commiss :ion, The' Planning Commission originally recommended to the City Council that the "P -M" zoning: request on lTraffi c :Way be adopted. . • Howe:ver:, the members of, the • Latter Day Saints Church ,started; that they -had -not received a notice bf the Planning Commission public heari.ng:•because : the'notice had been sent to Salt Lake City. The members of.t.h.e Chur,ch;,:were; concerned at the City Council hearing with • several things: the uses permitted in a "P -M" District, the sight problem that could be•.caused.:by a building; and the - traffic problems that could arise, The matter was referred back "to the Planning Commission from the City Council for consideration of a " -D" override, Director Gallop quoted from sections of the Zoning Ordinance referring to "P -M" District, with regard to uses allowed and those allowed subject to a Use Permit. The Planning Director also reviewed what can be controlled by combining the " -D" Design District with the "P -M" Zone, such things as height of buildings, distances between buildings, etc,:; whatever the Planning Commis- sion decided It wanted to make part of the override. 145 146 Arroyo Gr. nde Planning Commis 6- 1:7 -75 Page 2 Alao, there are some uses vLch may be objectionable in this area and that could be made subject to use permit procedure. It is also possible to make it a requireme ^i that anything that goes into the zone is subject to use permit procedure, The Commission could, in considering the "P -M" zoning with a "-D" ove include any or all of the uses permitted in the "P -M" zone; or they could be selective as to the uses, or make any or all uses in this particular district subject to a use permit procedure, Upon being ,assured by Director Gallop that public hearing for the Rezoning Case No 75 had been dufl y pubs i shed, Chairman Calhoon-declared the hearing open., Elsie Laycock, real estate agent for Mr, Lawler, referred to the 1970 Land Use Element of the• General Plan and stated that it ; indicates a need for this type of district. She also said she didn't understand why t:h,s. 'Church was concerned about traffic; they owned several churches in San Luis Obispo on some of the busiest streets. Dr, R. Dean Robinson, 164 Lincoln Street, San Luis Obispo, stated he is responsible for the Latter Day•Saint Churches throughout.the County, He stated that .the Church was not in opposition to the rezoning;.they were mostly concerned - about what it would involve, He.said he could possibly go along with the 'rezoning i f he could see definite plans for the area, How - :_!9,-, he did not l i k e to have the zone changed first, then the plans . drawn up, He also stated that he had not polled the other property owners in ,the area +ni was interested in knowing whether or not they agreed -with him, Riehard Mors, 633 E Tunnell Street, Santa Maria, said that he be- lieved it ws highly desirable to have close control over what goes into this area, He also felt that perhaps it might be desirableLto' have an area that is limited to residential or some type of development that is compatible with residential. Marie Cattoir, 195 Orcutt Road, stated that; she was concerned about possible rerouting of Highway 227, and she was al:s.o concerned about a future bond issue for road improvement, She would like to know exactly what is planle1 for this area, Commissioner Cole asked Doctor Robinson how often the Church is used, He replied that it is in almost constant use, with plans for even more use as the congregation grows. Mar; Annesley, 2010 Ocean, Oceano, said that she agreed with Doctor Robinson as far as wanting to see plans first, before the rezoning is done. ,_ &arnes "_,ewler, S, Traffic Extension, owner of the property, stated that he could not say what will go into the area an ; t i l. s,_,:rezoned, Chair- man Calhoon asked Mr, Lawler if he had any objection •;toa,.., "- ,D!!,oy,e.rride, He said he did not; he plans to continue to live in the area himself and does not want anything to go in that is not compatible.. - cal . Carroll Dean, 611 Traffic Way, said his only,-concern -was that there would be a tax bond needed to pay for improvements,- ,.su.ch s,- sidewalks, etc: Howard Mankins, 200 Hillcrest Drive, said he felt that a " -D" override was not adequate. He did not believe it allows all• the,-property owners to participate. He felt that a use permit should req,ui- red,,,in a cases, Director Gallop said that the "-D" override could be set up to require this, Doug Jones, 150 Palomar; Pismo Beach, inquired -•sf tthe "-,D" override allowed for controi Over the use permit after it has been ssued, Director Gallop said that any use permit can be set up to be,reviewed later date. Mr, Dean wanted to know if the other property.owners,,would have to improve their portion of the road,at the same time_.that;.the,developer did. Mr. Gallop assured him that they would not be required,.to,.,do so, until such a time as they improved their own property. 1 1 Arroyo Grande Planning Commission, 6 -17 -75 Thomas Gouff, Huasna Road, was present and made reference to the Church's questionable access. There being no further discussion for or against the proposed zone change, Chairman Calhoon declared the public hearing closed. A'.jT',_ST: After discussion, the following action was taken: RESOLUTION NO. 75 - 388 Z A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32, OF SAID CODE, On motion by Commissioner Ries, seconded by Commissioner Cole, and by the following roll call vote, to wit: AYES: Commissioners Cole, Mathews, Ries and Chairman Calhoon NOES: None ABSENT: Commissioners Moots and Sandoval The foregoing Resolution was adopted this 17th day of June 1975.
