April 1, 1975
The Arroyo Grande Planning Commission met in regular session with Chairman
Calhoon presiding. Present are Commissioners Cole, Miller, Moots, Ries and
Sandoval. Commissioner Mathews is absent. Also in attendance are City Admini-
strator Butch, City Engineer Garcia, Councilman de Leon and Planning Director
Gallop.
MINUTE APPROVAL
After hearing no additions or corrections, the minutes of the regular
meeting of March 18, 1975 were approved by the Chairman as prepared.
REVIEW - ARCHITECTURAL APPROVAL, CASE NOS, 75-100 AND 75 -101.
Director Gallop reviewed the two Architectural Committee actions. He
pointed out that McDonald's Restaurant, to be located on Barnett Street, is a
permissive use within the district, and the Committee approved the site and the
structure. With reference to the second Committee action, Patio Home Care,
Director Gallop advised that the owner, Mr. Mulliner, is increasing the facility
by ten bedrooms, and the addition is in keeping with the existing structure.
He pointed out that a Use Permit is required in connection with the expansion.

There being no further discussion, Chairman Calhoon ordered the reports
LAND USE ELEMENT OF THE GENERAL PLAN
As a matter of information, Director Gallop advised the Commission that
the Land Use Element of the General Plan was adopted by the City Council, with-
out change, at their last meeting and is now in effect.
PUBLIC HEARING - USE PERMIT CASE NO. 75 - 233, FREE STANDING SIGN, 410 GRAND AVE.,
MC DONALD'S RESTAURANT FRANCHISE REALTY).
Director Gallop displayed the development plan for the property, advising
that the free standing sign would be located in the southwest corner of the
property; that the property is commercially zoned, and the sign is within the
limits of the district, both as to height and face size.
Upon being assured by Director Gallop that public hearing for Use Permit
Case No. 75 - 233 had been duly published, posted and property owners notified,
Chairman Calhoon declared the hearing open.
Mr. Martin Polin, 1026 Chorro St., San Luis Obispo, stated he owned the
property directly across the street from this location, and spoke in favor of
the proposed development. Mr. Dick Gardner, McDonald's Corporation, was
present and spoke in favor of the Use Permit being granted. Mr. Gardner
presented a rendering of the proposed development, advising that the restaur-
ant will seat 120 people, and parking spaces provided for 74 cars which should
be more than enough for their business.
Mr. Eric Sendler, 1310 - 19th Street, inquired as to the hours of oper-
ation cif tthe sign, Mr. Jim Scravini, Parish Secretary of St. Barnabas Church,
stated he w.s concerned about the aesthetic nature of the sign.
No further discussion for or against the proposed Use Permit, Chairman
;alhoon declared the hearing closed, and the following action was taken:

Director Gallop advised that this case involves the granting of two
variances; 1) the front yard setback, and 2) to allow a fence which exceeds
the maximum on the front property line. These conditions were created by the
City because of the need of widening Elm Street for the public safety, in that
this house was fairly close to the old street, and when the new right-of-way
was established, the fence was necessary to protect this individual's front
yard and privacy.
Upon being assured by Director Gallop that public hearing for Variance
Case No. 75 had been duly published, posted and property owners notified,
Chairman Calhoon declared the hearing open. There being no discussion for

PUBLIC HEARING - VARIANCE CASE NO. 75 - REDUCTION OF FRONT YARD SETBACK

Director Gallop reviewed some of the problems involved, stating that
two building permits were issued for singly family homes on hillside property.
The original plans provided for a joint driveway, which was allowed in order
to minimize the cut on the hillside. After the construction was underway, it
was determined that the construction was approximately 3' higher than the
elevation on the plans which were approved. This 3' difference then made it
impossible to use the garages at that grade because of the increased elevation
The owner worked with the City in an effort to resolve the problem in some
manner, which finally resulted in Mr. Stickler signing a recorded covenant
agreeing to remove the encroachment from the public right -of -way upon 30 days
written notice. Said covenant would go with the land and could be exercised
on the part of the City at any time. Director Gallop further advised that
the carports are now set on the front property line, so that there is no
encroachment into the public right - of - way, however, there is no front yard
setback either. There are 32° in back of the present garage area to the
existing block wall. At one time, it was recommended that the garage be
moved back further into the hill, but there was concern on the part of the
builder that if the hill were cut too deep, it would not support the two
houses. The feeling now is that the hill would support the two houses.
Director Gallop briefed the Commission on the conditions for grant-
ing a variance, i.e., the conditions on these lots which would justify grant-
ing of a variance .. could be topography, shape, size, etc; financial consider-
ation is not a basis for granting a variance.

Mr. T. G. Hawthorne, 616 Coolidge Dr., Oceano, was present and stated
he owned the property adjacent to the property being discussed, and he had
no objection to the requested variance. Mr. Don Stickler, 770 Higuera St.,
San Luis Obispo, owner of the property, reviewed the problem, stating that

Mrs. Dorothy Rector, 545 Le Point Street, inquired if Mr. Stickler
would have to cut back his driveway, if the rest of the driveways would have
to follow. Mr. Jack English, 521 Le Point Street, stated he was concerned
about the public safety on this lot, and requested that the builder go back
to his original building plan. Mrs. Stinson, 562 Le Point Street, inquired
if there had been a change in the building code because of the change of
building inspectors. Director Gallop advised that the building code has
nothing to do with this particular problem. Mr. Grant Lane, 524 Le Point
Street, advised he owns the property east of the property in question, and
inquired if the variance would have any effect on his property with regard
to the driveway. Mr. Lane was assured that the action would not effect him.
Mrs. Rector inquired if this would set a precedence for other property in the
area. Director Gallop advised that the granting of a Variance should not set
a precedence, as each case is considered as an individual problem.
There being no further discussion for or against the proposed Variance,
Chairman Calhoon declared the hearing closed.
Director Gallop pointed out that the structures were built by Mr.
Stickler's contractor and were not built at the approved elevation. He
advised that the City is not responsible for surveying and determining
proper elevations. Mr. Gallop stated that he was completely unaware that
cores had been made of this area, and that he would be interested in seeing
these core tests before a decision is made, to determine if there is any
possibility of moving the garage wall back. With regard to the sight distance
problem, Director Gallop stated it was his feeling that every driveway in the
area has a sight distance problem. City Engineer Garcia advised that pushing
the garage back without cutting the hill down would not help the sight problem
at all.
Director Gallop suggested that the alternatives be mitred before any
