December 3, 1974
The Arroyo Grande Planning Commission met in regular session with Chairman
Calhoon presiding. Present are Commissioners Cole, Muller, Moots, Rues and
Sandoval. Commissioner Mathews is absent. Also in attendance is Planning
Director Gallop.
MINUTE APPROVAL
Upon hearing. no corrections or. additions, the.minutc,s oo, the r_qular
meeting of November 19, 1974 were approved by the Chairman as prepared.
CONSIDERATION OF NEGATIVE ENVIRONMENTAL IMPACT REPORT_ - PARCEL MAP NO._
AG - 74 - 275, CORBETT CANYON ROAD WILHOLM
Director Gallop described and explained the negative report a.s prepared
by the developer's engineer, and recommended its acceptance. After a brief
discussion, the following action was taken:

REVIEW - USE PERMIT CASE NO. 69 -147, POSTER PANEL STRUCTURE ORAND GRAND AVkEN.19E WEST
OF JUNIPER ST. (RYAN OUTDOOR ADVERTISING CO.).
Planning Director Gallop passed the Minute Book covering the Planning
Commission action of October 7, 1969, at which time the poster panel in question was approved. In view of the fact that the Ryan Company diddunotre
have a representative present, the Planning Director recommended that a one
year extension be granted and that at the end of one year, the Commission,
consider termination of the Use Permit.
After discussion, the following action was taken:

On motion by Commissioner Cole, seconded by Commissioner Sandoval, and

PUBLIC HEARING - REZONING CASE NO. 74 - 77, R -1 SINGLE FAMILY RESIDENTIAL D I ST.
TO R -1 -D SINGLE FAMILY RESIDENTIAL DISTRICT WITH " -D OVERRIDEO' FOR HEIGHT
LIMIT CONTROL.
Commissioner Sandoval requested to be excused because of a conflict of
interest. The Chairman granted the request and Commissioner Sandoval is NOW
absent.
The Planning Director explained the petition which brought: but the
public hearing and explained the differential of existing pad e1tvatio,s in
relationship to Corona del Terra curb height in comparison to the two upper
lots to the curb height and average building height of structures on Montego.

The three remaining building sites on the south side Brighton were also
included in the discussion. It was noted that all of the 'd :t on the east
side of Corona del Terra now have a building permit issued . h and,
therefore, no action can be taken to limit those lots. It was also noted
that the two upper lots below Montego were of such an elevation abovee curb
that a 17' limitation above curb height would restrict construction to
approximately 10' or 12', and that even a two story house would not infer=
fere with the view of those houses on Montego because there was an approxi-
mate 30' difference in elevation between curb height of Corona del Terra and
Montego.
The Planning Director also stated that he was concerned that placing a
height limitation on five undeveloped lots after all of the other lots of the
subdivision had been built would be imposing a constraint which would be un-
realistic in view of the other construction in the subdivision.
With reference to the Ruth Ann Way Assessment District development, he
stated that, In his opinion, until such time that grading plans have been pre-
pared, that It would be Impossible to consider placing any sort of a height
restriction on any one or all of those lots because there is a considerable
difference between existing terrain of the total aroi, Mr. gallop recommended
that the Commission deny the total "D'' Override xone chenge request, and that
staff be requested to "flag" Ruth Ann Way devolopment for consideration or
height limitations when grading and development plans have been preiseeted.
After the presentation by the Planning Director, and upon assurance
that public hearing for Rezoning Case No. 74.77 had been duly published and
property owners notified, Chairman Calhoon declared the hearing open.
Mrs. Stella Nobles, 1239 Montego, requested additional clarification on
the problem involved between curb height, pad elevation and structural heights.
The Planning Director reviewed this again for the audience and Commission. Mr.
Carpentier, 1243 Montego, stated that the houses on the south side of Montego
have been limited to an 11' height above curb. The Planning Director noted
that even with the 11' height limitation above curb, that two story houses
could still be built by taking advantage of the terrain south of Montego.
He also noted that in Mr. Carpentier's situation, that the 11' height limit-
ation applied to the higher curb elevation of Montego, and that the curb drop
is approximately 2' within the carpentier property, which allowed him 13' of
construction height on the westerly end of the lot. Mr. Bill Prather, 2218
Glacier Lane, Santa Maria, developer of the property, stated that on the south
side of Brighton they plan only single story homes such as the two already
built, which would not create a vision problem to the houses on the north
side of Brighton which are approximately 8' above curb grade.
Mrs. Elizabeth Jackson, 208 Fairview Drive, stated that she had no
-objections to the proposals, but was concerned that all of the development
takes place uniformly, and she inquired as to whether any of the lots within
Ruth Ann Way Assessment District could be built immediately, other than the
two which had been built on the north side of Brighton. The Planning Director
stated that there were two lots on the south side of Brighton,granted by a
parcel map, which could be constructed immediately, and one lot on the extreme
northerly end of the Assessment District area which has access to lower Newport
could be developed, otherwise, no new construction could take place until the
Assessment District and subdivision have been approved.
Mrs. Noble asked if a public hearing would be held on the subdivision
proposal on Ruth Ann Way. The Planning Director stated that a public hearing
on the Assessment District would be held by the City Council, but a public
hearing was not required for the subdivision, however, if she would call the
Planning Commission Secretary, an agenda could be sent to her when the sub-
division was to be considered by the Commission.
There being no fruther discussion for or against the proposed rezon-
ing, Chairman Calhoon declared the hearing closed.

RUTH ANN WAY DEVELOPMENT
On motion by Commissioner Ries, seconded by Commissioner Miller, and
unanimously carried, the staff was requested to consider height control limit-
ations In connection with the Ruth Ann Way Assessment District grading and
development plan when presented, and on any lot splits considered in connection
with the development.
COMMISSIONER SANDOVAL REJOINED THE COMMISSION AND IS NOW PRESENT.
ADJOURNMENT
There being no further business before the Commission, on motion by
Commissioner Moots, seconded by Commissioner Sandoval, and unanimously carried,
the meeting was adjourned at 8:25 P.M.
