PC Minutes 1973-04-03478 Arroyo Grande Planning Commission April 3, 1973 The Arroyo Grande Planning Commission met in regular session with Chairman Jones presiding. Present are Commissioners Calhoon, Goulart, Gullickson, Pope, and Spierling. Commissioner Porter is absent. Also in attendance are Councilman Talley, City Administrator Butch and Planning Director Gallop. MINUTE APPROVAL On motion by Commissioner Gullickson, seconded by Commissioner Spierling, and carried, the minutes of the regular meeting of February 20, 1973 were approved as prepared. ELECTION OF VICE CHAIRMAN, AND RECOMMENDATION OF REPRESENTATIVE TO THE COASTAL VALLEY PLANNING COUNCIL Chairman Jones opened the nominations for Vice Chairman to fill the un- expired term of Roger St. Denis. Commissioner Spierling moved that the name of Hugh Pope be placed in nomination for Vice Chairman. Commissioner Gullickson seconded the nomination and moved that nominations be closed. Motion carried. Director Gallop pointed out that the resignation of Roger St. Denis also left a vacancy on the Coastal Valley Planning Council, and that the Council meets the first Monday of each month. Commissioner Spierling volunteered to serve as the Commission's representative to this Council, and the Chairman requested that a recommendation be made to the City Council appointing Mr. Spierling as representative to the Coastal Valley Planning Council. REQUEST FROM L. C. LA VINE, 141 TALLY HO ROAD, TO CONSTRUCT GREENHOUSES Director Gallop advised the property in question is in the RA -B3 District and consists of approximately five to six acres. He 'pointed out that under the RA zoning it is clearly stated that agricultural uses are permitted, however, greenhouses are not specifically set out. He stated he felt a greenhouse would be a reasonable use of the property, however, a Commission determination is needed to the effect this is a permis- sive use in the R -A District, or that it is permissive subject to Use Permit procedure. If the Commission determines this is a permissive use, the adoption of a Resolution will be necessary and this then becomes an admini- strative guide for similar requests in the future. COMMISSIONER PORTER ENTERED THE MEETING Director Gallop recommended that if the Commission determines this is a permissive use in the R -A District, that it be by Use Permit procedure for better control as to location with relationship to other buildings, streets, etc. After a brief discussion, the following action was taken: RESOLUTION NO. 73 -286 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DETERMINING THAT GREENHOUSES ARE A PERMISSIVE USE IN AN RA -B3 DISTRICT SUBJECT TO USE PERMIT PROCEDURE. On motion by Commissioner Pope, seconded by Commissioner Spierling, and by the following roll call vote, to wit: AYES: Commissioners Calhoon, Goulart, Gullickson, Pope, Porter, Spierling and Chairman Jones. NOES: None ABSENT: None The foregoing Resolution was adopted this 3rd day of April 1973. REQUEST TO CONSIDER A -D OVERRIDE TO THE R -1 ZONE IN TRACT 150, BLOCKS 2 AND 3, SOUTH SIDE OF MONTEGO ST, Director Gallop advised that when Ordinance 32 C.S. was originally adopted, there was a paragraph which attempted to establish a view control arrangement, but that several cities in the state had a similar resolution, which had been declared illegal under the conditions which it was established. Arroyo Grande Planning Commission, 4 - - Page 2. Consequently, we eliminated this paragraph from the ordinance and adopted the " -D Override" instead. The -D Override was adopted to use where it is desirable to place particular controls on properties, and can be used on height, size, location, buildings, fences, etc. Director Gallop cited a problem about a year ago with a new house on the lower side of Montego, but that through negotiation with the builder, he did lower the profile of the house considerably and, as a result of this condition, the -D Override was adopted. Also, as a result of that construction and until such time controls were established, the City Council asked that any building permit on the south side of Montego be referred to them for approval. Some of the property owners in the area filed a petition that this -D Override be established on Blocks 2 and 3 for this view control. They have suggested an 11' maximum height in relationship to the curb. Mr. Gallop stated he was not sure this is a valid height, and that if the Commission initiates a zone change, a study will be made of all existing heights in the area. He further advised that there are six lots that would be affected by this -D Override, and it was suggested that only Blocks 2 and 3 of Tract 150 be affected by this Override. RESOLUTION NO. 73 - 287 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE EXPRESSING INTENTION TO INITIATE A ZONE CHANGE TO. CREATE A "-D OVERRIDE" DISTRICT. On motion by Commissioner Goulart, seconded by Commissioner. Porter, and by the following roll call vote, to wit: AYES: Commissioners Calhoon, Goulart,. Gullickson, Pope, Porter Spierling and Chairman Jones NOES: None ABSENT: None The foregoing Resolution was adopted this 3rd. day of April 1973. PUBLIC HEARING - PROPOSED STREET NAME CHANGE - "FRONTAGE ROAD" TO "EL CAMINO REAL ". Director Gallop advised that the proposed street name change is ,a recom- mendation from the Coastal Valley Planning Council and is a result of the street name and property identification study which has been going on for about three years, and the matter has been before the Commission several times and has been approved, however, in the 'past, the City Council has not seen fit to act on the recommendation. He pointed out that the street in question commences just about in the center of the Cemetery property and comes southerly to the northerly end of Barnett. The recommendation was originally made to the Cities of Pismo Beach, Grover City, Arroyo Grande and San Luis County. All have changed the name of the street to El Camino Real, with the exception of Arroyo Grande. Upon being assured by Director Gallop that all property'owners which abut the street have been notified, Chairman Jones declared the hearing open. There being no discussion for or against the proposed street name change, Chairman Jones declared the hearing closed, and the following action was taken: RESOLUTION NO. 73 -288 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING CHANGING THE NAME OF "FRONTAGE ROAD" LOCATED ON THE SOUTHERLY SIDE OF HIGHWAY 101, BEGINNING AT A.POINT ON THE NORTHERLY END OF. BARNETT STREET NORTHWESTERLY TO THE WEST CITY LIMITS, TO "EL CAMINO REAL"- . PUBLIC HEARING - USE PERMIT CASE NO. 73-206, CHURCH AND SCHOOL USAGE IN AN R -3' DISTRICT 117 POOLE ST. CENTRAL COAST CHRISTIAN ACADEMY & FIRST PRESBYTERIAN CH.) Director Gallop advised that the property is predominantly owned by the Presbyterian Church and a Use Permit was sought and granted to the Central Coast Christian Academy for elementary school usage, and since that time additional property has been acquired by the Church. In addition to the newly acquired property, a piece of property was inadvertently omitted from the original request, and the Church is now requesting this new property be included in the Use Permit and the property which had been omitted. Director Gallop recommended that curb, gutter and sidewalks be required on any portion of the church ownership which is not now improved. Upon being assured by Director Gallop that public hearing for Use Permit Case No. 73 -206 had been duly published, posted and property owners notified, Chairman Jones declared the hearing open. Mr. Byron Scott, 121 Poole Street, stated he was an adjacent property owner and was concerned about the 14 ft. strip adjacent to his property. Mr. Marvin Hartwig, representing the Church, stated they wanted to include the 14 x 100 ft. strip just in case a youngster did venture in that area, but that they have closed the use of the area to the school by installing a gate. In answer to Mr. Scott's question regarding loading and unloading, Mr. Marlin Miller, 327 So. Mason, Principal of the School, advised that they will probably extend the unloading zone to the other area, and the reason they don't unload around on Bridge Street is because of the traffic situation. Mr. Scott stated he didn't see any problems with this arrangement, and commented about the added school bus traffic on Poole Street by the Lucia Mar School District. No further discussion for or against the proposed Use Permit, Chairman Jones declared the hearing closed. Director Gallop pointed out that there is a problem on Traffic Way being a traffic bottleneck and that several different solutions are being considered. He suggested that the Commission refer the problem of parking and loading in the Church area on all abutting streets to the Traffic and Parking Commission for their consideration. After further discussion, the following action was taken: RESOLUTION NO. 73-289 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 73 -206. On motion by Commissioner Pope, seconded by Commissioner Goulart, and by the following roll call vote, to wit: AYES: Commissioners Calhoon, Goulart, Gullickson, Pope, Porter, Spierling and Chairman Jones. NOES: None ABSENT: None The foregoing Resolution was adopted this 3rd day of April 1973. PUBLIC HEARING - REZONING CASE NO. 73 - 67, SO. ELM STREET AND THE PIKE - P -D DISTRICT TO R -1 DISTRICT (COASTAL CONSTRUCTION CO. AND R. D. GRAY CONSTR. Director Gallop reviewed that the request is to rezone a parcel of property, consisting of approximately 20 acres, northerly of The Pike and easterly of Efm Street, excepting the five acres in the northeast corner of Arroyo Grande Planning Commission, 4 - - Page 4 the intersection. He further advised that about three years ago this property was rezoned to P -D District for small lot development for retired people. In the meantime a different owner has picked up the property and they are desirous of developing as R'1 instead of P-D. Director Gallop further advised that the petition, at his request, also includes a small portion of the property within Tract No. 463 to R-1 in keeping with that subdivision development to eliminate what would be a small P -D sliver. Upon being assured by Director Gallop that public hearing for Rezoning Case No 73 - had been duly published, posted and property owners notified, Chairman Jones declared the hearing open. Mr. Ron Gray, one of the owners of the property, was present and advised they plan to construct single family homes on the property and make it a nice development. No further discussion for or against the proposed zone change, Chairman Jones declared the hearing closed and the following action was taken: RESOLUTION NO. 73-290 Z RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4, ARTICLE 21, OF SAID CODE. On motion by Commissioner Porter, seconded by Commissioner Goulart, and on the following roll call vote, to wit: AYES: Commissioners Calhoon, Goulart, Gullickson, Pope, Porter, Spierling and Chairman Jones NOES: None ABSENT: None The foregoing Resolution was adopted this 3rd day of April 1973. AMENDED MAP - TRACT NO. 456, "VERDE PARK" Director Gallop reviewed that on the Tentative Map for Tract 456, the property on which Mr. Green's house is located was not included in the Sub- division, and that the house sits on the proposed plan line for the widening. of Elm Street. An agreement has now been reached whereby the southerly part. of Lot 3, all of Lot 4 and the northerly part of Lot 5 would have a temporary berm which would restrict off - street improvements, and a separate restriction on this condition pertaining to Lot 4 to be recorded as a deed restriction, and not a part of the subdivision map, where it would be pulled back and the full improvements would go in. Also,.rather than a dog leg street, a cul -de -sac is to be considered off of The Pike. He advised that the amended map was taken to the Subdivision Board and was approved by them and the staff. The map was not recommended for referral back to the Commission, and is being brought up only as a matter of information. GENERAL PLANNING DISCUSSION AND STUDY SESSION In view of the lateness of the hour, it was agreed that the study session would be held at the next regular Commission meeting. CITIZENS' COMMITTEE There was considerable discussion regarding the City Council's consideration of a proposed Citizens' Committee to work with the Planning Commission. Councilman Talley pointed out that there were a couple of problem areas where citizens have protested zone changes, and it appears there are problems dealing with specific areas. FINAL DEVELOPMENT PLANS - CIELO VISTA MOBILEHOME PARK Commissioner Goulart questioned as to whether final development plans had been approved by the Commission as required. Director Gallop advised he was certain they had been, but would review the files and advise the Commission of his findings..
