PC Minutes 1972-12-191 Arroyo Grande Planning .Cosh D.ca b.P 19, 1972 MINUTE APPRQVAL On motion by Commissioner Gullickson, seconded by rommiss:::ner Berryhill, and unanimously carried, the minutes of the regular meeting of December 5, 1972 were approved as prepared: Since Mr. Kraatz, Engineer for the developer, was not present the matter was carried over until after the scheduled public hearings. PUBLIC HEARING - USE PERMIT CASE NO. 72-201 - JOSEPH AIRE•V. MULTI - STRUCTURE APARTMENT COMPLEX .- NORTHEAST CORNER OF FARROLL AVENUE AND ELM STREET Director Gallop stated that the reason this development requires a use .permit under R -3 zoning is because these is more Char one structure proposed on a single parcel of property. The development ik proposed on the 31 aLres plus and is :located in the northeast corner o- F3rrc I 1 Avenue and Elm Street and consists of 7 structures; four structures .arc residential, ter:: for parking and one for recreational and mechan' cal. Present are Coexiissloners Berryhill, Gullickson,: Jones, Pope, Porter and St. Denis. Also in attendance are Planning Director Gallop and Councilman Millis. REVIEW - usg PERMIT CAS NO. 72 - 194 - OR. PEPPER WAREHOUSE & STORAGE YARD - 111 ALDER STREET (ROBERT FOLKERTS . Director Gallop adv sed that the. Use Permit was gr,nted June 2 0, 1972 and will remain in effect until June 20, 1973, and he understands that the property has been sold and that the use permit will not be exercised, however, it ;.)u1d be utillzed even under the new ownership. ... On motion by Commissioner Porter, seconded by Commissioner St. Denis, and unanimously carried, that Use Permit Case Nc. 72 -194 be reviewed in 90 days. REVIEW - TENTATIVE SUBDIVISION MAP. TRACT NO. 456 Director Gallop stated that the proposed subdivision is located on the northeast corner of Elm Street and The Pike. The subdivision, as filed by the owner, consists of 16 lots and does not include property on which his horse is located and the property between his home and the corner of the intersection. Mr. Gallcp advised that the staff has recommended that the total ownership be inc;uded it the sub- division because of potential problems by leaving property out. Director Gallop pointed out that the other conditions listed in the report . are based on the assumption that this property be included. The total area to be developed is 4.05 acres after the required right -cf -way is taken from the property, and the required fees are not assessed on the right -of -way take. He advised that both The.Pike and Eim Street are plan lined. Director Gallop further noted that it is possible they could create 4 or 5 additional lots by including all property, and it is the only way the City can really control the development of the intersection area where there is considerable traffic; also there is a flooding problem during the rainy season and, therefore, the staff recommends the property be Included. It was pointed out that there are two wells on the property and one well is . presently being used for domestic use. The Health Department has requested that the wells be capped and cannot be used for domestic use. With regard to Environmental ' impact Reports, Director Gallop advised that he fully intends to proceed with the reports and have them on file. if the subdivision is approved, then it will be considered for environmental impact and will be brought back before the Commission for a decision based on the staff's recommendation. In answer to Chairman Nunes' question regarding the wells, Director Gallop advised that the wells could not be used for domestic purposes, however, it may be that they could be used for irrigational purposes and, therefore, they are not making the recommendation at this time that these wells be filled and capped. The Health Department stated that if the developer feels it is advantageous to use them for irrigation purposes, it is possible they could remain.- Director Gallop advised that this property is presently being rezoned to R -1 under the action of this Commission, so the zoning will be proper for this subdivision. A rands Planning Commission, 12 -19 -72 Page 2 -• -The complex is being built on private streets, which means that everything inside the property line is private and is the developer's responsibility to develop and maintain. Director Gallop pointed out that the development has received architectural approval and read the conditions listed in the Architectural Committee Action of December 6, 1972. Upon being assured by Director Gallop that public hearing for Use Permit Case No. 72 -201 had been duly published, posted and property owners notified, Chairman Nunes declared the hearing open. Don Heldeprem, 160 So. Elm Street; Jack Scarborough, 166 So. Elm Street; and Doris Olson, 400 So. Elm Street, were present and objected to the use permit being granted because of the additional traffic on Elm Street. No further discussion for or against the proposed use permit, Chairman Nunes declared the hearing closed. With regard to the City's program on the widening of Elm Street, Director Gallop advised that the City has authorized the Director of Public Works to proceed with acquisition of property in order to continue the underground drain line. to the ponding area, and to his understanding, the Elm Street widening protect Is still in the working stages, Ths' first stags will, go from Popular to Ash, the second stage will take it down to Parroll, and at a later time it will go to The Pike, The drainage has to go from Grand Avenue to Ash Str eet in order to carry that water underground to the drainage pond already created, Director Del.lop 'stated if this development goes in, this w111 complete the full improvement on the east side of Elm Street, and it was his feeling that the streets In this area are adequate to carry the projected traffic being discussed. After discussion by the Commission, the following action was tokens RESOLUTION NO. 72 -276 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 72 -201. He pointed out that there is an existing apartment on the back of this building at the present time and the addition would merely be an extension of the existing. apartment. He advised the apartment there now has access on to an undeveloped area, which Is an extension of the parking lot behind the Bank of America. Director Gallop recommended that if the Vertenee Is granted, it be on the condition that the parking lot be improved, and stated that Mr. Grant Intends to do this. Upon being assured by Director Gallop that the public hearing for Variance Case No. 72 -49 had been duly published, pasted and property owners notified, Chairman Nunes declared the hearing open. As there was no discussion for or against the proposed Variance being granted, Chairmen Nunes declared the hearing closed. Arroyo Grande Planning Commission 12 -19 -72 ' Page 3 Director Gallop advised that the Commission has granted residential expansion within the CBD district In the past, and that since the roof and structural condition of the building is bad, Mr. Grant has to protect what is there by rehabilitation of the building, and the apartments would be incorporated into that rehabilitation. He pointed out this would be a temporary commercial residential use 1 ( After further discussion, the following action was taken: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 72 -49. CONTINUATION - REVIEW OF TENTATIVE SUBDIVISION MAP NO. 4 6 Mr. Lowell Kraatz is now present and advised the Commission that the location of the residence creates a problem because it Is right on the plan line, and the garage is three feet over the plan line. He pointed out that if they are to develop the property the way the staff has recommended, they will have problems with the residence, and this is the main reason they left that parcel of property out of the subdivision. He further indicated that the house was built in 1956 and is in good shape. Director Gallop suggested that if there is an 8° parkway behind the curb to the property line, this would still clear the house and garage, a.nd:stated that this is the reference which was made in the staff report to some pos's-1b;l consideration to Elm Street plan line adjustment in this particular area, and_ - Director of Public Works Anderson had indicated that the sidewalk requirement could be eliminated in this area. Mr. Kraatz commented that if the City insists that the property be included in the subdivision, there may be a way around It by using block walls at the curb line and a variance or two on setbacks to leave the present residence as it is, and the Commission took note of this potential. RESOLUTION NO. 72 -277 V After discussion, the following action was taken: RESOLUTION NO. 72 -278 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE SUBDIVISION MAP FOR TRACT NO. 456, AND REFERRAL TO THE CITY COUNCIL FOR INFORMATIONAL PURPOSES ONLY. On motion by Commissioner Pope, seconded by Commissioner Berryhill, and on the following roll call vote, to wit: AYES :. Commissioners Berryhill, Gullickson, Jones, Pope, Porter, St. Denis and Chairman Nunes NOES: None ABSENT: None the foregoing resolution was adopted this 19th day of December 1972. PRESENTATION TO CHAIRMAN NUNES Director Gallop advised that the City Council had accepted, with regret, Chairman Nunes° resignation to the Commission, and have appointed Mr. Al Splerling to fill Mr. Nunes' term, effective 12- 19-72. Mr. Gallop presented Chairman Nunes with his name plates from the Commission, and a Certificate of Appreciation from the City Council for his services to the City.
