November 21, 1972
The Planning Commission met in regular session with Chairman Nunes pre-
siding. Present are Commissioners Berryhill, Gulllckson, Pope, Porter and St. Denis.
Commissioner Jones is absent. Also in attendance are City Administrator Butch and
Planning Director Gallop.
MINUTE APPROVAL
On motion by Commissioner Gulllckson, seconded by Commissioner St. Denis,
and unanimously carried, the minutes of the adjourned meeting of November 8, 1972
were approved as prepared.
ENVIRONMENTAL IMPACT REPORT
Director Gallop advised that a second list of building permits was given to
the Commission with their agenda material, and that these are all building permits
falling within Category 1 of Resolution 1010. A committee report has been made on
these items with the recommendation that they be accepted by the Commission.
Director Gallop pointed out that there is one single family home permit on
which the environmental aspects have been questioned by an attorney. The home is
proposed for construction on Brisco Hill at 1542 Hillcrest Drive. The individual
questioning the effect of the construction lives at 1533 Hillcrest Drive, directly
across the street. The Committee met and considered this one particular residence.
The plans were evaluated and a survey was made on the site, It was determined
from the plans and from actual investigation on the site, that the peak of the
new house will be 14' above the crown of Hillcrest. Director Gallop pointed out
that an average single story dwelling unit built to grade on a level lot will
normally be 14' to 17' from the crown of the street to the peak of the house; in
other words, the house in question is actually one to two feet lower than a single
story house in a flat subdivision in relationship to the street which serves it.
He further advised that the challenge was made on the basis of being built on a
hillside and obstructing vision and, after investigation, the Committee made the
determination that there was no environmental affect on this particular building
permit and it is included as falling within Category I and on the list of build-
ing permits being recommended by the Committee for acceptance by the Commission.
After discussion, on motion by Commissioner Berryhill, seconded by
Commissioner Porter, and unanimously carried, that the Environmental Impact
Staff Committee Report, dated November 16, 1972, be accepted by the Planning
Commission, and acknowledged that all projects listed fall within Category I
of Resolution No. 1010.
Mr. A. Olpin, Attorney for Mr. Nelson,of 1533 Hillcrest Drive, was present
and listed his reasons for questioning the placement of the subject permit in
Category I. He further stated that, in his opinion, in a situation of this type
there are enough possible problems that an attempt should be made to consult one
or two experts; and that in this particular type of a case, city officials are
put in a very difficult position when another city official is involved as one
of the parties, which is another reason why he thought outside experts should
have been, and could still be consulted to make sure this is done correctly.
COMMISSIONER JONES ENTERED THE MEETING DURING THE ABOVE. DISCUSSION
Director Gallop pointed out that Mr. Garing is not a full time employee
of the City, and that he recently completed a full week of a very in study
course at the University of California In the preparation and analyzing for
environmental impact reports, and Mr. Gering attended the school as an indi-
vidual engineer.
The Commission felt that the additional information was not sufficient
to reopen the matter. Mr. Olpin was advised that he or Mr. Nelson had the
right to appeal the decision to the City Council.
PUBLIC HEARING - REZONING CASE NO,, 72 -64 ARROYO GRANDE COMMUNITY HOSPITAL.
SOUTH HALCYON ROAD - RA -B3 DISTRICT TO P-C DISTRICT,
Director Gallop advised that the property involved is approximately five
acres and is located on the southeasterly end of Fair Oaks Avenue adjacent to
the creek and to the Arroyo Grande Community Hospital, He advised that the
petition was filed by the Arroyo Grande Community Hospital and it is their -
intention to expand the hospital structure itself and to provide for a medical
clinic structure. Director Gallop advised, after discussing the matter with
Director of Public Works Anderson and City Engineer. Gering, it is recommended

that an offer of dedication of a minimum of ten feet above the top of the bank and
the streambed area be made for green belt and flood control purposes, and that the
developer be made aware of the necessity of a street development in the easterly
portion of the property adjacent to the streambed for access to the north, but that
until we know how the property Is to be developed, that the street be held in
abeyance at this time.
Upon being assured by Director Gallop that notice of public hearing for
Rezoning Case No. 72 -64 had been duly posted, published and property owners
notified, Chairman Nunes declared the hearing open.
Mr. Grieb, Rt. 1, Box 754, Arroyo Grande, inquired if this zone change would
involve the Grieb property or cause the taxes to be increased? Chairman Nunes
advised the property is adjacent to the Grieb property, and that the County Assessor's
office assesses the property on the basis of the best potential use of the property,
and that the Planning Commission has no control over the assessment or taxes.
With reference to the proposed street, Director Gallop advised that the street
will come at a later date; that he doesn't know where It will be; and that when the
street is proposed, it will be approved only ). it becomes beneficial to all
abutting properties.
Mr. Paul Meyer, Administrator of the Arroyo Grande Community Hospital,
stated the intent Is to expand the hospital and provide medical offices to afford
better hospital facilities for the South County area and for the City of Arroyo
Grande. Mr. Meyer commented that, with reference to the recommendations, they
would provide for deeding a minimum of ten feet above the top of the bank and the
streambed to the City for green belt and flood control purposes, and it would be
agreeable with the hospital for any proposal for street development to provide
access to the property to the north.
Mrs. Barbara Grieb Inquired If this would force the road through the Grieb
property again. Chairman Nunes advised the road will come through at a later date,
depending on how the property develops. Director Gallop advised when the street
location is considered, they will also consider the affect on the abutting properties
to see that these properties are developed to the best Interests of the owners and
future owners.
In answer to Commissioner Berryhill's question as to possible conflict of the
rezoning and the General Plan, Director Gallop advised that, in his opinion, the re-
zoning of the property from RA -B3 District to P -C District would not be in conflict
with the,General Plan,
No further discussion for or against the proposed rezoning, Chairman Nunes

PUBLIC HEARING - USE PERMIT CASE NO 2 -200 HIGHWAY 101 DOKO PROPERTY -
EQUIPMENT YARD - R, BAKER CONSTRUCTION CO
Director Gallop advised the request Is for temporary use for a construction
yard, and involves the same property that recently was abandoned by a trucking
company. He pointed out that the buildings are still existing and that this use
would be a continuation of a non - conforming legal use. He advised that the staff
would have no objections to a temporary use permit being granted for 6 to 8 months,
provided a 30 day cancellation clause is Included, but would oppose any slm.11ar

permanent type:of use being permitted either by use permit or by rezoning. He
further advised he had discussed the proposed use permit with Mr. Al Browne,
abutting property owner, and Mr. Browne agreed to the use as a temporary arrange-
ment. The Commission was advised that Mr. Baker is in the pipeline construction
business.
Upon being assured by Director Gallop that public hearing for Use Permit
Case No. 72 -200 had been duly published, posted and property owners notified,
Chairman Nunes declared the hearing open.
Mr. Robert Baker, 2100 Shoreline Drive, Pismo Beach, was present and
advised the request is for temporary use of the buildings and office until he can
locate other facilities, mainly to get through the winter season, and that six to
eight months would be adequate. He advised he would be using the existing buildings
primarily for maintenance work.
No further discussion for or against the proposed Use Permit, Chairman Nunes
declared the hearing closed, and the following action was taken:
