PC Minutes 1972-03-21414 Arroyo Grande Planning Commission March 21, 1972 The Arroyo Grande Planning Commission met in regular session with Chairman Schultz presiding. Present are Commissioners Bowles, Berryhill, Jones, Nunes and St. Denis. Commissioner Porter is absent. Also in attendance is Planning Director Gallop. MINUTE APPROVAL On motion of Commissioner Bowles, seconded by Commissioner Berryhill, and unanimously carried, the minutes of the regular meeting of February 7,, 1j /2 were approved as prepared. REFERRAL - LOT SPLIT CASE NO. 71 -147, FAIR OAKS AVE. - M. BETITA Chairman Schultz requested Planning Director Gallop to outline the case and the reason for its being before the Commission. The Planning Director explained that the matter had been denied by the Lot Split Committee, approved by the Planning Commission and appealed to the City Council, and the City Council had returned it to the Commission because the petitioner had requested one additional lot being created in the parcel map. Mr. Max Hirdler, 811 Fair Oaks Avenue, objected to granting the split, question- ing the public services right to enter property on a private drive, such as Police and Fire Departments. Mr. Hirdler outlined a number of easements which were of record over the property, and noted that the property was higher than surrounding lots and expressed concern about drainage. Mr. O'Donnell, representing the petitioner, explained some of the easements would be erased and were not needed because they were provided for other purposes and would not be required for this division, and that the proposed lots were large enough to protect existing ease- ments which had to be observed. Mr. O'Donnell also explained efforts which he had made in contacting abutting property owners to dispose of the interior property., He noted that of the several letters written, none of the abutting property owners, other than Mr. Doeckel, expressed interest, and it was Mr. Doeckel who was interested in buying Parcel D of the new map. COMMISSIONER PORTER ENTERED THE MEETING DURING THE ABOVE DISCUSSION Mr. Matthew Gallagher, 520 Leanna Drive, commented that he was of the opinion that the origin of this lot, by its shape, location and size, was obviously intended to be a neighborhood park, and requested that the Commission make an effort to revert the property for park purposes. He also stated that it was his understanding that a private driveway such as proposed should be 30 feet wide, not 20 feet wide. Mr. Bernard Landsman, Newman Drive, stated he felt that the property should be a park and requested City consideration to purchase for that use. Mr. Gallop explained that the City had considered this but could not pay $15,000, the asking price, for a small parcel of property when an equal amount of money would provide a much larger facility for the taxpayers of the City. Mr. Don Doeckel, 450 Woodland Drive, stated that he had filed the original appeal; that he had negotiated to purchase a parcel of the property, and that he and his wife had made an effort to interest others in the neighborhood to buy the property without success. He advised he was now in favor of granting the split in order that the property could be cleaned up and eliminate a very unsatisfactory situation. Mrs. Imogene Brown, 420 Woodland Drive, whose property abuts the subject property, stated she would not want additional houses built adjacent to her property and recommended against granting the lot split. Mr. Robert Goulart, 801 Opal Drive, stated he felt it was the intent of the original developer that this property should be for park purposes and recom- mended against granting the split. Mr. Hirdler again stated that he felt the easement access to the property not being public would be of detriment to the neighboring lot and felt that by granting the split would be granting a variance to the lot which faces on Fair Oaks Avenue. After general discussion of the matter by members of the Commission and the audience, the following action was taken: Arroyo Grande Planning Commission, 3 -21 -72 Page 2 On motion of Commissioner Nunes, seconded by Commissioner Jones, and on the following roll call vote to wit: AYES: Commissioners Jones, Nunes, Porter, St. Denis and Chairman Schultz NOES: Commissioner Berryhill ABSTAIN: Commissioner Bowles ABSENT: None the foregoing Resolution was adopted this 21st day of March, 1972. MONTEREY COUNTY PLANNING COUNCIL ANNUAL CONFERENCE Director Gallop announced the annual Planning Conference to be held in Carmel on April 8th, and requested that Commission members interested in attending the conference to contact him. STUDY SESSION - ZONING ORDINANCE CHANGES A study session was held on the proposed changes to the Zoning Ordinance. ADJOURNMENT There being no further business before the Commission, on motion of Commissioner Porter, seconded by Commissioner Jones, and unanimously carried, the meeting was adjourned at 9:30 P.M.
