PC Minutes 1971-03-16Arroyo Grande Planning Commission March 16, 1971 The Planning Commission met in regular session with Chairman Moss. presiding. Present are Commissioners Bowles, Nunes, Porter, St. Denis, Schultz and Strother. Also in attendance are Mayor Levine, Councilman Wood, City Administrator Butch and Planning Director Gallop. APPROVAL OF MINUTES On motion of Commissioner Bowles, seconded•by Commissioner Schultz, and unanimously carried, the minutes of the regular meeting of March'2,. 1971. were-approved as prepared. REVIEW OF EXISTING BLOCK WALL - BEACON OIL STATION 610 GRAND AVENUE Director Gallop advised that Mr. Gomes, of Beacon Oil, had called him from Bakersfield Monday afternoon and they had just received the agenda. Mr. Gomes advised it would be impossible to attend the meeting and asked if this matter could be set over to the next meeting so that they could be present, and that they have some plans they would like to discuss. On motion of Commissioner Strother, seconded by Commissioner Nunes, and unanimously carried, that this matter be carries over to the next regular meeting of the Planning Commission. REQUEST FOR EXTENSION, USE PERMIT CASE 68- 126,.MOBILE HOME PARK, 1211 FARROLL AVE., (GRANDMOTHERS' CLUB, INC.) Director Gallop advised that the - current Use Permit will lapse March 30,. 1971, and that a letter has been received from Mrs. Tucker, Chairman of the project, dated March 5, 1971, asking for an extension. He further advised the - .letter indicated they have had problems in securing a competent contractor to do - the job and also difficulty in securing financing. However, the financing; is in the process of being approved and they have secured a contractor and, in-discussing the matter with Mrs.'.Tucker, she in- dicated that they hope this project will be.under way in'30 days, butwould: like to have a six month's extension. Director Gallop pointed out that the State Division of Housing extended the - construction permits for six months dependent upon the action of this Commission. Director Gallop also pointed out that at the time the last extension was granted, the Grandmothers' Club had just purchased the property. Chairman Moss stated it was his feeling that the extension should not be granted unless the Commission reviews the - conditions,. and perhaps consider it as a new one, in view of the recent studies and.activities on mobilehome parks. Director Gallop read the-conditions.originally imposed on the Use Permit._ Mrs. Tucker was present and advised the Commission that the Club.had purchased the property six months ago and have been working hard on the project. She further advised that she had talked to the loan company today and they are very :interested.in making the loan, and that the plans have been drawn up and a contractor secured. After considerable discussion regarding proposed width of streets, size of lots, density, etc., on motion of Commissioner Nunes, seconded by Commissioner Bowles that the request for extension of the Use Permit be- denied for reasons that three years have passed since the - original Use Permit was granted, and in view of .tije changes in requirements during this time, the development should be reviewed by the Planning Commission for additional requirements. After a brief review of the construction plans by the Commission,. Director Gallop pointed out that the Commission would have a right to ask for a clarification of the apparent drafting errors in the plans presented, and that a determination will take more time for study. Commissioner Nunes withdrew his. motion for denial of the extension. Chairman Moss stated he felt the Commission should review the plans as they do not correspond, such as one indicates a.3 ft. setback and one indicates a 5,ft. setback. Administrator Butch suggested that the staff review the plans and the - conditions of the Use Permit and report back to the Planning Commission at their next regular meeting of April 6th. Director Gallop stated that by continuing the review until April 6th, the Use Permit would.be open for amendment, and that the right to start construction would lapse on the 30th, but that the Commission could reactivate it on. the 6th of April, which would give the City an opportunity to re- view the plans and recommend amendment to the Use Permit. Director Gallop further advised he would discuss the matter with the City Attorney to determine how much stronger the Commission could.make the conditions of the Use Permit. After further discussion, on motion of Commissioner Nunes, seconded by Commissioner Schultz, and unanimously carried, that the matter be held over to the Planning Commission meeting of April 6th, for further review of the Use Permit and plans, and to secure a determination from the City Attorney as to what additional requirements can or cannot be-imposed on the We Permit. 343 344 Planning Commission, 3- 16-71 Page 2 TENTATIVE MAP - TRACT NO. 409,_ LOTS 39 AND 40 OF STEELE'S RESUBDIVISION, "NOGUERA PARK" . IADDISON WOOD Director Gallop displayed a.map of the proposed development and pointed out that the lots that face on Garden Street are not a part of the subdivision. He further ad- vised that the State Subdivision Map Act requires one set of rules for a Parcel Map as against a Subdivision, in that where a new street is being created, it has to go by the Subdivision rules. Director Gallop also pointed out that all lots indicated on the plan meet the subdivision requirements with the exception of Lots 1 and. 18, which are the two corner lots, and are proposed for 65 ft. width to retain as many trees as possible. Commissioner Strother indicated he felt it would be reasonable to require park allotment for all of the lots, and not just the ones off of Garden Street since this is all part of one project. Director Gallop advised that to do this would require an amend- ment to the Subdivision Ordinance to make this requirement on Lot Splits as well as Sub - divisions. After further discussion, on motion of Commissioner Bowles, seconded by Commissioner St. Denis, and unanimously carried, that the Tentative Subdivision Map. for Tract 409 be approved subject to the Staff Recommendations dated March 8, 1971. CONTINUATION - REZONING CASE NO. 71 -45 ADJACENT TO GREENWOOD. MANOR (CARL GREENWOOD) Director Gallop reviewed that this case was carried over from the Planning Commission meeting of February 16th, at which time the public hearing was closed. The request is to change the property presently zoned RA -B3 to R -1. He advised that this parcel of land was originally approved for subdivision under Tentative Tract Map No. 273. Commissioner Schultz advised that when the tentative tract map was brought before the Planning Commission for approval several years ago, the plan included street improve- ments and a park, and since the original proposal the property has been sold and the new owner wants to continue with the development as it was originally intended. He also stated that with regard to the street, he felt that this street or any other street would never be developed until there is a need, and added that Cherry Street has been designed to go out to Coach Road and on to Huasna Road. He stated he felt the project would be a good development when completed. Commissioner Nunes stated he thought the road_ is in poor condition and would— impose a burden on the City to upgrade the road. Commissioner Porter stated that the' situation has been created and, apparently, it was good for R -1 then and there hasn`t.. been any material change since then. Commissioner St. Denis stated it would be more desirable to see orderly development from the City out, but that is not too likely, and he feels the development would be a logical extension of the present subdivision. ATTEST: After further discussion, the following action was taken: RESOLUTION NO. 71 -194 z A RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING AN. AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 21, OF SAID CODE. On motion of Commissioner St. Denis, seconded by Commissioner Porter, and by the following roll call vote, to wit: AYES: Commissioners Bowles, Nunes, Porter, St. Denis, Schultz, Strother and Chairman Moss NOES: None ABSENT: None the foregoing Resolution was adopted this 16th day of March, 1971. City Administrator Butch advised the audience that a public hearing on this rezoning case would be held by the City Council on April 13, 1971.
