PC Minutes 1970-12-01Planning Commission Arroyo Grande, Calif. . December. .1, 1970 The Planning Commission met in regular session with Chairman Moss presiding. Present are Commissioners Bowles, Nunes, St. Denis and Strother. Commissioners McMiTlen and Porter are absent. Also in attendance are City Administrator Butch and Planning Director Gallop. ..MINUTE APPROVAL On motion of Commissioner Bowles, seconded by Commissioner .Nunes,.and unanimously carried, the minutes of the special. meetings of November 16th and.. 17th, 1970 were approved as prepared. REVIEW OF "ON.STREET PARKING" ORDINANCE Director Gallop explained that the Department. Heads reviewed the proposed ordi- nance again, with the result that one addition was recommended. in Section .1,. Para.. A,. II as follows: It shall be unlawful to park or cause to be parked within a public right - of -way in a Residential Area, in iie City of Arroyo Grande ..." It was pointed out that the Police Department would not be aware of all of the various zones and would have to rely on the character of the neighborhood. Grande. Avenue,is a Commercial District and parking would be permissible on Grand, Traffic Way and adjacent to Sambo's,.and basically the Ordinance would,apply to any area whieb is residential in character. DirectorGallop further advised that all com- plaints received have been from basically •res.ident.ial _ . .Commissioner Strother inquired about':provisions for due notice before the cars are towed away for violation. Director Gallop advised that the State Vehicle Code requires a definite procedure of notice prior to towaway. Administrator Butch advised that large trucks over 4,500 pounds or more.than 18' in length, vacation vehicles, etc. would be prohibited from parking in residential areas. in excess of 72 hours. A citation can be issued after the 72 hour .period and..if the vehicle Is not. moved. after .issuance of the. citation, the Police Department could then tow the vehicle away. After a brief discussion, on motion of Commissioner St. Denis, seconded by Commissioner Bowles, , and unanimously carried, that a recommendation be made to the City Council for the adoption of the proposed ordinance titled "Amending. the Municipal Code of the City of Arroyo Grande by Adding the following sections, Limiting Parking of All Vehicles, Trailers and Boats in the City of Arroyo Grande ". LEAGUE OF CALIFORNIA CITIES CHANNEL COUNTIES DIVISION MEETING DECEMBER 4 1. 0 Director Gallop reminded the Commission of the League Meeting to be held in Santa Barbara, Friday, December 4, 1970,. and advised that reservations should be in to City Clerk Polly Miller. LOT SPLIT COMMITTEE '• Commissioner Strother requested that he be excused from further service on the Ldt Split Committee because of his work on the Harbor Commission. On motion o Commissioner St. Denis, seconded by Commissioner Nunes, and unanimously carried, that Commissioner Strother be relieved from further serviceon''the Lot Split Committee and Commissioner Bowles be appointed to serve on thi.S in his place. III PUBLIC HEARING - REZONING CASE NO. 70 -40 - REZONE R -1 DISTRICT'TO R -G DISTRICT PRATHER) Director Gallop advised the property petitioned for rezoning -is :immediately west 'of the residences which face on North Elm Street, south of Montego, and the, property slopes from the south up to the north. The property will be bisected by the extension of Brighton as provided for in the development plan, which outlines the development of this area. , "--- _. Upon being assured by Director Gallop that the Public Hearing for Rezoning Case No. 70 -40 had been duly published. and property owners.notified,.Chairman Moss declared the hearing open. 315 In response to Mr. James Moore's request for a definition of the zoning, Director Gallop read the permissive uses and uses permitted under Use Permit Pro- cedure in an R -G District. Director Gallop added that the allowable height is th same in the R -G District as it is in the R -1 District, and the building site iv larger in the R -G District than in the R -1, with the maximum coverage of all structures being 60 %. . The remaining 40% is to be devoted to landscaping,�'t creation, etc. r -- —. 316 Planning Commission, 12 -1 -70 Page 2 Dr. Upton, 1218 Montego Street, was present and read a petition signed by 33 residents of the area protesting the proposed zone change. Mr. Baker, 221 North Elm S greet; Mr. Jim Drinkard, 298 No. Elm St.; Mrs. Lloyd Nobles, 1239 Montego St.; Mr. John Hussey, 362 No. Elm St.; Mr. Jim Love, 1238 Montego St.; Mr. Jack Files, 1226 Montego St.; Mrs. Barbara Vasquez, 387 No Elm Street, were present and objected to the proposed zone change. Mr. and Mrs. Prather were present and spoke in favor of the zone change. Mr. Prather stated they felt there is a need for rental units in the City, and the development would not interfere with any of the views because of the height limitations of the buildings and the slope of the area. With regard to the R -G Zoning, Commissioner Strother questioned as to whether the City of Arroyo Grande needs any more Garden Apartment zoning and, if so; is this the area that should be added? He pointed out that there is quite a bit of acreage already zoned for that purpose. Director Gallop pointed out on the map all•, multiple unit zoning now existing within the City, noting that a large percentage of R -2, R -G and R -3 is developed and no large single ownerships are available in exist- ing R -G Districts. No further discussion for or against the proposed zone change, Chairman Moss declared the hearing closed. After further discussion among the Commission, it was the concensus of opinion that the proposed zone change would be spot zoning; that a higher density development in this area would add to the already existing traffic problems and increase the danger to the children walking to Ocean View School because of the lack of sidewalks; and that there are sufficient areas within the City already zoned for garden apart- ments. RESOLUTION NO. 70 -181 A RESOLUTION OF THE CITY OF ARROYO GRANDE PLANNING COMMISSION RECOMMENDING DENIAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 21, OF SAID CODE. On motion of Commissioner Bowles, seconded by Commissioner St. Denis, and by the following roll call vote, to wit: AYES: Commissioners Bowles, Nunes, St. Denis, Strother and Chairman Moss NOES: None ABSENT: Commissioners McMillen and Porter the foregoing Resolution was adopted this .ist day of December, 1970. Chairman Moss informed the petitioners of their right to appeal the decision of the Planning Commission to the City Council within ten days. ZONE CHANGES IN AREAS ABUTTING THE COUNTY Commissioner Strother inquired if property owners in the County are notified of public hearings on rezoning property within the City which abuts the County. Director Gallop advised this is not presently done because of the fact we do not have the County assessor's maps and roll books available and, to do this, it would be necessary to go to the County Assessor's office to look up the ownerships. City Administrator Butch questioned whether County residents should have any say in zone changes within the City. After discussion on motion of Commissioner Strother, seconded by Commissioner Nunes, and unanimously carried, that property owners .in the County be informed of rezoning cases where the property abuts the County. MOBILE HOME PARK DEVELOPMENT After a brief discussion regarding the problems of mobile home .developments in San Luis Obispo County, on motion of Commissioner Bowles, seconded by Commissioner Nunes, and unanimously carried, that a recommendation be made to the City Council that a moratorium be declared within the City of Arroyo. Grande on mobile home park development, excluding the case now before the City Council, until the following inequities have been resolved: 1) More equitable tax rate between the traditional home owner and the mobile home owner has been established by the State, and to urge the City Council to join with other Councils in the County to get some legislation toward this end, and 2) That the City tax structure concerning sewer and water 1 ATTEST :. ec:retary. Planning Commission, 12 -1 -70 assessments be modified -to be.. more equitable between the traditional home 'owner and the - mobile home owner.., DISCUSSION RE TRAFFIC HAZARDS AT OCEAN VIEW SCHOOL After further discussion regarding the existing traffic problems and dangejs to the children walking to school in the street because of the lack of sidewalks„on motion of Commissioner Strother, seconded by Commissioner St. Denis, and unanimouay carried, that a recommendation be made to the City Council to study the problem with ,: ;: the property owners on Elm and Montego Streets and consider the possibility of es,'` tallishing a 1911 Act. It was also pointed out that the lack of sidewalks pose similar hazards in other elementary school areas.: ADJOURNMENT There being no further business before the Commission, on motion of Commissioner Nunes, seconded by Commissioner'St. Denis, and unanimously carried, the meeting was adjourned at 8;45 P.M Chairman Page 3 317
