PC Minutes 1970-05-05Planning Commission Arroyo Grande, California May 5, 1970 The Planning Commission met in regular session with Chairman Moss presiding. Present are Commissioners Combe, Kane, Porter, St. Denis and Strother. Commissioner McMillen is absent. Also in attendance are City Administrator Butch, Councilman Wood. and Planning Director Gallop. MINUTE APPROVAL On motion of Commissioner St. Denis, seconded by Commissioner Combe, and unanimously carried, the minutes of the regular meeting of April 7, 1970 were approved as prepared. LOT SPLIT CASE NO. 70 -105 - APPEAL FROM. JOHN R. AND LOUISE E. DILLAHA Director Gallop advised that Item No. 4 of the Minor Subdivision Committee Action report of February 25th, which had previously been appealed, has now been resolved, .the:. reservoir has been demolished and, therefore,Items 1 and 2 as listed on the staff report remain to be resolved. He described the property as being a non - conforming fourplex on So. Alpine, the last property on the improved street. The petitioners have requested a lot split and, the Lot Split. Committee have approved the lot split with a number of conditions placed on it. The following conditions have been appealed by the petitioners: 1. Curb, gutter and sidewalk required on Alpine frontage of Parcels 1 and 2. The petitioners do not object to the curb and gutter, but do object to the sidewalk requirement at this time, and indicate they would enter into a covenant to place the sidewalk upon demand of the City or the creation of an improvement district. being assured by Director Gallop that the Public Hearing for Use Permit Case No. 70-159, Arroyo Grande Congress of Jehovah's Witnesses, 250 Spruce Street, had been duly posted, published and property owners notified, Chairman Moss declared the hearing open. Mr. Sakle, Presiding Minister, was present and stated they want to beautify the church on the outside, using rock work and shrubbery, and expand the facilities to accommodate the increasing members in the congregation. No further discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. After discussion, the following action was taken; 283 2. Improvement of the drive area from the street to the off- street parking area. The fourplex has an existing concrete parking area, however, the approach from the street to the concrete slab is not improved but does have base, and the Committee has recommended that this drive be leveled and improved to be weather proof and dust free. He advised that there is probably sufficient base existing on this drive, and that a little blade work and a couple of inches of base coat and seal is all that would be needed to meet this requirement. With regard to the sidewalk requirement, Commissioner Strother voiced objection td;` the wording that the petitioners would enter into a covenant to place the sidewalk "upon demand of the City ", or the creation of an improvement district, stating he objected to the possibility that the City could demand this to be done at anytime, and he felt this should be worded to require that the sidewalks be installed when 51% of the block is in. Director Gallop advised the covenant could be worded this way. On motion of Commissioner Porter, seconded by Commissioner Strother, and unanimously carried, that the Commission support the Subdivision Committee action, rewording the side- walk requirement as suggested by Commissioner Strother. Mrs. Barbara Simpson, Agent for the petitioners, requested that the City repair and oil the street after the curb, gutter and driveway approach have been installed. Directdr Gallop advised that the street would be improved at that time. PUBLIC HEARING - USE PERMIT CASE NO. 70 -159, A.G. CONGRESS OF JEHOVAH'S WITNESSES, 250 SPRUCE STREET - ADDITION AND REMODELING OF PUBLIC MEETING HALL Director Gallop explained that this church existed prior to annexation to the City and, therefore, it is a non - conforming use. By approving the Use Permit, the Commission in effect approves a non - conforming use as conforming, and also approves the addition. 284, Planning Commission, 5 - 5 - Page 2 RESOLUTION NO. 70 -165 U A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 70 -159. On motion of Commissioner Combe, seconded by Commissioner Strother, and by the following roll call vote, to wit: AYES: Commissioners Combe, Kane, Porter, St. Denis, Strother and Moss NOES: None ABSENT: Commissioner McMillen the foregoing Resolution was adopted this 5th day of May, 1970. After further discussion, on motion of Commissioner Porter, seconded by Commission St. Denis, and unanimously carried, that Architectural Approval be granted according to t plans on file, and required by the previously granted Use Permit. ,_c _. TENTATIVE MAP FOR TRACT NO. 398 Director Gallop advised that the property being discussed is located adjacent to the City Limits on the west end of Farroll Avenue, involving five acres, or 19 lots, and the zoning is R -3. The developer proposes developing the subdivision with duplex apartments. The Subdivision Review Committee met on the matter and the Committee report was given to the Commission members with the various public utility and department re- commendations. All of the lots are oversize because they are being designed for duplexes and no variances are required. Lot 19 is to be held for drainage purposes and no con- struction will be permitted until such time that the area wide drainage problem is re- solved. He advised that the conditions set out by the Review Board are consistent with all requirements made in the past. After discussion, the following action was taken: RESOLUTION NO. 70 -166 S A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE MAP OF TRACT NO. 398, GOLDEN WEST HOMES UNIT NO. 2. On motion of Commissioner Combe, seconded by Commissioner Strother, and by the following roll call vote, to wit: AYES: Commissioners Combe, Kane, Porter, St. Denis, Strother and Moss NOES: None ABSENT: Commissioner McMillen the foregoing Resolution was adopted this 5th day of May, 1970. DETERMINATION OF PLANNING COMMISSION MEETING OF JUNE 2ND, 1970 Director Gallop advised the regularly scheduled Planning Commission meeting of June 2nd is the Primary Election date and is a legal holiday for the City. He further advised that two Zone Change petitions have been filed and recommended that the meeting be rescheduled for Wednesday, June 3rd. On motion of Commissioner Strother, seconded by Commissioner St. Denis, and , unanimously carried, that the regular Planning Commission meeting of June 2, 1970 be cancelled and reset for Wednesday, June 3, 1970. TEXACO STATION ON TRAFFIC WAY(CATTOIR) Chairman Moss requested the Secretary write a letter to the City Council re- questing clarification as to the "indeterminate date" for the installation of curb and gutter at the Texaco Station on Traffic Way. He stated when the Use Permit was granted for a free standing sign, one of the conditions was to install curb and gutter.
