PC Minutes 1969-10-07Planning Commission Arroyo Grande, .California October 7, 1969 The Planning Commission met in regular session with Chairman Moss presiding. Present are Commissioners Bowles, McMillen, St. Denis and Strother. Commissioners Porter and Sawyer are absent. Also in attendance are Councilman Levine and Planning Director Gallop. MINUTE APPROVAL On motion of Commissioner Strother, seconded by. Commissioner Bowles, and unanimously carried, the minutes of the regular meeting of September 16, 1969 were approved as prepared. COMMISSIONER PORTER ENTERED THE MEETING II LETTER OF AGREEMENT FROM MRS. LILLIAN QUARESMA Director Gallop advised the matter involved a request to build a new single family dwelling in an R -1 District which was formerly subdivided, and that curb, gutter and sidewalk are normally required, however, this property creates problems as far as access on Halcyon Road is concerned because of sight distance. In order to permit Mrs. Quaresma to build this home, she and her heirs have entered into an agreement, filed with the City, that when the lots are re- subdivided for the purpose of developing building sites, they will be served by an extension of Magnolia Drive and without access directly to Halcyon Road. He advised this was a matter of information to the Commission. AMERICAN INSTITUTE OF PLANNERS CONFERENCE Director Gallop advised the Conference would be held on Friday and Saturday in .mid November, but no dates have been set as yet. Money has been budgeted for one or two Commission members to attend, and any member wishing to attend was asked to advise Mr. Gallop, and he would advise them as soon as the dates have been set. COMMISSIONER SAWYER ENTERED THE MEETING COASTAL VALLEY PLANNING COUNCIL Commissioner Bowles advised the Coastal Valley Planning Council had met last night and were advised the Board of Supervisors had authorized the Chairman and the Clerk to sign the amended Joint Powers Agreement. Director Gallop advised that two paragraphs of the Joint Powers Agreement had been amended; one was the paragraph involving membership, and the second involves the County's contribution. He stated a letter had been received from the County promising staff assistance and secretarial services in lieu of cash funds. On motion of Commissioner McMillen, seconded by Commissioner St. Denis, and unanimously carried, :that a recommendation be made to the City Council to approve and .authorize :signing of the Joint Powers Agreement. MOBILE HOME AND TRAVEL TRAILER PARKS - NEW LEGISLATION Director Gallop advised that on Thursday, October 9th, starting at 10:00 a.m. in the Arroyo Grande Council Chambers, the City would be hosting a meeting by the Department of Housing and Community Development on new legislation concerning mobile home and travel trailer parks. It is anticipated that 12 to 15 representatives from the different areas will be present, and Commission members were invited to attend. ARCHITECTURAL APPROVAL - WILLIAMS BROS. SHOPPING CENTER Commissioner Porter advised the Architectural Committee had granted approval for two small buildings on property originally designed for one large structure, and inquired if this would be in conformance with the original approved plans, or if the Commission would consider this as a deviation of the original approved plan. Director Gallop advised that when Williams Brothers secured a Use Permit to develop the present shopping area, the area which is unpaved southwest of Kinney's Shoes was proposed to be one large structure. Now they have received architectural approval for two small structures, leaving a considerable area yet to be developed. Commissioner Porter advised the developer has indicated they also have plans for a third building in between the two proposed buildings. He also pointed out that the present buildings in the shopping center are of the same roof design, but that the two proposed buildings are completely different, by necessity, because of the type of business. On motion of Commissioner McMillen, seconded by Commissioner Strother, and unanimously carried, that the original plans for the Williams Bros. Shopping Center be reviewed by the Commission to determine suitability of the proposed structures. 245 24 Planning Commission, 10 -7 -69 Page 2 PUBLIC HEARING - USE PERMIT CASE NO. 69 -147 - POSTER PANEL STRUCTURE, GRAND AVE., WEST OF JUNIPER ST, (RYAN OUTDOOR ADV., INC.) Director Gallop advised that a map had been prepared by staff showing the location of the proposed signs. This particular site is in the area of the strawberry fields, west of Bonanza Realty office. The property is about the same grade as the street. He advised that in the applications, none of the five applications indicates whether the panels are single or double faced and, if so, if both sides are to be lighted. The bottom of this panel will be 15° from grade, and 12' high, with an overall height of approximately 27, feet. The application indicates the panel would be exterior lighted, non - flashing, and non - rotating. Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 69 -147, Poster Panel Structure, Grand Ave., West of Juniper St., had been duly published, posted and property owners notified, Chairman Moss declared the hearing open. William Black, 1300 Brighton St., Arroyo Grande, was present and stated, in his opinion, advertising of this nature only detracts from the beauty of the City and he would object to the sign. Mrs Virginia Strother, 270 Larchmont, Arroyo Grande, was present and stated she is a member of the City Beautification Committee, and is very muct interested in making the City as attractive as possible, and that large billboards such as these are not suitable for the center of the town. Mrs. John Raeberg, of Hillcrest Drive, was present and advised she was opposed to the sign. Mrs. Ellen Johnson, 163 So. Elm, was present and advised she was opposed to the sign. She also asked if the City did not have an Ordinance against billboards within the City limits of Arroyo Grande. Chairman Moss advised that the signs they are requesting are per- mitted in the P -M Planned Industrial zone, subject to Use Permit procedure. Jim Odum, a representative of the Ryan Outdoor Advertising Co. was present and stated he resides in Salinas, California, and that his area of responsibility covers the 4 counties from. Monterey to Santa Barbara. He advised that his company has agreed to remove the structures on Traffic Way and Branch Street, and that the matter of these signs has -already been before this Commission and the City Council, and there was a question as to policy and to interpretation of the existing Sign Ordinance. At that time, it was the opinion of the City Council that outdoor advertising structures vo uld be allowed in Industrial zoned areas only, which, in the industry, is a restriction beyond normal. We are normally, in the 22 counties in which we operate, allowed to function as a media. in heavy commercial and industrial zones as a matter of right without applying for a Use Permit. Mr. Odum stated his company would be able to comply with the suggested require- ments of the staff that the electrical wiring would be placed underground, and that the landscaping requirements would also be complied with. He also stated, with re- gard to how long the structure would be in place, that agreements with the property owners may be terminated with a 30 day notice . should the property be developed in such a way that they would be in the way of said development. He stated the construction plans submitted have been certified by an engineer which establishes the maximum codes on a structure of this nature, and that all signs would be double faced so that the back side of the structure would not be visable. As there was no further discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. Commissioner McMillen asked. Mr. Odum if they applied for the sign prior to getting approval from the property owner. Mr. Odum advised they have agreements with the property owners, and that it is necessary to indicate the owner's approval on the application. On motion of Commissioner McMillen, seconded by Commissioner Strother, and unanimously carried, action on Use Permit Case No. 69 -147 is tabled until completion of Public Hearings on all five applications for poster panels. PUBLIC HEARING - USE PERMIT CASE NO.. 69 -148 POSTER PANEL STRUCTURE 958 GRAND AVE. (RYAN OUTDOOR ADV„ INC.) Director Gallop advised the request is roughly 200° west of Halcyon Road and would be located between the Motorcycle Shop and the Auto Shop, on the west side of the entrance to the property, which would be 17° west of the Motorcycle Shop. This sign would be 24° from grade, which is also street grade to the bottom of the panel, with an overall height of 36 °. The panel would be above the existing...structures in this area. Planning Commission, 10 -7 -69 Page 3 Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 69 -148, Poster Panel Structure at 958 Grand..Avenue had been duly published, .posted and property owners notified, Chairman Moss declared the hearing open. Mrs. Ellen Johnson, 163 So, Elm Street; Mr. Leroy Berry, 1355 Grand Ave.; Mr. William Black, 1300 Brighton; Mr. Walt Filer, 1015 Grand Avenue; Mrs. Virginia Strother, 270 Larchmont Drive; and Mrs. John Raeberg, Hillcrest Drive, were present and stated they were opposed to this Use Permit being granted. Mr. Jim Odum, stated with regard to this application, his company would comply with the requirement of undergrounding utilities as recommended by the staff, and that they would also be able to landscape the area. He also pointed out that the proper term for these structures is "Standardized Poster Panels", and that billboards may appear anywhere_. In answer to Director Gallop's question regarding periodic changes to the panels, Mr. Odum advised they are changed monthly, and copy is submitted by agencies and local businesses. No further discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. On motion of Commissioner McMillen, seconded by Commissioner Bowles, and unanimously carried, action on Use Permit Case No. 69 -148 was tabled until completion of Public Hearings on all five applications for poster panels. PUBLIC HEARING - USE PERMIT CASE NO. 69 -149 - POSTER PANEL STRUCTURE HALCYON ROAD:. NORTH OF GRAND AVENUE (RYAN OUTDOOR ADV., INC.) Director Gallop advised.the request is for a poster panel on the west side of Halcyon, north of Grand Avenue, and would be adjacent to.the small garage behind Steffan's Carpet City. On this particular panel request, the bottom of the panel would be 12° from grade, and 24'.overal1 height, double faced, exterior lighting, non - flashing and non- rotating. Upon being assured by. Director Gallop that the Public Hearing for, Use. Permit Case No.. 69 -149, Poster Panel Structure on Halcyon Road north of Grand. Avenue had been duly published, posted and property owners, notified, Chairman Moss declared the hear- ing open. E1len.iJohnson, 163 So. Elm Street, stated she is opposed to this sign. Mrs. John Raeberg, Hillcrest Drive, inquired as to what advantage these signs would be to the City. Mr. Odum advised the structures are assessed close to $6,000. to $8,000., dependent upon the size, and the company also pays for a City business license. Mr. William Black, 1300 Brighton Ave., stated he was opposed to this sign from a traffic standpoint.in that it might detract from the safety at the intersection of Grand and Halcyon. Col. Ben Jacobs, 1136 Grand Avenue, stated, in his opinion, the dollars are important, and it is also important to have a nice looking area. He suggested. that a.time.limit be put on the signs; that there may not be any harm.at the present time, but big signs can get awfully cumbersome. Mrs. Virginia Strother, 270 Larchmont, stated she was opposed to this sign also; that it is difficult enough to makethe: area attractive and, in her opinion, the businessmen have concluded that a beautiful. area is important to business. She stated-Grand Avenue, in particular,, is difficult to beautify because it is so spread out, and. she:.believed.these.structures would make the area more. unattractive. Mr. Walt Filer, 1015'Grand Avenue, stated he is opposed to this type of sign because he feels this is not the proper place for them. No further discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. On motion of Commissioner McMillen, seconded by Commissioner Strother, and unanimously carried, that action on Use Permit Case No. 69 -149 be tabled until completion of Public Hearings on all five applications for poster panels, PUBLIC HEARING - USE PERMIT CASE NO. 69 -150, POSTER PANEL STRUCTURE, 112 BRISCO ROAD, (RYAN OUTDOOR ADV., INC.) Director Gallop advised the panel would be 15' from grade, or an overall height of 27 °, with exterior illumination, non - flashing, non - rotating. 247. 248 Planning Commission, 10 -7 -69 Page 4 Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 69 - 150, Poster Panel Structure at 112 Brisco Road had been duly published, posted and property owners notified, Chairman Moss declared the hearing open. Director Gallop advised the sign would be between the Arc Shop and the Print Shop on Brisco Road, and would be visable from Grand Avenue. Mrs. Ellen Johnson, 163 So. On motion of Commissioner McMillen, seconded by Commissioner Strother, and unanimously carried, that action on Use Permit Case No. 69 -150 be tabled until completion of Public Hearings on all five applications for poster panels. PUBLIC HEARING - USE PERMIT CASE NO. 69 -151, POSTER PANEL STRUCTURE, 1303 GRAND AVE., (RYAN OUTDOOR ADV., INC. Director Gallop advised the proposed panel is adjacent to the residence owned by Mr. Bizzini. The grade is about 3' lower than the street grade, and it is just west of Juniper Street. Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 69 -151, Poster Panel Structure, 1303 Grand Avenue, had been duly published, posted and property owners notified, Chairman Moss declared the hearing open. Mr. William Black, 1300 Brighton; Mrs. Ellen Johnson, 163 So. Elm; and Mr. Leroy Berry, 1355 Grand Avenue, stated they were opposed to this sign. No further discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. ADMINISTRATOR BUTCH ENTERED THE MEETING In answer to Commissioner Strother's question as to what plans were being made by Ryan with regard to removing the present non - conforming signs as required by the City Council in their meeting of August 26, 1969, Mr. Odum advised his company has notified the City Administrator that they are complying with that request and they hope to do tot before the end of the month. Commissioner Strother moved that this Use Permit be denied from the standpoint of aesthetics. The :.motion lost for lack of a second and the matter was tabled. PUBLIC HEARING - USE PERMIT CASE NO. 69 -152 - EXPANSION OF MOBILE HOME PARK, 535 TRAFFIC WAY (SCHMITT) Director Gallop advised the request is to expand an existing mobile home perk on South Traffic Way. The property in question is on a bench which has been developed to the south of the property and faces on to the South Traffic Way Extension. The plans presented are within the density requirement standards of the City. Mr. Schmitt 240 25;0 Planning Commission, 10 -7 -69 Page 6 has already placed the curb and Otter. Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 69 -152, Expansion of Mobile Home Park at 535 Traffic Way had been duly published, posted and property owners notified, Chairman Moss declared the hearing open. No discussion for or against the proposed Use Permit, Chairman Moss declared the hearing closed. Commissioner Strother asked if any landscaping had been proposed for the home sites themselves. Director Gallop advised that because this bench is quite an ex- tensive cut slope on both sides and individual site landscaping would cause a problem in that the spaces are not large and access to the sites would be difficult because of restricted roadway. After discussion, the following action was taken: RESOLUTION NO. 69 -141 U A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 69 -152. Administrator Butch advised that, to his knowledge, no word had been received as yet from the property owner. Chairman Moss requested that Director Gallop report on this matter at the next Commission meeting. PARKING OF SEMI TRUCKS AND TRAILERS IN THE PUBLIC RIGHT OF WAY Chairman Moss inquired as to the status of the problem of parking semi trucks and trailers in public right of way. Director Gallop advised that a report would be submitted to the Commission at their next meeting.
