The Planning Commission met in Special Session with Vice Chairman Strother
presiding. Present are Commissioners Moss., St. Denis and Skelton. Absent are
Chairman McMillen, Commissioners Porter and Sawyer. Also in attendance are
Planning Director Gallop, Public Works Director Anderson, and City Engineer Garing.
MINUTE APPROVAL
On motion of Commissioner Moss, seconded by Commissioner Skelton, and
unanimously carried, the minutes of the Special Meeting of May 20, 1968 and the
Regular Meeting of May 21, 1968 were approved as prepared.
COMMISSIONER SAWYER ENTERED THE MEETING
CHERRY STREET PLAN LINE
Director of Public Works Anderson displayed an aerial photo and a plan of
the area in question and stated that the master plan calls for a collector street
which is 64' right - of - way, but due to the alignment and narrow width, they pro-
posed using a 60' right -of -way and maintain the 44' improvement, and instead of
10' sidewalk areas, leave them as 8' sidewalks. He stated the reason for the 44'
improved width is that eventually this street might require four lanes, and this
could be accomplished by cutting into 2 - 11's and 2 - 11's and stop any parking.
Director Gallop explained, for the benefit of the three new Commission
members, that the purpose of a Plan Line is to establish proposed property lines
for a street in the future, and to protect the area within these property lines
from any new construction. A plan Line establishes a new set back line where a
street is to be widened and protects the future right -of -way of that street. He
further stated this Commission must consider Plan Line alternatives and after a
decision is made, the City Engineer and Public Works Director is requested to
draw up a final plan, a Public Hearing must be held, and the plan is then for-
warded to the City Council with recommendations for approval.
After discussion, on motion of Commissioner Moss, seconded by Commissioner
Skelton, and unanimously carried, that the staff draw up a precise Plan Line ex-
tending to the easterly end of Cherry where it turns south and becomes Branch Mill
Road, and referred back to this Commission for further study.
FAIR OAKS TO VALLEY ROAD PLAN LINE
Public Works Director Anderson explained that the Plan Line now is to
bring an 80' road from Halcyon Road to Valley Road, stating this would be an 80'
Major 4 lane road with two parking lanes. He stated that at the present there
is an existing plan line for an 80' road which is an easterly extension of Fair
Oaks straight through to Valley Road, but it does not eliminate two very bad
turns. He stated the proposed realignment would tie into the high school
corner and continue down to Traffic Way. He stated that at the present time
they have some property on the westerly side of the creek and curb and gutter
is in in some areas.
Director Gallop stated, in his opinion, this alignment of the Fair Oaks
extension would serve the people's need far better than a "T" intersection on
Valley Road which creates traffic flow problems and that the main advantage of
this plan was the smooth flow of traffic from Halcyon to Traffic Way. Director
Anderson stated that the majority of the property required for this plan would
be from Mr. Fred Grieb.
On motion of Commissioner Sawyer, seconded by Commissioner Moss, and
unanimously carried, that this matter be given further study and deferred
until the July 2nd meeting of the Commission.
MARTIN POLIN'S REQUEST TO THE UNION STATION ON THE CORNER OF HALCYON AND
GRAND
Director Gallop advised the Commission he had talked to Mr. Polin about
this matter and conveyed to him the staff's recommendation that a plan of this
property be submitted. Mr. Polin advised the recommendation was acceptable to
him and he would wait until he was informed of this Commission's request for a
development plan of what he is proposing to do. Mr. Polin stated he would pre-
pare a plan and would accept a ruling from this Commission. Director Gallop
stated that sometime ago there were problems on the east of the tire shop, and

that a plan would include the new Union Station, the muffler shop, the tire shop
and the building behind it. He stated there were parking problems, drainage
problems and several other problems involved.
After discussion, on motion of Commissioner Skelton, seconded by Commissioner
Moss, and unanimously carried, that a plan of development of this area be submitted
including the Tire Shop and Raceway Buildings, and property to the west for further
consideration.
PROPOSED ZONING ORDINANCE AND MAP
The Commission took under consideration the various letters and requests
which resulted from the Public Hearing held on May 20th and 21st, requesting the
Planning Director to discuss these requests item by item.
Director Gallop stated, in his opinion, that the Commission should consider
first any changes in the text prior to consideration of map changes, and suggested
that the first item should be the new combining P -M District with the proposed
General Services District as prepared and presented in written form.
Vice Chairman Strother suggested on Page 69, item 11, changing the word
"a ccessories" to "accessory ".
The fence requirements in the P -M District within the front yard setback
was discussed and as a result of the discussion, the following change in wording
was recommended. "Such fences and walls shall not exceed eight (8) feet in
height except where the same are located in the required front yard setback, then
the fence shall not exceed three (3) feet in height ".
After discussion, on motion of Commissioner Moss, seconded by Commissioner
Sawyer, and unanimously carried, that the new Article 16 be adopted combining the
General Services and P -M Districts into a single district with the two above
noted changes.
Director Gallop stated another change in the text is the view control on
hillsides, on Page 33, Section 1005, stating at the present time it is included
in the P -D District only and, in his opinion, it would be desirable to include
in the General Provision where hillsides are involved. 'He stated the P'-D does
provide protection, and in order to make this control work, it should be tied to
the 7% grade differential in the Subdivision. Ordinance. He advised if this were
tied directly to 7% or more grade differential and were included in the General
Provisions, it would affect any hill area in any district which exceeds 7% cross
slope.
After discussion, on motion of Commissioner Skelton, seconded by
Commissioner Moss, and unanimously carried that the view control established by
Subdivision Ordinance be included in the General Provisions based on 7% grade
differential.
Director Gallop advised the Commission there were five basic requests for
consideration for changes of the proposed map.
There are a number of requests to change from a B -1 to a B -3 District in
the Tally Ho Road area. Mr. Gallop stated, in his opinion, B -1 should be a
zoning which is attached to a subdivision rather than agricultural holding zone
use. He stated that B -3 does permit two head of livestock and the larger the
parcel, the more animals allowed. Use Permit provides for over two animals for
private use, requiring 20,000 square feet for each additional animal.
After Commission discussion, on motion of Commissioner Skelton, seconded
by Commissioner Sawyer, and unanimously carried, that Tally Ho Road westerly of
San Luis Road, presently zoned B -1 be changed to RA -B3.
Director Gallop advised that Mrs. Garey has requested consideration for
other than the proposed FS District for the front 300 feet of property between
the Catholic Church property and the Arden Farm Garage, and she has requested
this be considered for Highway Service District as outlined in a written pro-
posal to the Commission. At the first hearing she requested this property be
included in the CBD and then reconsidered and requested it be in H-S. This
would require changing the property immediately east of the Garey property.

Commissioner Moss stated this property was no closer to the freeway than it is
to the Highway. Mrs. Garey was present and gave her reasons for the request.
Director Gallop stated Mrs. Garey was in his office this afternoon and he ad-
vised her that the discussion would not be entered in the minutes because the
hearing is closed.
Director Gallop read the uses permitted under the present C -2 zoning as
compared to the proposed zoning F -S. He stated the present building, as long
as it is used for a church or similar use, under the present Ordinance is a non-
conforming use. In the new ordinance this non - conforming use is permitted to
continue after six months lapse, and actually to use it as a church, it would
be subject to a Use Permit because of the non - conforming status.
Director Gallop explained the proposed parking program being considered
by the Downtown Merchants to the rear of the Bank of America and Johnson property,
and stated it was his recommendation to take a look at the picture at that time,
if the parking plan materializes, and if Mrs. Lawrence wants to participate, then
the Garey property would abut the CBD.
Director Gallop explained that Freeway Services is oriented to the needs
of highway travel and Highway Service is oriented to the local people who shop
by automobile.
After discussion, on motion of Commissioner Sawyer, seconded by Commis-
sioner Moss, and unanimously carried, it was recommended that the property re-
main as F -S because a change would be spot zoning, because it is a projection
of existing zoning, and a change to HAS would be preferential consideration, and
any self created hardship is not a legal consideration of this Commission.
Director Gallop stated Mr. Lovett's request that the property south of
Brighton and east of 20th Street, which is presently zoned R -3, remain R -3 in-
stead of the proposed change to R -2. After a brief discussion, on motion by
Commissioner Sawyer, seconded by Commissioner Moss, and unanimously carried,
that the property south of Brighton and east of 20th Street remain R -3 because
of the adoption of the view control in the General Provisions.
-Mr..- Gallop :_indicated Mr. Lovett had also requested that the property,
approximately a 5 acre parcel, between Youngs Food Market and the Used Furniture
Store, be zoned H -S instead of the proposed C -N. Director Gallop read the major
differences between the C -N and H -S Districts. After discussion, on motion of
Commissioner Moss, seconded by Commissioner Sawyer, and unanimously carried,
that this remain C -N to avoid spot zoning as this does not abut an H -S District
and the property is too deep in relationship to its width for H -S use, as
related to the H -S zoning east on Grand Ave.
The third request from Mr. Lovett was in regard to the property on
Halcyon Road which is presently zoned R -3 and the map indicated a change to
R -1. Mr. Lovett is requesting it remain R -3. Director Gallop stated the
property is narrow and deep, approximately 70' wide. Director Gallop stated
that the abutting property to the south, which is in the County, is a mobile
home park, but that it also abuts some nice homes within the City on the north
of the subject property. The property has a 70' frontage on Halcyon and is
210 feet deep. On motion of Commissioner Sawyer that the property be changed
back to R -3, motion died for lack of a second. Commissioner Skelton moved
that the property be considered as an R -G District, motion died for lack of
a second. After further discussion, on motion of Commissioner Sawyer,
seconded by Commissioner Moss, that the property be zoned R -3, motion lost
with three "no" votes. On motion of Commissioner Skelton, seconded by
Commissioner St. Denis, that the property be zoned R -G, motion carried with
three "yes" votes and two "no" votes.
Director Gallop advised the next item was a request from Mr. Hook to
extend the R -3 zone south of Allen Street easterly from the H -S to approxi-
mately the extension of Mason Street, one lot deep. Mr. Hook stated that he
does not own property there but is considering purchasing property so he can
build multiple units. Director Gallop stated there were 8 parcels of property
involved, 7 developed as R -1., and there are a number of lots within the R -3
District, across the street which could be rebuilt as R -3 the same as the lots
in question, and that the original, R -3 was rezoned by petition of the owners.
After discussion, on motion of Commissioner St. Denis, seconded by Commissioner
Sawyer, and unanimously carried, that the present R -41 zoning be retained.

Director Gallop advised that Mr. Gaynos had requested a change of a narrow
strip of property facing Brisco Road adjacent to Linda Drive, presently zoned and
proposed as R -1, be changed to the P -M District which abuts the property to the
south, Mr. Gaynos stated that he felt this property, because it was marginal,
could be better utilized as a part of the P -M District. After considerable
Commission discussion, on motion of Commissioner Sawyer, seconded by Commissioner
Skelton, the motion was passed with one "no" vote, that the property be zoned P -M.
Director Gallop advised that the property within a triangle shaped block
between Branch Street and Crown Hill. Street to the High School had been requested
to be changed from R -1 to R -G, and the request is based on the difference of
topography and the fact that four lots are double fronted. After Commission
discussion, on motion of Commissioner Moss., seconded by Commissioner Sawyer, and
unanimously carried, that the staff was requested to contact the property owners
and get their opinion of the change and the matter would be discussed at the next
meeting.
Director Gallop stated he had received a letter, dated the 26th of' May, .•
from Florian Marsalek objecting to the P -C District of his property adjacent to
the freeway north of Valley Road, and requested that Highway Service . be considered.
The letter is dated after the hearing was closed. Mr. Gallop stated, in his
opinion, if any change were to be considered, it probably should be changed back
to the present zoning which is RA -B3.
On motion of Commissioner Sawyer, seconded by Commissioner Moss, and
unanimously carried, that the property between Traffic Way and the Freeway
revert back to RA -B3, with the exception of the residential lots on Valley Road
to be left in H -S
