The - Planning Commission -met in regular Chairman M;cM.illen presiding.
Present are - Commissioners Moss, Porter and Sawyer. Commissioner Strother • is
absent. Two vacancies exist on the Commission. Also in attendance are Administrator
Butch and Planning Director Gallop,
MINUTE APPROVAL
On motion of Commissioner Moss., seconded by Commissioner Porter, and unanimously
carried, the minutes-of the regular meeting of May 7, 1968 were approved. as prepared.
COMMISSIONER STROTHER'ENTERED THE MEETING
REPORT ON USE PERMIT NO. 67 -104 - RECAP.SHOP, 111 ALDER (WHEAT)
Director Gallop reported that Building Inspector Nicklas had inspected the
subject property the day after the last Planning Commission meeting, and again on
the 20th of May,. and the premises are in the same condition now as at that time
-and, apparently, operating within the boundaries of the Use Permit, and no complaints
have been received by the Police Department to his knowledge.. He also stated the
- inspections will be continued.
USE PERMIT CASE NO,, 67 -107, FIRST METHODIST CHURCH- REQUEST FOR EXTENSION
Director Gallop read a letter from Rev. M. Kenneth Criswell of the First Methodist
Church, requesting an eighteen month time extension of .certain conditions required
by the Commission under Use Permit Case No, 67 -107. After discuss:ion,,the follow=
•ing action was taken:
1. On motion of Commissioner Moss., seconded by Commissioner Sawyer, .motion
carried with one abstaining vote, that an' l8 .month extension be granted
on the installation of curb and gutter along the entire property on
Bennett Ave.., and the four (4) foot sidewalk one foot from property
line..
2. On motion of Commissioner Porter, seconded by Commissioner Moss,
motion carried with one abstaining vote, that the requirement for
Ten (10) foot sidewalk on lialcyon Road be extended to November 1
1968.
3.. On•mot.ion•of Commissioner Sawyer, seconded by Commissioner Porter,
.motion carried with one abstaining Note, .that an 18 month extension
be granted -.on the requirement that the area between sidewalk and
bui l.ding be .landscaped,

CONTINUATION OF:PUBLIC HEARING - PROPOSED ZONING :ORDINANCE AND MAP
Chairman McMillen re- opened the: Public Hearing on the Proposed Zoning
Ordinance and 'Map,

Mrs. Elaine Garey was present and stated they had given the proposal considerable
study and find that they are too far from the freeway to be in the F -S District, and
that they are on a street perpendicular to the freeway which should not be in the
F -S; she stated F -S should be parallel to the freeway. She stated they would accept
H -S zoning, but they felt F -S zoning was much too restrictive for them. She also
requested a delay on deciding on their request until she could get in touch with
her neighbors to see if they wanted CBD or HIS zoning. She advised that unless the
Commission was prepared to decide that they be put in H -S, she would like to have
an extension until the next time they meet. Chairman McMillen advised that, un-
doubtedly, the hearing would be closed tonight, and that the next time the
Commission meets would probably be in a study session. He also advised her that
study sessions are open to the public. Mrs. Garey stated she would write a letter
to the Planning Commission amending the letter from Mr. Art Garey dated May 20, 1968.
Mr. Lee Lovett was present and stated that he has had a little more time to study
the ordinances and would like to say something more in relation to the property
that is C -1 and proposed C -N on Grand Avenue. In studying the Ordinance, he stated
he found that before it was zoned C -1 and now it is C -N, and that in his opinion
the H -S would be closer to what it was before than the zoning they have now. He
stated the H -S zoning abuts their property and was wondering if there was any
particular reason why the H -S was brought to their property and not extended any
further, and if it would be any real problem to extend this H -S zoning. He stated,
in his opinion, with the proposed zoning this property, along with the other two
he mentioned last night, they would be losing value in their property; that it
would hurt them value -wise; it would also hurt them to try to keep it in this
market as it is today. He stated they had worked very closely with the Planning
Commission and obtained these zonings through their cooperation and their O.K..,
and that he didn't mean.,to say anything against the present because he
thought the plan was very good and it shows a lot of planning and a lot of work,
but he .did think it would create a terrific hardship on them if it were carried on
as proposed. He asked the Commission to leave the zoning as near to what it was
before as is possible.
Chairman McMillen clarified that the R -3 zone Mr. Lovett was talking about is
just off of Grand Avenue in Ledo Heights. Mr. Lovett stated the property below
which faces on Grand Avenue is the other one, and that the R -3 property is down
on Halcyon Road, the south extremity of Willow Park Subdivision where the end
abuts an R -1 Zone on one side and a trailer park on the other side.
Mr. Tany__Abrate - of 168 Tally Ho Road was present and stated It seems that
everyone has the same feeling about the Tal ly`'Ho Road'aiea b "eing'ah ideal place
to keep animals because the property is so deep and runs into the creek, and in-
quired about getting a petition restricting livestock commercially.
Mr. Sam Facchetti of 248 Tally Ho Road was present and stated he bought the
property three years ago for the purpose of keeping animals, and that the animals
keep the grass down and there is less danger of fire.
Mrs. Dorie Bentley of 391 Tally Ho Road stated she supported her neighbors
request in asking for a change to RA -B3. She also requested that consideration
be given to adequate drainage and sewers in this area before any rezoning is
considered to make it a high denity area.
Chairman McMillen stated that the Commission would study this requested change
and would ask Mr. Gallop and his staff to answer, by letter, and inform the
people of the Commission's decisions, and that if they did not like this decisions
they could appeal to the City Council.
Mrs. Elaine Garey advised the Commission that she was impressed with the work
and with all of the new ideas, and that Mr. Gallop had given her the finest and
most courteous service.
No further discussion for or against the proposed Zoning Ordinance and Map,
Chairman McMillen declared the hearing closed.
On motion of Commissioner Moss, seconded by Commissioner Sawyer, and unanimously
carried, that a study session be set for Wednesday, May 29th at 7 :30 p.m. to
consider the requests and protests received on the Proposed Zoning Ordinance and
Map.

WELCOME TO NEW PLANNING COMMISSION MEMBERS
Chairman McMillen introduced Roger St. Denis and Charles Skelton to the
Commission members and requested they take their seats with the Commission.
CHERRY STREET PLAN LINE
Director Gallop advised the Commission that one of the items on the Agenda
for the next meeting of June 5th is the Cherry Street Plan Line.
ANNUAL CITY PCCNIC
Director Gallop reminded the Commission of the Annual City Picnic being held
May 25, 1968.
USE PERMITS
Commissioner Moss asked if any action had been taken on the suggestion made
at the last regular meeting in regards to enforcing Use Permits. City Administrator
Butch advised this matter had not been referred to the Council, but that it is
included in the new proposed Zoning Ordinance.

Chairman McMillen adjourned the meeting at 8:12 p.m.
