PC Minutes 1968-05-20Planning Commission Arroyo Grande., California May 20, 1968 The Planning Commission met in special session with Chairman McMillen presid- ing. Present are Commissioners Moss, Porter, Sawyer and Strother. Two vacancies exist on the Commission. Also in attendance are Administrator Butch and Planning Director Gallop Chairman McMillen welcomed the audience and thanked them for their interest in the new proposed zoning map, stating the Commission had been working on a new zoning map for quite some time which, they believed, would be better for the City, better for the orderly growth of the City, and better for the taxpayer. Chairman McMillen advised that anyone wanting to speak would have a time limit of three minutes, and requested that all questions be addressed to the chair. Chairman McMillen asked Director Gallop to explain the new legend, districts and zones as compared to the old zones. In answer to Mrs. Elaine Garey's question as to whether the Commission intends to accept the zoning map tonight, Director Gallop advised that under the State Law and under the City Ordinances., when the present ordinance is amended or changed, the Planning Commission must hold one hearing. This hearing may be continued from time to time as long as the Commission feels is necessary. After the hearings are held and everyone has had an opportunity to be heard, the Planning Commission will take into consideration all requests and recommendations and in each case make .a decision whether to accept or deny such requests, after any changes or amendments are adopted, a Resolution accepting the proposed Ordinance and a recommendation is made to the City Council. Then the Council must hold a Public Hearing, after, which the Ordinance and map may be adopted, and 30 days after the second reading would be the effective date of that Ordinance. ;JPUBLIC HEARING - PROPOSED ZONING ORDINANCE AND MAP Upon being assured by Director Gallop that the Public Hearing for the Pro - ;posed Zoning Ordinance and Map had been duly posted and published, Chairman .McMillen declared the hearing open. Mr. Tony Abrate stated he lived at 168 Tally Ho Road and owned almost a full acre. He stated the property was approximately 36,000 square feet and is deep, and about the only thing it is really good for is keeping livestock, and asked the Commission to make this an RA -B3 District rather than RA -B1. He stated there were a lot of people here tonight that live there and that do have livestock there now. Mrs. Elaine Garey read a letter to the Planning Commission from Mr. Art Garey, dated May 20, 1968, requesting that his property at 124 West Branch. Street be included in the CBD District instead of the proposed F -S, and he also felt that Branch and Grand Avenue should be zoned for Commercial use from E. C. Loomis down to Highway 1. He also questioned the advisability of using the F -S classification on Grand Avenue from the freeway to Giant Food Store, in that it was too restrictive. Mr. Lee Lovett was present and stated he had three pieces of property he would like to talk about. He stated he would like to discuss property which is just off of Grand Avenue now an R -3 Zone, a part of Ledo Heights, and the pro- posed change to R -2. He stated, in his opinion, this would create a hardship for the owners of this property for obvious reasons, because these lots are much larger than the average R -2 lots and they are taxed accordingly. He advised the assessor appraises these lots according to his assessments, around $9,000.00, and the average R -2 lot in the City will bring about $3,500.00 and are taxed from $50.00 to $75.00, and the lots in Ledo Heights are taxed approxi- mately $175.00 per lot. This property abuts a C -1 Zone and is being changed to C -N, and he could see no reason the adjoining property could not remain C -1, and felt this would prove to be a hardship as far as zoning is concerned, and that some privilege might be taken from the C -1 Zone by the change. He stated that some uses that were allowed before might have to go to a Variance and everyone . knew it couldn't be guaranteed. He stated that if he was right, that some privileges might be taken away, he felt this might create a hardship they didn't have before. 151 152 Planning Commission - 5 -20 -68 Page 2 Another piece of property he wanted to discuss was on Halcyon Road adjoining Willow Park Tract. This is a large lot, 70' x 149' on one side and 200' deep. He stated he had enough square feet at the moment to allow 6 or 7 units in an R -3 Zone, and the Commission is proposing to rezone this to R -1. He stated that this piece of property was formerly in the County and he had a contract to have a building erected on this piece of property, but he couldn't get water to it be- cause it was outside the City, so he proceeded to have it brought into the City of Arroyo Grande, and along with this he did get a zoning of R -3.. This took six months and in the meantime, the man that was going to build had moved to Oregon so the project was never completed. However, this lies at the rear of R -1 property and it also joins in on the opposite side of a trailer park and, in his opinion, an R -1 Zoning here would create a situation that probably a home owner would re- sist in wanting to build on this particular property. It was his recommendation that the R -3 zoning not be changed and that the other property on Ledo Heights be kept as R -3. Mr. Abe Johnson was present and stated he has lived on Tally Ho Road and that he bought the property in 1942 and has been there for 26 years. He stated there hasn't been any time in that 26 years that he hasn't owned stock out there. He would like to see it zoned so it would allow them to keep stock there. He stated his property was approximately 200' by 90'. Mr. Neil Willhoit was present and stated he lives on Tally Ho Road and owned a little less than one acre, and he would like the zoning to be such that they could keep a few animals. Mr. Pete Nesbitt was present and stated he lives on Cornwall and questioned the proposed zoning of Planned Industrial District, and asked how heavy it would be in back of the cemetary. Chairman McMillen read the uses permitted. Mr. Nesbitt stated he wouldn't like to see a petroleum plant in there. Mr. Frank Sullivan was present and stated he lived on Tally Ho Road. He stated he has lived there since 1949 and has had livestock there and.would like to have something done to keep a couple of animals there. Mr. Bob Brazetti stated he lived on Tally Ho Road and that he has a few goats and some chickens, and would like to keep them there. Mrs.. Darling stated she would like to keep two horses at the end of Nevada Street, stating she has an acre and a half that she leases. Mr.Hook of 242 Garden Street stated he was new in Arroyo Grande but that he has owned property on Valley Road for some time. He stated that the south side of Allen Street from Mason to the Freeway Service area was presently R -1, and suggested it be incorporated in the R -3 District to make it more compatible as they are facing each other, and this would encourage development of the south side of Allen Street. Director Gallop stated that Mr. Nick Gaynos had filed a letter concerning a narrow 60' strip of property south of, and adjacent to Linda at Brisco Road and adja to the proposed P -M District which is presently zoned R -1, and that he is asking it be made P -M as is the abutting property. He stated the property is 60' wide but several hundred feet long. Mrs. Yeary from Shell Beach was present and stated they owned some property at 525. -E. Branch Street, between Branch and Crown Hill,across from where an R -G District is proposed, and her property is 100 x 150' and she would like to see this zoned R -G also. She stated she has talked to a few of the property owners and they all seemed to be satisfied that that is the way it is going to go. Director Gallop stated that Mrs. Yeary was in his office several days ago and got the property owners' names on Branch Street to Crown Hill, with the thought this would be better R -G than R -1. Mrs. Yeary advised she talked to Mr. Fissori, Mr. Santos and Mr. Addison Wood. Planning Commission - 5 - - Page 3 Mrs. Garey requested an explanation as to why the C -1 was being changed to H -S, stating that the CBD was closer to C-1. Chairman McMillen stated that the CBD had not been changed. Mrs. Garey asked which one was closer to the C -1 zone. Director Gallop explained the proposed H -S is quite similar to the old C -•1 and, that the CBD is a very restrictive district, and that no drive -in type of business is permitted and that signs are restricted, and CBD is strictly retail. H -S is closer to the present C -1 than any of the districts we are proposing because it is oriented to the drive-in type of business as the ::old .C- 1 was. . He explained that under Use Permits you may put in light manufacturing in the C -1 District; in the H -S District this is not a permissive use, either by use permit or otherwise. He stated that secondhand sales, mortuaries, public utility buildings and corporate yards were no longer permitted in the H -S District. Mr. Lovett inquired in the C -N zoning a use permit as such is decided by whom? Director Gallop answered that the Planning Commission makes the decision and it doesn't have to go to the Council, but that the Planning Commission denial or conditions can be appealed to the City Council. Mrs. Garey asked how much it would cost to file a Use Permit. Director Gallop stated that under the present ordinance Use Permits are $10.00 and Variances are $25.00, but that under the new Ordinance - a Use Permit would cost $25.00 and Variances $50.00. He stated that the City is required, by law, to put a public ad in the newspaper and to post in each case, and that these fees are to pay for the cost incurred by the City. He stated that in addition to posting and newspaper advertising, we also mail notices in individual cases of request to everyone that owns property within 300 feet, so that everyone is notified. On motion of Commissioner Moss, seconded by Commissioner Strother, and unanimously carried, that the hearing be adjourned to 7:45 p.m.. Tuesday, May 21st.
