PC Minutes 1968-05-07Planning Commission Arroyo Grande, California May 7, 1968 The Planning Commission met in regular session with Chairman McMillen presiding. Present are Commissioners Moss, Porter, Sawyer and- Strother. Two vacancies exist on the Commission. Also in attendance are Planning Director Gallop, Administrator Butch and Councilwoman Thompson. MINUTE APPROVAL On motion of Commissioner Strother, seconded by Commissioner Sawyer, and unanimously carried, the minutes of the Meeting of April 30, 1968 were approved as prepared. SELECTION OF A NEW VICE CHAIRMAN Commissioner Moss moved to place Commissioner Strother in nomination for Vice Chairman of the Arroyo Grande Planning Commission to complete Orville Schultz term of office, and Commissioner Porter moved that nominations be closed and the records show that there was cast a unanimous vote to appoint Newell Strother as Vice Chairman, motion carried. REVIEW - USE PERMIT NO. 67 -104 - RECAP SHOP, 111 ALDER (WHEAT) Director Gallop advised that at the last regular meeting the Planning Commission had requested him to check with the Police Department on any complaints they had received on this operation. He advised that a check with the Police Department revealed two fairly recent complaints; one on October 24, 1967, at 2:30 a.m., which was primarily a complaint of noise, and one on January 26th, 1968 at 11:00 p.m., also a complaint on the noise. On both occasions the doors were open and the officers requested the doors be closed. Director Gallop also advised that since the last regular meeting, the petitioners who hold the Use Permit filed a petition signed by quite a number of persons (approximately 29), but no addresses, stating they have no objections to the Recap Shop operation. Director Gallop stated, in checking the petitions, he found three names appearing on both petitions, for and against the operation. Mr. Bob Wheat was present and stated he is the owner of the Recap Shop and that when the shop was started a year ago., the residue container was outside of the building and since that time he has put the container inside the building. He also stated they have recently installed filters, which keeps the residue completely off of the building. He stated he recently checked the fence of these apartments and found no rubber residue, and that rubber is very heavy and if it blows vary far, there would have to be some sign of it on the fence. He stated they spent $3,000 putting in two new compressors and have done everything they could possibly do to satisfy these complaints.. He also stated that the nearby residents did not come to him with their complaints, but went to the Police Department or the Planning Commission. Mrs. Rodkey was present and stated she has the Fair Oaks Theater across the street from the Recap Shop, and that they live upstairs and would notice any dirt, rubber, noise, etc. She said she can't see where there would be any disturbance from this operation. Mrs. Trimmer was present and stated she lives in the apartments right next to the shop and some machinery was running last night and was noisy. She stated that when she hangs her washing out, the black residue settles on them. Mr. Wheat stated the only thing running was the air compressors, and with the windows and doors closed, there shouldn't be any noise. Mrs. Sorsby was present and stated she was representing Mr. McClain, Manager of Weatherby's Furniture who couldn't be present tonight, stat- ing that he doesn't hear any noise and he has some fine furniture in the store and doesn't notice any dirt or residue. Mrs. Davies stated „she lives across the street and that there is noise coming from the shop, but that it hasn't been so bad the Last couple of weeks, but that there is noise over there at night. Mrs. Rodkey stated that since Mr.. Wheat has taken over the shop, he has employed 1.1 men with families.,.and it was her understanding. that some were not permanently employed until Mr. Wheat gave them a job. 147 1 Planning Commission - May 7, 1968 Page 2 Mr. Wheat stated that if the filter installed in the pipe does not solve the problem completely, then he would completely disconnect the pipe. Mr. Darlington was present and stated he was one of the owners of the property next door, and that he was not living there, but felt that the use was improper and tenants immediately to the south were disturbed by this shop being located where it is.. He stated that if this use is continued, their only alternative would be to advise the tenants to call the Police Department any time they are disturbed., and that in talking to the tenants, they have in- formed him they still have problems. Director Gallop was requested by Commissioner Strother to read uses per- mitted under permissive uses and uses permitted under a Use Permit, which included light industry, and stated the apartments were in the C -1 District. After discussion by the Commission, on motion of Commissioner Strother, seconded by Commissioner Moss, and unanimously carried,:that a 60 day review be made for the next six months, with Building Inspector Nicklas giving a full report, starting at the next regular meeting, to see what progress has been made. PUBLIC HEARING - FOR THE CONSIDERATION OF THE COMBINING "D" DISTRICT FOR THE UNDEVELOPED PORTION OF TRACT 283 Director Gallop read a letter from McAbery and Martin.,dated May 2, 1968, developers of the retirement units, withdrawing their..request for a zoning change for the undeveloped portion of Tract 283 and thanking the Planning Commission for their courtesies. PUBLIC HEARING - USE PERMIT CASE NO. 68 -124., 823 GRAND AVENUE (UNION OIL) Upon being assured by Director Gallop that the Public Hearing for Use Permit Case No. 68 - 124 . , Union Oil Company, for a free standing sign at 823 Grand Avenue, in a C -1 Zone., had been duly posted, published and property owners notified, Chairman McMillen declared the hearing open. Mr. Marty Wachtel] was present and spoke in favor of the Use Permit being granted., stating he had a copy of the staff recommendations and was in complete accord with the recommendations.. There were no protests received. No further discussion for or against this request, Chairman McMillen declared the hearing closed. After a brief discussion by the Commission, the following action was taken: RESOLUTION NO. 68 - U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO, 68 -124 On motion of Commissioner Sawyer, seconded by Commissioner Moss, and by the following roll call vote to wit: AYES: Commissionersq Moss, Porter, Sawyer., Strother and McMillen NOES: None ABSENT: None the foregoing Resolution was adopted this 7th day of May, 1968. PUBLIC HEARING - USE PERMIT CASE NO. 68 -125, 1119 GRAND AVENUE (CRAIG) Upon being assured by Director Gallop that the .Public Hearing for Use Permit Case No. 68 - 125, Ken Craig, to allow for the display and sale of mobile homes, trailers, and supplies at 1119 Grand Avenue in a C -1 District, had been duly posted, published and property owners notified, Chairman McMillen declared the hearing open. Director Gallop advised the Commission that about four years ago a similar Use Permit was granted on the same property to M. Hartwig, but he did not know if he ever used the permit. He stated the lot had red rock .surfacing. Mr. Craig was present and spoke in favor of the Use Permit being granted., stating he would like to sell trailers on the same property used for this purpose in the past. Planning Commission - May 7, 1968 Page 3 There were no protests received. No further discussion for or against the request, Chairman McMillen declared the hearing closed. Director Gallop pointed out that any sales lot such as this, under the Ordinance, must be treated to be weather proof and dust proof. Director of Public Works Anderson had advised him that a seal coat or penetrating coat would be required. Director Gallop also pointed out that the office for the trailer sales will be conducted from Mr. Craig's office, which is approximately 70' from the site under consideration. Said office does have curb, gutter and sidewalk, and so does the sales lot, but there is an area between the two properties that does not have sidewalk., and all properties are under a common ownership. He stated the staff recommends that the present red rock surfacing be treated with either seal coat or penetrating coat to eliminate dust and provide all weather surfacing as required by Ordinance, and perhaps sidewalk required now or in the near future for that property between the office and the display yard. Chairman McMillen stated the Commission was not dealing directly with this particular piece of property between the office and the display yard, and did not feel sidewalks should be required. After discussion, Commissioner Moss moved that the Use Permit be granted with the tipula'tion that red' rock be seal coated with a dust free coating and sidewalk be installed prior to the rainy season in November. Motion was lost due to the lack of a second. After further discussion by the Commission, the following action was taken. RESOLUTION NO, 68 -95 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO, 68 -125 On 'motion of Commissioner Porter, seconded by Commissioner Strother, and by the'following roll call vote to wit: AYES: Commissioners Porter, Strother and McMillen NOES: Commissioners Moss and Sawyer ABSENT: None the foregoing Resolution was adopted this 7th day of May, 1968. . ARCHITECTURAL APPROVAL - LITTLE RED HEN, INC. Director Gallop showed the Commission a drawing and'.plot plan of the pro posed.structure and adJised.it woul.d..not be a restaurant, but for the preparation and sale of food only and, therefore, under the zoning ordinance, it is a per - missive use. Director Gallop stated that on the advice of Public Works Director Anderson, curbs and gutters could not be installed at this time until the drainage problem is resolved, but that a bond or the equivalent would be re- quired for curbs and gutters in connection with a building permit. He stated there would be parking in the front for customers and parking in the rear and at the side for employees; four parking spaces for customers and four employee parking spaces; that the front of the building would be brick and the rear would be stucco. On motion of Commissioner Strother, seconded by Commissioner Porter, and unanimously carried, that architectural approval be given in accordance with the plans as submitted and on file. COMMUNITY BUILDING DEVELOPMENT Director Gallop advised the Commission that the City Council had re- quested that the Planning Commission Chairman appoint a Commission member to a committee for the consideration of the feasibility and potentiality of a Community Building development in connection with the Arroyo Grande. Woman's Club. On motion of Commissioner Strother, seconded by Commissioner Porter, and unanimously carried, that Commissioner Moss be appointed, to the Committee. 149 50 Planning Commission - May 7, 1968 Page 4 FOLLOW UP ON USE PERMITS Commissioner Moss stated he would like to see the Planning Commission initiate a plan to assure the conditions placed on Use Permits are being lived up to, and when these conditions are not met, that action be taken promptly. Chairman McMillen directed Mr. Gallop that on all new Use Permits a report be submitted by the City Inspection Office within 60 days, and again prior to the review. ALTERNATE DATE FOR PLANNING COMMISSION MEETING OF JUNE 4th Director Gallop advised that the Commission should consider an alternate date for the regular June 4th meeting inasmuch as this is on Primary Election day and is a legal holiday for the City. After discussion, it was agreed the regular meeting of June 4th be cancelled and the date of Wednesday, June 5th was tentatively set for the meeting in lieu of June 4th.
