The Planning Commission met in regular session �aith Chairman
Strother presiding. Present were Commissioners Dexter, Evans, McMillen,
Mize, Schultz and Talley. -
MINUTE APPROVAL
A motion was made by Commissioner Talley, seconded by Commissioner
Evans, that the minutes of the regular meeting of February 1,1966 be
approved as prepared. Motion carried,
2ND TIME EXTENSION REQUEST TRACT N0. 259(Attorney"s Opinion)

dated �ebruary 10, 1966 was received from Gerald W. Shipsey, City At-
to�ney, advising that he did not feel an extension of time cauld be
granted bey�nd the initial one year extensir�n which had already been
granted and referred to the Busi.ness and Pro�essions Cade Sections
11550 through 11555o The Planning Director advised that on January
4, 1966 the developers had paid Plan Check Fees for Trnct Noo 259 in
the nmount of $46.00. After discussion it was agreed that no further
action could be taken by the Planning Commission, and a motion was
made by Commissioner McMillen, seconded by Commissioner Schultz, that
the Pl.anning Commission instruct the staff to correspond with the
petitioners of Tract 259 and inform them of Mro Shipsey's ruling, and
request that they determine, with Mr. Shipsey, if payment of Plan
Check fees on January 4, 1966 in the amount of $46.00 would allow them
to proceed with immediate filing of a final map, or if it will be nec-
essary to refile a new Tentative Map. Motion carried.
HEARING-USE PERMIT CASE NO 66-78 -- 112 Short Sto(Whitney)
The Planning Director advised the proposed use would be located
in a frame two-car garage located between un unoccupied residence and
the creek, on the west side of Short Street. Chairman Strother de-
clared that Use Permit Case No> 65--78 of Douglas R. V�Thitney to allow
for a Sheetmetal and Heating Shop on Lots 3 and 4, Block 1 of the
Short, Mason and Whiteley Addition at 112 Short St. in a C-1 Zone had
been duly published and property owners notified and the hearing was
now opened and all persons for or against the request would be heard.
Mro Douglas Whitney was present and spoke in favor of the use being
granted as it was a one owner, one operator business with only small
jo�s being taken; all work was contracted; his home telephone was -
used for the business; he had mad�e minor improvements on the building
such as concrete floor and wiring; he paid low rent and served as
caretaker for other buildings on the property; he wanted the use for
6 months to a year; and that he had been operating at this location
for nlmost a year with no complaints that he was aware of. Mr.Chester
Porter and Mr. Andrew David spoke in protest to the use being gran�ted
as they felt it was not desirable in this area, would discournge the
type of business that should be attracted in the downtown area; and
would be defeating the purpose of the Central Business District plano
Mr, Porter was advised access to this business would be from Short St.
The City Planning Director advised he felt it would be six months to
a year before concrete evidence of progress can be shown on the Central
Business District Plan and that he would recommend off-street parking
not be requ:i.red, if the use were granted on a short term basis, as
parkinc� was available on Short St. He calso pointed out that the re-
quest was a legal use under a use permit procedure in a C-1 District,
No further discussion for or against the request, Chairman Strother
declared the hearing closed. After Planning Commission discussion,
the following resolution was adopted.

PROPOSED PLaANNED UNIT DEVELOPMENT OR "PD" DISTRICT
The Planning Director distributed copies of a proposed Planned
Unit Development or "PD'� District to the Commission for their study
and review and advised that this would be one of the items for dis-
cussi�n at the joint study sessio� of the Commission nnd Council at
7:30 P,M. on February 17th, 1966o Mr, Gallop, briefly went over the
proposed District and outlined the purpose and intent of such an
ordinance,
