PC Minutes 1963-08-20116 Arroyo Grande, Cal.if. September 3rd, 1963 7:30 P.M. The Planning Commission met in regular session with Comm- issioner Shaffer presiding as Chairman pro-tem. Present were Commissioners Richardson, Schultz, Strother and Councilman ��+iood. Absent were Commissioners Brisco, Evans, Smith and Chairma.n Talley_ MINUTE �APPROVAL The minutes of the regular meeting of August 20th, 1963 were approved as prepared. RENAME VIRGINIA COURT Mrs. James �xovious presented a petition signed by a major- ity of the resi�1ents and home owners of the street, requesting Virginia. be renamed to Virginia Drive. Commissioner Brisco joined the Planning Co�mmission. A motion was made by Commissioner Strother, seconded by Commissioner Schultz, that the request to rename Virginia Court to Virginia Drive be set for hearing at 5:00 P.M., SeZ�tember 17, 1963, subject to a decision from the City Attorney that the Planning Commission will conduct such hearings. All members present voted "Aye". _ . PARKIIJG-STREET N1�ME REPORT Commissioner Shaffer, as Chairman of the Parking and Street Name Committee, reported as follows: The report on Parking pre- pared by the committee was still in the hands of the City Attorney. The Co�arnittee had met on Street Idames and at the present time could only suggest the road from the intersection of Branch Street,. Crown Street, and the San Luis Obispo-Arroyo Grande Road, con- tinuing across Harris Bridge to the Huasna Area be designated as Huasna Road and the road from Cherry Avenue to the Biddle Ranch beyond the old Branch School be designated as Mil1 Road, and the Committee had reached no agreement on the road adjacent to Tract No. 273 and the east City Limits now known as Coach Road. As portions of these roads are in the County Area it was agreed to continue the matter to the next meeting. EAST CHERRY PLAN LINES Mr. Anderson advised the Planni.ng Commission, work was being done on the East Cherry Plan Lines Cherry Avenue to Coach Road and would be presente lst meeting. HOME OCCUPATION ORDIDIANCE The City Administrator notified the Planning City Attorney was rewording the home occupation had requested a meeting with the Comanittee to be September 4th, in Mr. Butch's office. TREE PLANTING ORDINANCE preliminary to extend d at the October Cpmmission the ordinance and heZd at 4;00 P.M. The City Administrator advised the Planning Commission the City Attorney had completed the Tree Planting Ordinance except for including a penalty clause and that the ordinance would be presented at the �ext meeting. CZTY ATT. REPORT ON COND. USE PERP+iIT � The City Administrator read a report from the City Attorney advising as follows:. Conditional Use Penc►its can be revoked or made null and void under Sections 7.4 and 7.3 of Ordinance No- 157; ��� PLANNIIdG COMMISSION - 3eptember 3rd, 1963- page 2 a land owner who received a permit may request the City to revoke the permit prior to tYie expiration af the one year period by�followinc} the procedure recommended by tt�e City Attorney that (a) the permittee,landowner write a ietter to the Gity Council asking that the use permit be immediately revoked and declared nul.l and vo�.d, (b) The letter application be referred to the Plaruzing Co�nission for their recommendation, (c) in the event of a f�vorable recommendation from the Pianning Commission, the City Council adopt a resolution revoking the permit; in the. opinion of the City Attorney the manner in which use permits may be amended is that it would have to proceed under Sec- tion 7.4 to revoke the permit; it would further be nec- essary to show a change of conditions which existed a�"`the time of issuing the permit; following this, an application for a new permit could be made and new�conditions attached. REPORT ON ' .: - . � . ."- - - - - �- -• -_ - - - ORDINANCE-RETROACTIVE Z"he City Administrator read a report from the City Attorney advising that the general rule is that an�Ord- inance cannot be made retroactive and on the actual ques- tion an whether or not the City may refuse to issue a � building permit on a lot not meeting present minimum stan- dards, advised that Section 5.16 of Ordinance No. 1�7 pro- vides thzt the use may be allowed if the lot in.question was in single ownership on January 9, 1962, when the Ord- inance was adopted. � , DRAINAGE AND SLOPING STANDARDS Mr.,Anderson notified th� Pianning Commission drainage and sloping standards were being prepared and preliminary outlines would be presented at the next regular meeting. LOT-SPLIT DISCUSSION- . �. RENAI� 26th STREET The Clerk read a copy of a letter from the County Plann- ing Commission to the County Board of Supervisors reconunend- ing 26th Street be renamed Elm Street from the south City Limits of F.rroyo Grande to Highway l, as requested by the City of Arroyo Grande.
