PC R 99-1709RESOLUTION NO. 99-1709 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM CASE NO. 99-002, APPLIED FOR BY ALBERTSONS, LOCATED AT 1464 GRAND AVENUE WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application by Albertsons for Planned Sign Program Case no. 99-002, with Architectural Review, located at 1464 Grand Avenue in the General Commercial District; and WHEREAS, the applicant is proposing to replace the lettering on the front wall and monument signs at the existing Lucky's supermarket with the "Albertsons" logo and lettering and remove all secondary signage; and WHEREAS, the existing Lucky signs were approved prior to the adoption of the Sign Regulations and therefore are legal non-conforming; and WHEREAS, Development Code Section 9-10.100 states that nonconforming signs are allowed to remain until such time as the sign is expanded, modified or moved, and the change of copy of a nonconforming sign does not constitute grounds for modification of a nonconforming sign; and WHEREAS, the Planning Commission has found that this Planned Sign Program and architectural review is consistent with the General Plan and Environmental Documents associated therewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQA Guidelines Section 1531 1(a); and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed signs are consistent with the goals, objectives, policies and programs of the Arroyo Grande General Plan and the Berry Gardens Specific Plan. The goals of the General Plan are to encourage economic vitality and business activity, protect investments while preserving the environment and character of the City. Said signs are important to the success of this business and are not out of scale or character with other signs in this zone and vicinity. 2. The proposed signs conform to applicable development standards and provisions of the Development Code, and will not be detrimental to the public health, safety or welfare. The physical location or placement of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Planned Sign Program Case No. 99-002, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. ATTEST: Kathleen Fryer, Commi ion Clerk �S Q,(,(��JYIC'� L� �/N� � Laurence Greene, Chair AS T CO TENT: � Kerry ants, Community Development Director � J J Resolution No. 99-1709 Planned Sign Program Case No. 99-002 Albertsons October 19, 1999 Page3of4 EXHIBIT "A" CONDITIONS OF APPROVAL PLANNED SIGN PROGRAM CASE NO. 99-002 1464 Grand Avenue Albertsons GENERAL CONDITIONS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes the placement of one 1 17.7 square foot "Albertsons" wall sign on the front elevation of an existing building, and lettering on one existing monument sign of 120 square feet, as illustrated in Exhibits "B1- B3". 1 2 The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. The applicant shall comply with all conditions of approval for Planned Sign Program Case No. 99-002. 3. This application shall automatically expire on October 19, 2001 unless a building permit is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1► year from the original date of expiration. 4. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of October 19, 1999 and marked Exhibit "B1 ". 5. The applicant shall agree to defend at his/her sole expense any action brought against the City, its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. DEVELOPMENT CODE 6. Development shall conform to the General Commercial zoning requirements and the Sign Ordinance except as otherwise approved. The UL listing label shall be located on the top of the sign so that it is not visible from below. 8. The toggle switch shall be placed on the top of each letter. BUILDING AND FIRE DEPARTMENT CONDITION 9. The project shall comply with the most recent editions of the California State Fire and Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo Grande. 10. The applicant shall obtain any necessary permits from the City's Fire and Building Department, as determined by the Chief Building Inspector.
