PC R 98-1678RESOLUTION NO. 98-1678 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A VARIANCE APPLIED FOR BY SUSAN P. FLORES AT 529 EAST BRANCH STREET WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Variance Case No. 98-213 for approval of a variance at 529 East Branch Street, APN 007-263-028; WHEREAS, the Planning Commission has held a public hearing on this application in accordance with City Code; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and is exempt from environmental review pursuant to the California Environmental Quality Act and the Arroyo Grande Rules and Procedures for Implementation to CEQA; and WHEREAS, the Planning Commission finds after due study, deliberation and public hearing, the following circumstances exist: Variance Findings: 1. That strict or literal interpretation and enforcement of the �a 3. ._,� � C� specified regulation would result in practical difficulty or unnecessary hardship not otherwise shared by others within the surrounding area. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties classified in the same zone. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties classified in the same zone. That the granting of the variance will not constitute a grant of special privilege inconsistent with the limitations on other properties classified in the same zone. That the granting of the variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. That the granting of a variance is consistent with the objectives and policies of the General Plan and the intent of this title. Resolution No. 98-1678 December 1, 1998 Page 2 of 2 NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Variance Case 98-213 and finds that the project is exempt from review pursuant to the California Environmental Quality Act and the Arroyo Grande Rules and Procedures for Implementation to CEQA, instructs the Secretary to file a Notice of Exemption, with the above findings.
