PC R 98-1676RESOLUTION NO. 98-1676 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DENYING CONDITIONAL USE PERMIT 98-565 APPLIED FOR BY ROBERT ANDERSON, LOCATED AT 200 STATION WAY (VILLAGE CREEK PLAZA) WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a Conditional Use Permit 98-565 application filed by Robert Anderson to construct a 27,350 square foot commercial office and commercial retail complex; and WHEREAS, the Planning Commission has held a duly noticed public hearing December 1, 1998 in accordance with City Code; and WHEREAS, the Planning Commission has reviewed and considered the information and public testimony presented at the public hearings, the staff report and other information and documents that are part of the public record; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposed use is permitted within the General Commercial District; however, the project does not comply with all the applicable provisions of the Development Code, the goals and objectives of the General Plan, and .the development policies and standards of the City. 2. The proposed use will impair the integrity and character of the neighborhood in which it is to be established because the proposed commercial use is not consistent with the Development Code requirements for parking, landscaping and density and is too intensive for the site creating conflicts with adjacent uses in the neighborhood. 3. The site is not suitable for the type and intensity of the proposed because the 2.7 acre gross and approximately 2.3 acre net site is not large enough to accommodate the density and intensity of the use causing parking and circulation and aesthetic problems. 4. The proposed use will be detrimental to the public health, safety, or welfare, or materially injurious to properties and improvements in the vicinity because the increased density and lack of adequate landscaping and other site improvements would adversely impacts the neighborhood. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City .of Arroyo Grande hereby denies Conditional Use Permit 98-565 based on the above findings incorporated herein by this reference.
