A RESOLUTION OF .THE PLANNING COMMISSION .OF THE CITY OF
ARROYO CRANDE APPROVING A ONE YEAR TIME EXTENSJON FOR
TENTATIVE TRACT MAP 2197AND CONDITIONAL USE PERMIT 95-
534 FOR A FIVE UNIT PLANNED UNIT DEVELOPMENT LOCATED
AT 260 SPRUCE STREET, APPLIED FOR RICHARD ARMSTRONG
WHEREAS the Planning Commission of the City of Arroyo Grande has
considered a request for a one-year tine extension for Tentative Tract Map
2197 and Conditional Use Permit 95-534: filed by Richard Armstrong to
construct a five unit planned unit development, located at 260 Spruce
Street; and
WHEREAS, tile City Council approved The project on September 12, 1995;
and
WHEREAS, tile Planning Commission held a public hearing on November 4,
1 998 to consider this application in accordance with City Codes; and
WHEREAS the Planning Commission has found that this project is consistent
with the City's General Plan; and
WHEREAS, the Planning Commission finds, after due study, deliberation and
public hearing, that there have been no significant changes in the General
Plan, Municipal Code or character of the area within which the project is
located that would cause the approved project to be injurious to the public
health, safety, or welfare.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the
City of Arroyo Grande hereby approves a one-year time extension for
Tentative Tract Map 2197 and Conditional Use Permit 95-534, with the
above findings and subject to the conditions as set forth in Attachment "A"
attached hereto and incorporated herein by this reference.
On motion of Commissioner Haney seconded by Commissioner Keen and by
the following roll call vote, to wit:
AYES: Commissioners Parker, Keen, Haney, Greene and Lubin
NOES: None
ABSENT: None
the foregoing Resolution was adopted this 4th day of November 1998.

CONDITIONS OF APPROVAL
TENTATIVE TRACT MAP 2197 &
CONDITIONAL USE PERMIT 95-534
TIME EXTENSION
GENERAL CONDITIONS
COMMUNITY DEVELOPMENT DEPARTMENT
This approval authorizes a one-year time extension for Tentative Tract 2197
and Conditional Use Permit No. 95-534; allowing development of a five unit
planned unit development located at 260 Spruce Street.
1. The applicant shall ascertain and comply with all Federal, State,
County and City requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for
Tentative Tract Map 2197 and Conditional Use Permit 95-534.
3. Tentative Tract Map 2197 and Conditional Use Permit 95-534 shall
automatically expire on September 12, 1999. The applicant may
apply for an additional time extension pursuant to Development Code
Section 9-02.140
4. The applicant shall agree to defend at his/her sole expense any action
brought against the City, its present or former agents, officers, or
employees because of the issuance of said approval, or in anyway
relating to the implementation thereof, or in the alternative, to
relinquish such approval. The applicant shall reimburse the City, its
agents, officers, or employees, for any court costs and attorney's
fee's which the City, its agents, officers or employees may be
required by a court to pay as a result of such action. The City may,
at its sole discretion, participate at its own expense in the defense of
� any such action but such participation shall not relieve applicant of
his/her obligations under this condition.
