A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE RECOMMENDING THAT THE
C1TY COUNCIL CERTIFY COMPLETION AND MAKE
FINDINGS AS TO THE FINAL ENVIRONMENTAL IMPACT
REPORT PREPARED FOR THE BERRY GARDENS SPECIFIC
PLAN; APPLICANT: CHARLES BAKER
WHEREAS, the Planning Commission of the City of Arroyo Grande has considered the
following applications: Certification of the Berry Gardens Specific Plan Environmental
Impact Report (EIR►; filed by Charles Baker, for the property generally located south of
Grand Avenue, north of Ash Street, east of Oak Park Blvd., and west of Spruce
Street; and
WHEREAS, the Planning Commission held a duly noticed public hearing on August 4,
1998 to consider this application in accordance with City Codes; and �
WHEREAS, said EIR meets the requirements of state and local environmental laws,
addresses the concerns raised during the review period and at public hearings,
adequately addresses the potentially significant environmental impacts, and
recommends suitable mitigation measures for said impacts; and
WHEREAS, the Planning Commission makes the following findings of fact:
1. Based on the information set forth in the EIR, Addendum, and in the Statement
of Significant Environmental Effects and Mitigation Measures, the Planning
Commission determines that changes or alterations have been required in, or
incorporated into, the project which avoid or substantially lessen the adverse
environmental effects identified in the E1R.
2. No additional adverse impacts will have a significant effect or result in a
substantial or potentially substantially adverse change in the environment as a
result of the proposed amendment.
3. All significant environmental effects identified in the EIR and Addendum have
been reduced to an acceptable level in that all significant environmental effects
that can be feasibly avoided have been eliminated or substantially lessened as
determined through the findings set forth in paragraphs (1) and (2) above.
WHEREAS, the Planning Commission has reviewed and considered the information
contained in the EIR for the project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby recommends that the City Council certifiy that the
Environmental Impact Report for Berry Gardens Subdivision has been prepared and
completed in compliance with CEQA, the State CEQA Guidelines, and the City's Rules
and Procedures.

following roll call vote, to wit:
AYES: Commissioners Haney, Green, Keen, Parker and Chair Lubin

the foregoing Resolution was adopted this 4th day of August 1998.
