PC R 98-1659RESOLUTION NO. 98-1659 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING A ONE YEAR TIME EXTENSION FOR CONDITIONAL USE PERMIT 95-535 AND ASSOCIATED ARCHITECTURAL REVIEW FOR A 39,636 SQUARE FOOT YMCA LOCATED AT 400 WEST BRANCH STREET, APPLIED FOR BY SOUTH COUNTY YMCA WHEREAS, the Planning Commission of the City of Arroyo Grande has considered a request for a one year time extension for Conditional Use Permit 95-535, filed by South County YMCA, to construct a 39,636 square foot facility, located at 400 West Branch Street; and WHEREAS, the Planning Commission approved the project on June Z0, 1995 by adopting Resolution 95-1520; and WHEREAS, the Planning Commission held public hearings on June 16 and July 21, 1998 to consider this application in accordance with City Codes; and WHEREAS, the Planning Commission has found that this project is consistent with the City's General Plan; and WHEREAS, the Planning Commission finds the project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15314 of the CEQA Guidelines; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that there have been no significant changes in the General Plan, Municipal Code or character of the area within which the project is located that would cause the approved projects to be injurious to the public health, safety; or welfare. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves a one-year time extension for Conditional Use Permit 95-535, with the above findings and subject to the conditions as set forth in Attachment "A", attached hereto and incorporated herein by this reference. AITEST: � ' Pearl Phinney, Commission C rk AS TO CONTENT: �� Helen Elder, AICP Acting Community Development Director Resolution No. 98-1659 ATTACHMENT "A" CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT 95-535 TIME EXTENSION SOUTH COUNTY YMCA 400 WEST BRANCH STREET GENERAL CONDITIONS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes a one-year time extension for the 39,636 square foot YMCA, located at 400 West Branch Street. 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to this project. 2. The applicant shall comply with all conditions of approval for Conditional Use Permits 95-535. 3. The Conditional Use Permit shall automatically expire on June 20, 1999. Thirty (30) days prior to the expiration of the approval, the applicant may apply for a time extension. 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, �its present or former agents, officers, or employees because of the issuance of said approval, or in anyway relating to the implementation thereof, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. � � bb\cups\lymca\07 2198timeeMreso
