PC R 98-1652�I RESOLUTION NO. 98=1652 A RESOLUTION OF THE PLANNING COMMISSION OF THE C1TY OF ARROYO GRANDE RECOMMENDING THAT THE ClTY COUNCIL APPROVE LOT LINE ADJUSTMENT CASE NO. 98- 053, APPLIED FOR BY HOWARD MANNlESJ CENTERS, LLC. WHEREAS, the Planning Commission of the City of Arroyo Grande has heid a public hearing on Lot Line Adjustment Case No. 98-053; and WHEREAS, the Planning Commission has found that these projects are consistent with the General Plan; and WHEREAS, the Planning Commission has reviewed these projects in compliance with the California Environmental Quality Act (CEQA1, the CEQA guidelines, and the City's Rules and Procedures for the lmplementation of CEQA; and WHEREAS, said projects were referred to the Planning Commission, 6y various City Departments and the Staff Advisory Committee; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: This Lot Line Adjustment will not: 1. Create any new lots. 2. Include any lots or parcels created illegally. 3. Impair any existing access or create a need for access to any adjacent lots or parcels. � 4. Impair any existing easements or create a need for any new easements serving adjacent lots or parcels. 5. Constitute poor land planning or undesirable lot configurations due to existing environmental conditions or current zoning development standards. 6. Require substantial alteration of any existing improvements or create a need for any new improvements. 7. Create a non=conforming lot in the General Commercial zoning district. Resolution No. 98-1652 Lot Line Adjustment Case No. 98-053_ West Branch Street, Five Cities Center April 21, 1998 Page 2 NOW, THERE�ORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby recommends that the City Councii approve Lot Line Adjustment Case No. 98-053 with the above findings and subject to the conditions as set forth in Attachment "A", attached hereto and incorporated herein by this reference. On motion by Commissioner Greene, seconded by Commissioner Haney, and by the following roll call vote, to wit: AYES: Commissioners Greene, Haney, 0'Donnell, Rondeau and Chair Lubin NOES: None ABSENT: None the foregoing Resolution was adopted this 21"' day of April, 1998. Elder, AICP, Acting Community Development Director Resolution No. 98-1652 ATTACHMENT "A" CONDITIONS OF APPROVAL LOT L1NE ADJUSTMENT CASE NO. 98-053 ESJ Centers, LLC West Branch Street, Five Cities Center COMMUNITY DEVELOPMEIVT DEPARTMENT GENERAL CONDITIONS This approval authorizes the reconfiguration of two (Z) commercial lots. 1. The applicant shail ascertain and compfy with all Federal, State, County and City requirements as are applicable to this project. 2. This application shall automatically expire on April 21, 2000 unless the Lot Line Adjustment is finaled. Thirry (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 3. Development shall occur in substantial conformance with the attactied Exhibit "A". 4. The applicant shall, as a condition of approvai of this project, defend, indemnify and hold harmless the City of Arroyo Grande, its present or former agents, officers and empioyees from any claim, action, or proceeding against the City, its past or present agents, officers, or employees to attack, set aside, void, or annui City's approva! of this subdivision, which action is brought within the time period provided for by law. DEVELOPMENT CODE 5. G•^' Development shall conform to the General Commercial requirements except as otherwise approved. The developer shall comply with Development Code Chapter 9-04, "Land Divisions". 7. The developer shall comply with Development Code Chapter 9-14, "Dedications, Fees and Reservations." Resolution No. 98-1652 PUBLlC WORKS DEPARTMENT All Pubiic Works Department conditions of approva( as listed below are to be complied with prior to the devefopment of any parcel, unless specifically noted otherwise. 8. All existing easements, offers of dedication, and agreements applicabie to the existing parcels shall be retained and shown on the recorded documents. 9. This Lot Line Adjustment shall be finalized by recordation of the parcel boundary description and by deed transfers in accordance with the Subdivision Map Act.
