A RESOLUTION OF THE PLANNING CONIlVIISSION OF
THE CITY OF ARROYO GRANDE RECOMII�NDING THE
CITY COUNCIL APPROVE PLANNED SIGN PROGRAM
CASE NO. 97-122 AND MINOR ARCHITECTURAL
REVIEW, APPLIED FOR BY CARL'S KARCHER
ENTERPRISES (CARL'S JR.) AT 1590 WEST BRANCH
STREET
V'VHEREAS, the Planning Commission of the City of Arroyo Grande has considered an
application by Carl's Karcher Enterprises (Carl's Jr.), for Planned Sign Program Case No. 97-
122 with an Architectural Review in the Planned Development district; and
WHEREAS, the Planning Commission has found that this planned sign program and
architectural review is consistent with the General Plan and the Environmental Documents
associated therewith; and
W��REAS, the applicant is proposing to install a new parapet wall four (4) feet in
height; and
V�IEREAS, the applicant is proposing to remove three (3) existing canister signs and
replace them with two (2) individually illuminated channel signs; and
WHEREAS, the Planning Commission has reviewed this project in compliance with the
California Environmental Quality Act (CEQA) and has determined that the project is
categorically exempt per CEQA Guidelines Section 15311(a); and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances exist:
l. The proposed signs are consistent with the goals, objectives, policies and programs of
the Anoyo Grande General Plan and the Oak Park Acres Planned Development. The
proposed signs balance the need for identification of businesses with the rural small town
character of the community.
2. The proposed signs conform to applicable development standards and provisions of the
Development Code, and will not be detrimental to the public health, safety or welfare. �
3. The physical location or placement of the signs are compatible with the existing signage
with the Oak Park Shopping Center and surrounding neighborhood and do not pose a
safety risk.
NOW, TFIEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Arroyo Grande hereby recommends approval of Planned Sign Program Case No. 97-122 and
Architectural Review to the City Council, with the above findings and subject to the conditions
as set forth in Attachments "A" , attached hereto and incorporated herein by this reference.

GENERAL CONDITIONS
COMMUNITY DEVELOPMENT DEPARTMENT
This approval authorizes the construction and placement of two (2) "Carl's
Jr." signs on the parapet wall, one on the east and one on the west
elevation; two (2) "Green Burrito" signs on the parapet wall, one on the east
and one on the west elevation; replace the existing awning that hangs under
the building soffit from gold to red; construct a new four (4) foot high
parapet wall; change the sign copy on the existing directional signs, and;
repaint the building a medium shade of gray and off-white with gray tones,
as depicted on Exhibits "A" and "B". The existing signs shall be removed
and the fascia and roof tile replaced to match the existing building.
1. The applicant shall ascertain and comply with all Federal, State, County
and City requirements as are applicable to this project.
2. The applicant shall comply with all conditions of approval for Planned Sign
Program Case No. 97-122.
3. This application shall automatically expire on April 15, 1999 unless a
building permit is issued. Thirty (30) days prior to the expiration of the
approval, the applicant may apply for an extension of one (1) year from
the original date of expiration.
4. Development shall occur in substantial conformance with the plans
presented to the Planning Commission at the meeting of April 15, 1997
and marked Exhibits "A" and "B".
5. The applicant shall agree to defend at his/her sole expense any action
brought against the City, its present or former agents, officers, or
employees because of the issuance of said approval, or in anyway relating
to the implementation thereof, or in the alternative, to relinquish such
approval. The applicant shall reimburse the City, its agents, officers, or
employees, for any court costs and attorney's fee's which the City, its
agents, officers or employees may be required by a court to pay as a
result of such action. The City may, at its sole discretion, participate at
its own expense in the defense of any such action but such participation
shall not relieve applicant of hislher obligations under this condition.
DEVELOPMENT CODE
6. Development shail conform to the Oak Park Planned Development 1.1
requirements except as otherwise approved.
SPECIAL CONDITIONS
7. The Carl's Jr. and Green Burrito signs shall be a minimum of six feet apart
on the parapet wall.
8. The existing signs shall be removed and the roof and fascia rebuilt to match
the existing building.
