WHEREAS, the Planning Commission of the City of Anoyo Grande has considered
Conditional Use.Permit Case No. 96-547, filed by Naresh Patel, for a remodel and 1,615 square
foot expansion to the existing Econo Lodge; and ,
V'VHEREAS, the Planning Commission has held a public hearing on this application in
accordance with City Codes; and
WHEREAS, the Planning Commission has found that this project is consistent with the
General Plan and the environmental documents associated therewith; and
WHEREAS, the Planning Commission has reviewed the draft negative declaration under
the provisions of the California Environmental Quality Act (CEQA), the State CEQA Guidelines,
and the Arroyo Grande Rules and Procedures for the Implementation of CEQA; and
WHEREAS, the Planning Commission finds after due study, deliberation and public
hearing, the following circumstances exist:
Conditional Use Permit Findings:
1. The proposed use is permitted within the GC District pursuant to �the provisions of Section
9-03.050 of the Development Code, and complies with all applicable provisions of the
Development Code, the goals and objectives of the Anoyo Grande General Plan, and the
development policies and standards of the City. •
2. The proposed use will not impair the integrity and character of the district in which it is to
be established or located.
3. The site is suitable for the type and intensity of use or development that is proposed.
4. There are adequate provisions for water, sanitation, and public utilities and services to
ensure the public health and safety.
5. The proposed use will not be detrimental to the public health, safety, or welfare, or
materially injurious to properties and improvements in the vicinity.
Department of Fish and Game Required Findings of Exemption:
l. . The City of Arroyo Grande has prepared an initial study, pursuant to Section 15063 of the
Guidelines of the California Environmental Quality Act (CEQA), for Conditional Use
Permit Case No. 96-547.
2. Based on the initial study, a negative declaration has been drafted for review by the public
and approval by the Planning Commission.

3. After holding a public hearing pursuant to State and City Codes, and considering the record
as a whole, the Planning Commission adopted the negative declaration and found that there
is no substantial evidence of any significant adverse effect, either individually or
cumulatively on wildlife resources as defined by Section 711.2 of the Fish and Game Code
or on the habitat upon which the wildlife depends as a result of development of this project.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of
Arroyo Grande hereby adopts a negative declaration with mitigation measures, instructs the
s�cretary to file a Notice of Determination, and approves Conditional Use Permit Case No. 96-
547 with the above findings a�d subject .to t�e conditions and mitigation measures as set forth
in Attachments "A" and "B", attached hereto and incorporated herein by this reference.
On motion of Commissioner Lubin, seconded by Commissioner Keen, and by the following
roll call vote, to wit:

CONDITIONS OF APPROVAL

COMMU1vITY DEVELOPMENT DEPARTMENT
GENERAL CONDITIONS
This approval authorize$ the addition of 645 square feet to the existing first floor of the motel
for an administrative office and lobby and the addition of 738 square feet and 232 square feet
to the existing second story for a manager's unit and storage respectively.
1. The applicant shall comply with all conditions of approval for Variance Case No. 96-200.
2. This application shall automatically expire on December 17, 1998 unless a building permit
is issued. Thirty (30) days prior to the expiration of the approval, the applicant may apply
for an extension of one (1) year from the original date of expiration.
3. Development shall occur in substantial conformance with the plans presented to the Planning
Commission at the meeting of December 17, 1996 and marked Exhibit "A" .
4. The applicant shall agree to defend at his/her sole expense any action brought against the
City, its present or former agents, officers, or employees because of the issuance of said
approval, or in anyway relating to the implementation thereof, or in the alternative, to
relinquish such approval. The applicant shall reimburse the City, its agents, officers, or
employees, for any court costs and attorney's fees which the City, its agents, officers or
employees may be required by a court to pay as a result of such action. The City may, at
its sole discretion, participate at its own expense in the defense of any such action but such
participation shall not relieve applicant of his/her obligations under this condition.
TREES
5. Prior to issuance of a building permit and during construction the applicant shall comply
wifh the provisions of Ordinance 431 C.S., the Community Tree Ordinance.
DEVELOPMENT CODE
6. Development shall conform with the GC zoning requirements except as otherwise approved.
7. Signage shall be subject to the requirements of Development Code Chapter 9-13.
8. Prior to issuance of a certificate of occupancy, all ducts, meters, air conditioning
equipment and all other mechanical equipment, whether on the ground, on the structure or
elsewhere, shall be screened from public view with materials architecturally compatible with
the main structure. It is especially important that gas and electric meters, electric
transformers, and large water piping systems be completely screened from public view. All
roof-mounted equipment which generates noise, solid particles, odors, etcetera, shall cause
the objectionable material to be directed away from residential properties.

9. Setbacks, lot coverage, and floor area ratios shall be as shown on the development plans,
Exhibit "A", except as specifically modified by these conditions.
10. All planted areas shall be separated from the driveway by concrete curbs.
11. Prior to issuance of a building permit, the development shall comply with Development
Code Sections 9-10.070, "Fences, Walls and Hedges" ; 9-10. 080, "Ligl�ting" ; 9-10.110,
"Performance Standards"; and 9-10.120 "Screening Requirements".
12. Prior to issuance of a building permit, the developer , shall comply with Development
Code, Chapter 9-12, "Parking and Loading Requirements" .
PARKS AND RECREATION DEPARTMENT
SPECIAL CONDITIONS
13. The developer shall replace the two trees shown on the site plan as "to be removed" with
a minimum of two 15 gallon trees on-site. The specie and location of the trees shall be
subject to the approval of the City Arborist.
BUILDING AND FIRE DEPARTMENT CONDITIONS
ADDRESSES
14. Prior to issuance of a certificate of occupancy, all addresses shall be visible at the street
and on individual residences.
UBC/UFC
15. The project shall comply with the most recerit editions of the California State Fire and
Building Codes and the Uniform Building and Fire Codes as adopted by the City of Arroyo
Grande. .
16. All roofs shall be class "A" .
FIRE LANES
17. All fire lanes must be posted and enforced, per Police Department and Fire Department
guidelines.
CONSTRUCTION TAX
18. Prior to issuance of a Certificate of Occupancy, applicant shall pay a construction tau
pursuant to Article 5, Cfiapter 3, Title 3 of the Arroyo Grande Municipal Code.
SECURITY KEI' BOX
19. Prior to issuance of certificate of occupancy, applicant must provide an approved "security
key vault," per Building and Fi�e Department guidelines.

COMPACTION TEST
20. Prior to concrete pour inspection, compaction tests are required in the footings.
ELECTRICAL CONDUIT
21. Electrical conduit shall have separate ground wire installed.
PUBLIC WORKS DEPARTMENT CONDITIONS
All conditions of approval herein specified, unless otherwise noted, are to be
complied with prior to issuance of a cert�cate of occupancy.
SPECIAL CONDITIONS
22. The applicant shall replace broken curb, gutter, and sidewalk along El Camino Real, Bell
Street and Bennett Avenue frontages of the project to the satisfaction of the Director of
Public Works.
23. The applicant shall replace broken driveway approaches and curb and gutter along El
Camino Real and Bell Street to the satisfaction of the Director of Public Works.
24. The applicant shall install to City standards, handicap ramp at the southeast corner of Bell
Street and El Camino Real, and at the northeast corner of Bell Street and Bennett Avenue.
25. The applicant shall coordinate with the Parks and Recreation Director all construction that
require the cutting of tree roots.
26. The applicant shall obtain an encroachment permit and contact Underground Service Alert
(LTSA) prior to the start of any work within the City right of way.
ARCHITECTURAL ADVISORY COMIVIITTEE CONDITIONS
27. The height of the porte cochere may be reduced to the minimum height required for Fire
Department access. More specifically, a minimum clearance of 13'-6" (with maximum
clearance of 14' 11" from finished grade to the bottom of the roof structure shall be
provided unless otherwise approved by the Director of Building and Fire.
28. The surface beneath the porte cochere shall be delineated by paving or stamped concrete.
29. An awning shall be installed over the second story sliding glass door on the west elevation.

A negative declaration with mitigation measures has been adopted for this project. The
follo�wing mitigation measures shall be implemented as conditions of approval and shall
be monitored by the appropriate City department or responsible agency. The applicant
shall be responsible for verification in writing by the monitoring department or
agency that the mitigatian measures have been implemented.
ARCHAEOLOGY
1. In the event that during grading, construction, or development of the project, any
archaeological resources are uncovered, all work shall be halted until the City has reviewed
the resources for their significance. If human burials are encountered, the County Coroner
(781-4513) shall be contactetl immediately. The ap�licant may be required to provide
archaeological studies and/or mitigation measures. All grading and improvements plans
shall be noted to reflect this mitigation. A representative of the appropriate tribe shall be
present on site during all grading, trenching and excavation.
Time Frame: Prior to issuance of grading or building permits for the

NOISE
2. The following standard mitigation package, from the Noise Element, to achieve a NLR of
20 dB shall be implemented: Normal construction practices per the latest edition of the
Uniform Building Code are st�fficient provided:
a) Air conditioning or a mechanical ventila�ion system is installed so that windows and
doors may remain closed;
b) Windows and sliding glass doors are mour�ted in low air infiltration rat� frames (0.5 cfm
or less, per ANSI specifications); and
c) Exterior doors are solid core with perimeter weather-stripping and threshold seals.
