PC R 96-1590RESOLUTION NO. 96-1590 A RESOLUTION OF THE PLANNING COMIVIISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A"QUICK LUBE" BUSINESS IS NOT A PERMITTED USE IN THE GENERAL COMI��RCIAL DISTRICT WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and . WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title; and WHEREAS, Development Code Table 9-07.030-A indicates businesses that fall within the use category of "auto-related repair and service", which include automobile and light truck repair, automobile service station, and tire sales and service, are not permitted in the General Commercial District; and WHEREAS, the Planning Commission has received a request for interpretation of whether a"quick lube" business that provides oil changes and replacement of small vehicle parts can operate in the General Commercial District; and WHEREAS, the Planning Commission, after due research arld deliberation finds that: 1. The Anoyo Grande Development Code does not allow said use in the General Commercial District because the primary purpose of the General Commercial District is to provide for the general shopping needs of area residents and workers with a variety of retail and commercial services. Furthermore, auto-related repair and service is specifically limited to the Highway Commercial District in order to provide an area for auto-related uses along major travel routes. Therefore, the proposed use is not similar to other uses allowed in the General Commercial District: NOW, TFIEREFORE, BE IT RESOLVED that the Planning Commission of the City of Anoyo Grande hereby makes the interpretation that the business described above is NOT a permitted use in the General Commercial District. On motion of Commissioner Deviny, seconded by Commissioner Keen, and by the following roll call vote, to wit: � AYES: Commissioners Deviny, Keen, Lubin, Titus and Tappan NOES: None ABSENT: None the foregoing Resolution was adopted this 19th day of November, 1996.
