PC R 96-1587RESOLUTION NO. 95-1587 A RESOLUTION OF THE PLANNING COMIVIISSION OF THE CITY OF ARROYO GRANDE �� SELECTING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE THE ARROYO GRANDE REDEVELOPMENT PROJECT AREA AND APPROVING A PRELIlI�NARY PLAN FOR REDEVELOPMENT OF THE PROJECT AREA WHEREAS, on September 24, 1996, by resolution, the Arroyo Grande City Council designated a Redevelopment Survey Area for redevelopment study purposes; and WHEREAS, the California Community Redevelopment Law (Health and Safety Code Section 33000, et seq.) provides for the local planning agency, in cooperation with the Redevelopment Agency ("Agency") to select a redevelopment project area from within the boundaries of a survey area, and to formulate a preliminary plan for the redevelopment of the proposed Anoyo Grande Redevelopment Project Area ("Project Area"); and WHEREAS, the Planning Commission has reviewed the Preliminary Plan submitted herewith, and based thereon has determined that the boundaries of the Project Area as hereinafter set forth are appropriate; NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Arroyo Grande hereby resolves as follows: Section 1. The Planning Commission hereby selects and designates those properties shown on attached Exhibit A to be included within the Project Area. Exhibit A is included within the Preliminary Plan as Appendix A. The designated properties are being included based upon the Planning Commission knowledge about the project areas and after consideration of consultant field surveys and recommendations, and consultations with Agency staff. Each of the parcels recommended for inclusion within the Project Area were included within the redevelopment Survey Area previously designated by the City Council. In the event that it may be necessary, for clarification purposes, to make minor technical changes to the boundaries described in Appendix A, the Planning Commission finds and determines that minor, technical changes for clarification purposes do not materially affect the boundaries selected and designated herein, and approves and authorizes such minor, technical changes. Section 2. Tfie Planning Commission hereby approves the Preliminary Plan for the Redevelopment Project in the form sub :;�tted herewith and incorporated herein by reference. Section 3. The Secretary of the Planning Commission is hereby authorized and directed to submit the Preliminary Plan and related appendices, including the map showing the Planning Commission's recommended boundaries for the Project Area, to the Arroyo Grande Redevelopment Agency for their further consideration and subsequent action. INTRODUCTION The purpose of this Preliminary Pian is to provide direction for the Arroyo Grande Redevelopment Agency in the implementat�on of inethods and procedures to satisfy the needs of the residents and business community in the development of a viable and active residential, commercial, and industrial base in the area proposed to be the Arroyo Grande Redevelopment Project Area. This Preliminary Plan outlines the conditions deterring growth and preventing the City from achieving its full potential. It explores ways to protect and enhance the environment and focuses on the means to redevelop stagnating and blighted areas in such a way as to stimulate and attract private investment, thereby improving the City's overall economic health, employment opportunities and revenue producing activities. The Preliminary Plan is an initial framework document which will be adjusted during the review and adoption process of the final Redevelopment Plan. More detailed and specific studies are to be initiated which wiil target more specific problems, programs and actions necassary to effectuate the achievement of public policy affecting the Redevelopment Plan. A"Project Area" is defined by the California Community Redevelopment Law (Health and Safety Code Sections 33000 et.seq.) as a predominantly urbanized area of a community which is a blighted area, the redevelopment of which is necessary to effectuate the public purposes declared in this part, and which is selected by the Planning Commission in conjunction with the Redevelopment Agency. II. . DESCRIPTfON OF THE BOUNDARIES OF THE PROPOSED PROJECT AREA The boundaries of the proposed Project Area are illustrated on the map accompanying this report, labeled as Appendix "A". The legal Description of the proposed Project Area is attached hereto, labeled as Appendix "B". III. GENERAL STATEMENT OF PROPOSED LAND USES As a basis for the redevelopment of the proposed Project Area, it is recommended that development and redevelopment be in conformance with the adopted General Plan of the City of Arroyo Grande, as it presently exists and as amended from time to time, the City of Arroyo Grande Zoning Ordinance, as it presently exists and as amended from time to time, and all other applicable state and local building codes and guidelines and be subject to all review and procedural requirements in effect as development and redevelopment take place within the boundaries of the proposed Project Area. It is proposed that the following uses be permitted: A. Residential - Single Family - B. Residential - Condominium/Townhouse O1.AG.09/24/96 - PRELIM C. Residential - Apartments D. Residential - Senior Housing E. . Residential - Planned Development/Specific Plan F. General Commercial G. Village Commercial H. Office Professional I. Light Manufacturing J. General Agriculture K. Public and Quasi-Public IV. GENERAL STATEMENT OF PROPOSED LAYOUT OF PRINCIPAL STREETS As a basis for the redevelopment of the proposed Projeci Area, it is proposed that, in general, the layout of principal streets and those that will be developed in the proposed Project Area be as shown in the existing City of Arroyo Grande General Plan Circulation Element, as it presently exists and as amended from time to time, and as permitted by future actions of legally authorized public entities. Existing streets within and/or directly adjacent to the proposed Project Area may be closed, widened or otherwise modified, and additional streets may be created as necessary for proper pedestrian and/or vehicular circufation. V. GENERAL STATEMENT OF PROPOSED POPULATION DENSITIES Within the confines of the General Plan Land Use designations, there will be a permitted range of development. Population densities will be in conformance with the General Plan of the City of Arroyo Grande, as amended from time to time.. VI. GENERAL STATEMENT OF THE PROPOSED BUILDING INTENSITIES As a basis for the redevelopment of the proposed Project Area it is proposed that, in general, the building intensity be conirolled by limits on: (1) the percentage of ground area covered by buildings (land coverage); (2) the building setbacks, parking, landscaping and open space requirements; (3) the location of the buildable sites on building sites; and (4) the heights of buildings. Land coverage and locations of buildable sites should be limited, as is feasible and appropriate, to provide adequate open space, landscaping, parking and a high level of livability. The limits on building intensity shall be established in accordance with restrictions defined in the existing Zoning Ordinance and General Plan of the City of Arroyo Grande and as these documents may be amended from time to time. VI1. GENERAL STATEMEiVT OF THE PROPdSED BUILDING STANDARDS It is proposed that, in general, the building standards should conform to the building requirements of all applicable State statutes and all applicable City codes and ordinances. V!�!. ATTAINMENT OF THE PURPOSES OF THE LAW Redevelopment of the proposed Project Area would alleviate social, economic, physical or visual problems that are preventing the fuil and beneficial use of public and private within the subject Area. The California Community Redevelopment Law characterizes these problems as blight (Health and Safety Code Section 33000 et.seq.). 07.AG.09/24/96 - PRELIM 2 California Community Redevelopment Law defines a"blighted area" as one which is characterized by one or more of those conditions set forth in Sections 33030 and 33031(a) and (b1, causing "a reduction of, or lack of, proper utilization of the area to such an extent that it constitutes a serious physical end economic burden on the community which cannot reasonably be expected to be reversed or alleviated by private enterprise or governmental action, or both, without redevelopment." The law establishes two broad categories for blight; one citing declining physical conditions as being conducive to health and safety problems, economic stagnation and land use incompatibility. The second describing a retarded economic condition resulting largely from impaired investments, lack of commercial facilities and pressing public safety and criminal activity issues. The legal definitions of biighting conditions, as described in the Health and Safety Code, are as follows: 33030. Bliqhted Areas. (a) It is found and declared that there exist in many communities blighted areas which constitute physical and economic liabilities, requiring redevelopment in the interest of the health, safety, and general welfare of the peop{e of these communities and of the state. (b) A blighted area is one that contains both of the following: (1 ? An area that is predominantly urbanized, as thatterm is defined in Section 33320.1, and is an area in which the combination of conditions set forth in Section 33031 is so prevalent and so substantial that it causes a reduction of, or lack of, proper utilization of the area to such an extent that it constitutes a serious physicai and economic burden on the community which cannot reasonably be expected to be reversed or alleviated by private enterprise or governmental action, or both, without redevelopment. (2) An area that is characterized by either of the following: (A) One or more conditions set forth in any paragraph of subdivision (a) of Section 33031 and one or more conditions set forth in any paragraph of subdivision (b) of Section 33031. (61 The condition described in paragraph (4) of subdivision (a) of Section 33031. (c) A blighted area also may be one that contains the conditions described in subdivision (bi and is, in addition, characterized by the existence of inadequate public improvements, parking facilities, or utilities. 33031. Further Characterization of Bliqhted Area• Candition of Buiidinqs. (a) This subdivision describes physical conditions that cause blight: (1) Buildings in which it is unsafe or unhealthy for persons to live or work. These conditions can be caused by serious building code violations, dilapidation or deterioration, defective design or physical construction, faulty or inadequate utilities, or other similar factors. _ Ot.AG.09/24/96 -PRELIM 3 (2) Factors that prevent or substantially hinder the economicaliy viable .use or capacity of buildings or lois. This condition can be caused by a substandard design, inadequate size given present standards and market conditions, lack of parking, or other similar faciors. (3) Adjacent or nearby uses that are incompatible with each other and which prevent the economic development of those parcels or other portions of the project area. _ (4) The existence of subdivided lots of irregular form and shape and inadequate size for proper usefulness and development that are in multiple ownership. (b) This subdivision describes economic conditions that cause blight: (1} Depreciated or stagnant property values or impaired investments, including, but not necessarily limited to, those properties containing hazardous wastes that require the use of agency authority as specified in Article 12.5 (commending with Section 334591. (2) Abnormally high business vacancies, abnormally low lease rates, high turriover rates, abandoned buildings, or excessive vacant lots within an area deveioped for urban use and served by utilities. (3) A lacic of necessary commercial facilities that are normally found in neighborhoods, incfuding grocery stores, drug stores, and banks and other lending institutions. (4► Residential overcrowding or an excess of bars, liquor stores, or other businesses that cater exclusively to aduits, that has fed to problems of public safety and welfare. (5} A high crime rate that constitutes a serious threat to the public safety and welfare. Conditions within the proposed Project Area have coniributed to the physical decline of structures and infrastructure, a lacfc of proper utilization of the Area, a decline in the economic viability of the Area, impaired investments, and economic maladjustment. Economic blight causes the attrition of sales. property and business tax revenues which leads to a deteriorated physical environment, which in turn is caused by inadequate funds to provide the basic public improvements necessary for the public's health, safety and welfare. Based upon initial field surveys and discussions with City officials, the proposed Projeci Area exhibits many of the characteristics of blighi as defined in Sections 33030 and 33031 of the California Community Redevelopment Law including, but not limited to, the following conditions: 1. 2. 3 Poo�iy maintained buildings; Pooriy maintained vacant and underutilized parcels; Deteriorating structures and support facilities; � Ot .AG.09/24/96 - PRELIM 4 4. 5. 6. 7. 8. 9. 10. 11. 12. The prevalence of depreciated values and impaired investmenis; Reduced employment opportunities; Underutilized parcels; Mixed and incompatible land uses; Rights-of-way lacking landscaping, street lighting; Public improvements in need of repair; Substantial parcel access problems; • Parcels exhibiting shape and sizes that are not conducive to economic developmeni; and Other factors that substantially hinder the economically viable use or capacity of buildings or lots, including, but not limited to, substantial circulation deficiencies. These conditions cannot be reversed or alleviated by private enterprise acting alone. In some portions of the proposed Project Area private enterprise has attempted to remedy inadequate parcel configuration and access problems through subdivision activities without being able to remedy major development constraints incfuding vehicular circuiation deficiencies. Existing development constraints continue to negatively impact the economic development potential of these and other areas within the proposed Project Area. Benefits will occur to the present and future inhabitants and property owners within the proposed Project Area as well as to the residents and taxpayers of the City at large if the proposed Project Area is redeveloped. Redevelopmeni of the proposed Projeci Area would be at[ained through the following: 1. The comprehensive planning, redesign, replanning, development, reconstruction or rehabilitation of the Area which would facilitate a higher and better utilization of the lands within the proposed Project Area, thereby contributing to the public health, safety and welfare; 2 3 Stimuiating construction activity and increasing employment in the commercial and industrial segments of the community; Assisting in the financing, realignment, reconstruction and/or construction of curbs, gutters, . sidewalks, streets, drainage and other necessary public facilities; 4. Providing assistance to fund housing rehabilitation, new construction and other housing programs as necessary to ensure adequate housing oppor[unities for all economic segments of the City's population. 5. The attraction of residential, commercial and industrial uses to declining unproductive areas including the recycling of land uses and aggregation or subdivision of parcels into viable and productive parcels consistent with 01.AG.09/24l96 - PREUM 5 General Plan uses; and 6. Assisting in the development of residential, commercial and industrial construction by financing such devefopment in the proposed Project Area in such a way which will make ihe development economically feasible. IX. CONFORMANCE TO THE GENERAL PLAN OF THE C1TY The Plan will conform to the City of Arroyo Grande's General Plan. The Plan proposes the same pattern of land uses and includes all streets and public facilities indicated by the General Plan as the General Plan presently exists and as it may be amended from time to time. X. GENERAL 1MPACT OF THE PROPOSED REDEVELOPMENT PROJECT UPON THE RESIDEIVTS AND THE SURROUNDING NEIGHBORHOODS Impacts of the proposed Plan upon residents of the proposed Project Area and surrounding neighborhoods will, in general, be minimal. There may be impacts upon residents using the circulation system within the proposed Project Area due to the pubiic works improvements which can reasonably be expected to occur in the future. The impacts upon proposed Project Area residents and the surrounding neighborhoods will, in general, be positive and revolve around improvements to public facilities and services, parking, environmental quality, employment opportunities, economic developmen; and housing. The Agency will devote resources to increase the supply of affordable housing opportunities for both ownership and rental units in the Project Area and City-wide as appropriate. It is anticipated that direct Agency activity will occur only when sufficient financial resources are available and such action will produce effective and immediate redevelopment results. Thus, the proposed Plan is intended to be phased with a limited scope of direct activity at any given time. This subject will be discussed in depth by the Redevelopment Agency in the Report to Council and Environmental Impact Report which will accompany the Plan prepared for the proposed Project Area. XI. CONCLUSION This Preliminary Plan, as the initial document produced in the Plan adoption process, conforms to the requirements of the California Community Redevelopment Law. The Preliminary P1an is generalized and nonspecific in detail in its parts, evidencing its purpose as a preliminary directional guideline documeni. The adopted Preliminary Plan provides the Arroyo Grande Redeveiopment Agency with the opportunity to work with the Arroyo Grande Planning Commission in determining Project Area boundaries.
