A RESOLUTION OF THE PLANNING COMIVIISSION OF THE CITY OF
ARROYO GRANDE PROVIDING AN INTERPRETATION AS TO THE
LOCATION OF A DISTRICT BOUNDARY FOR PROPERTY LOCATED
ON TFIE SOUTHEAST CORNER OF EAST CHERRY AVENUE AND
TRAFFIC WAY
WHEREAS, the General Plan was adopted by the City Council on May 22, 1990 and
became effective on June 21, 1990; and
WHEREAS, the Development Code was adopted by the City Council on May I4, 1991,
and became effective on June 13, 1991; and
WHEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning
Commission with the authority to clarify ambiguities with respect to district boundaries as set
forth in the Development Code; and
WHEREAS, the Planning Commission has been requested to make a formal
interpretation as to the location of the eastern boundary of the Highway Commercial Zoning
District and the General Commercial General Plan Designation bisecting property located on the
southeast corner of East Cherry Avenue and Traffic Way (APN 007-621-23, 007-621-52 & 007-
621-53); and
WHEREAS, the Planning Commission, after due research and deliberation finds that:
1. During the adoption of the General Plan, all correspondence referencing the subject
property referred to the existence of approximately three (3) acres of commercially zoned
property and approximately twelve (12) acres of agriculturally zoned property; and
2. The City Council's intent in establishing the General Plan land use and Zoning district
boundaries was to maintain consistency in the location of different land uses; and
3. A clerical error was made in establishing the location of the district boundary separadng
the Highway Commercial Zoning DistricVGeneral Commercial Lane Use Designation
from the General Agriculture Zoning District/Land Use Designation for property located
on the southeast corner of East Cherry Avenue and Traffic Way.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Anoyo Grande hereby makes the interpretation that said district boundary is located further
east, in a location that lines up with the General Commercial Zoning District/General Plan Land
Use boundary to the north and the Mobile Home Park Zoning District/General Plan Land Use
boundary to the south, as shown on attached Exhibits A& B.
On motion by Commissioner Keen, seconded by Commissioner Titus, and by the
following roll call vote to wit:
AYFS: Commissioners Keen, Titus and Tappan
NOES: Commissioner Deviny .
ABSENT: Commissioner Lubin
