PC R 96-1579RESOLUTION NO. 96-1579 A RESOLUTION OF THE PLANNING COMNIISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTFR�'RETATION REGARDING FLOOR AREA RATIO (FAR) STANDARDS WHEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on 7une 13, 1991; and WfIEREAS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities; and WHEREAS, footnote (d) at the bottom of Development Code Table 9-06.050-B establishes floor area ratio (FAR) standards for all residential zoning districts and states the FAR shall be adhered to in a residential zoning district in addition to lot coverage requirements; and WHEREAS, footnote (*) at the bottom of Development Code Table 9-06.050-B states if a lot was created before June 13, 1991, buildings may conform with the setback and lot coverage standards of the previous zone, as outlined in Appendix C.W.D.2.19 of the Development Code; and WHEREAS, the Planning Commission has been requested to make a formal interpretation as to the applicability of said footnote (d) to lots which utilize the setbacks and lot coverage standards of the previous zone as established in footnote (*). NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby makes the interpretation that footnote (d) at the bottom of Table 9- 06.050-B of the Development Code applies to all residential lots inespective of whether the setbacks and lot coverage standards for the previous zone or present zone are applied.
