PC R 96-1574RESOLUTION NO. �6-1574 A R�SOLUTION OF THC PLANNING COMMISSION OF TH� CITY OF ARROYO GRANDE I'ROVIDING AN INT�RPIt�TATION TI-IAT TI-I� MAXIMUM RETAINING WALL/r�NCG IIEIGIIT ALLOW�D PURSUANT TO CONllI'I'IONAL USE PrRMIT CAS� NO. 94-528 AND LOT LIN� AllJUSTM�NT CAS� N�. 94-521 IS AS SHOWN ON THE CONSTRUCTION DRAWINGS FOR TI�E PItOJFCT, BUT IN NO CASE SI-IALL rXC��ll TWELV� F�CT, TOUR INCH�S (12'-4") WHER�AS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and WHEREAS, Section 9-01.110 (G)(3) of the Developmec�t Code provides the Planning Commission witl� tlie authority to clarify ambiguities; and WHCR�AS, on February 7, 1995, tl�e Planning Comrnission approved Conditional Use Permit (CUP) Case No. 94-528 and Lot Line Adjustment (LLA) Case No. 94-521 for a 37 unit planned unit development at 1131 Farroll Avenue in the MF zone; and WH�REAS, an ambiguity has arisen regarding the maximum retaining wall/fence heiglit allowed pursua�lt to said approvals; and 1. 2. WI�EREAS, the Planning Commission, after due research and deliberation finds that: Plans submitted for said Conditional Use Permit and Lot Line Adjustment depicled retaining walls and fences, al times in the same location, albeit on different sets of plans; and Where depicted in lhe same location, the maximum height of the combined retaining wall/fence is reflected in Exhibit "A" attached. NOW, TIiI:RLrORE, I3E IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby makes the interpretation that pursuant to CUP 94-528 and LLA 94- 521, the maximum heigl�t for a retaining wall/fence is as shown on tl�e construction drawings for tl�e project, but in no case shall exceed twelve feet, four inches (12'-4"). On motion of Commissioner Keen, seconded by Commissioner Lubin, and by tlle following roll call vote, to wit: AY�S: Commissioners Keen, Lubin, Deviny, Titus and Tappan NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 16th day of July, 1996.
