PC R 96-1571RCSOLUTION NO. 96-1571 A RESOLUTION OI+ THE PLANNING COMMISS�ON OF THE CITY OT ARROYO GRANDE R�COMM�NDING '1HAT TI3� CITY COUNCIL CERTIFY THAT T�IE ENVIRONMENTAL IMPACT REPORT FOR THE RANCHO GRANDE SUBDIVISION AND THE ADDEI�IDUM FOR AN AMENDMENT TO VESTING T�NTATIVE TRACI' MAP NO. 1997 AND SPECIFIC DEVELOPMENT PLAN NO. 90-04 HAS BECN 1'1t�PAItED Ilv COMPLIANCE WITH TI CALITORNIA �NVIRONM�NTAL QUALITY ACT WI tlie Cily of Arroyo Grande t�as received applications from Ottse, Inc. to amend Amended Vesting Tentative Tract Map No. 1997 and Specific Development Plan No. 90- 04; and WH�R�AS, an Addendum to tl�e Rancl�o Grande Subdivision EIR was prepared to update information abotit potential traffic impacts from payment of a revised traffic impact fee and purstiant to the California Environmental Quality Act (CEQA), and State CEQA Guidelines, and the City's Rules and Yroceclures for Implementation of CEQA; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the draft Addendum Environmental Impact Report (AEIR) for tl�e amendment to Vesting Tentative Tract Map No. 1997 and Specific Development Plan No. 90-04; and WHEREAS, a duly noticed public liearing was held by the Planning Commission of the City of Arroyo Grande, on July 16, 1996, at which time all interested persons were given the opportunity to be heard; and WII�1t�A5, said draft ALIR meets tl�e requirements of state and local environmental laws, addresses tl�e concerns raised during the review period and at public hearings,adequately addresses the potentially significant environmental impacts, and recommends suitable mitigation measures for said impacts; and WHER�AS, the Planning Commission makes tlle following findings of fact: 1. Based on the information set forth in the EIR, Addendum, and in the Statement of Significant Environmental Effects and Mitigation Measures, attaclled to the Resolution for approval as Attacl�ment "A" and incorporatecl herein by refere�lce, the Planning Commission determines that changes or alterations have been required in, or incorporated into, the project wliicl� avoid or substantially lessen tlie adverse environmental effects identified in the EIR for traffic and circulation. 2. No additional adverse impacts will liave a significant effect or result in a sub'stantial or potentially substantially adverse change in the environment as a result of tlie proposed amendment. 3. All significant environmental effects identi�ied in tl�e EIR and Addendum llave been reduced to an acceptable level in tl�at all significant environmental effects that can be feasibly avoided have been eliminated or substa►itially lesse�ied as determined througli tlie findings set forth in paragraphs (1) and (2) above. ATTE.ST: - • � , � L- c le Breese, ommission Clerk William � appa , Chairperson AS TO CONTFNT: Ol.asLY ' � Doreen Litierto-Blanck, Community Development llirector ATTACHMENT "A" STA'I'�M�NT Or �NVIRONM�NTAL �FFECTS AND MITIGATION MCASURLS BACKGROUND The California Environmental Quality Act (CEQA) and the State CEQA Guidelines prornulgated pursuant thereto provide: "No public agency shall approve or carry out a project for which an Environmental Impact Report has been completed and which identifies one or more significant environmental eEfects of the project unless the public agency makes one or more wrilten findings for each of those significant effects, accompanied by a brief explanalion of tlie rationale for eacll finding." Tl�e City Council of ttie City of Arroyo Grande (tl�e "City") proposes to approve an amendment to Vesting Tentative Tract Map No. 1997 and Specific Development Pla�i 90-04. Because the proposed action constitutes an action under CEQA and the CEQA Guidelines, the City has prepared an addendum to the Environmental Impact Report (EIR) for the Rancho Grande Subdivision. The Addendtim EIR (AEIR) identified certain significant effects that may occur as a result of this project. Further, the City has determined that the AEIR is complete and has been prepared in compliance with CEQA, the State CEQA Guidelines and the "City of Arroyo Grande Rules and Procedures for tl�e Implementation of the California Environmental Quality Act. " ErF�CTS AND MITIGATION MEASUR�S TRAFPIC AND CIRCULATION Effec : The proposed project will have ciimulative impacts on certain already impacted intersections and roadway segments. Miti ag t, ion: The Following miligation measure is recommended in the AEIR: 1. Prior to recordatioc� of the final map, tlie developer shall enter into an agreement with the City, in a form approved by the City Attorney, whereby, the developer agrees, on bel�alf of llimself and his successors in interest, to pay the City a fee of One Thousand, Sixty Nine Dollars and Twenty Two Cents ($1069.22) per residential unit, to be paid for eacl� residential unit prior to issuance of building permits or witliin five (5) years of recordation of tlle parcel map, wllichever comes first. Findin�: Changes or alterations l�ave been required in, or incorporated into the project wtiich avoid or substantially lessen the environmental effect as identified in the A�IR. �e Statetne�tt of Facts: In 1989, tl�e City of Arroyo Grande adopted a program of mitigating cumulative traffic impacts on several specified street segments and intersections. This involved payment of a fee of $2656 per peak I�our trip that would impact the specified street segments or intersections. In 1994 the City Co�mcil adopted Ordinance 461 C.S. and Resolution 3021 tl�at eliminated the 1989 policy and implemenled a neVV fee of $53.82 per Average Daily Trip (ADT). Tl�e new fee was based on additional studies and a revised metliodology for calculation of tlie fees. As a result of the enactment of the ordinance and resolution, fees for residential development decreased significantly. The new fee program requires a traffic impact fee of $538.22 per residential lot. Environmental impacts remain as identified in the EIR for the Rancho Grande Subdivision. Recommended mitigation measures include payment of the new traffic mitigation fee ($538.22 per unit) and payment of a fee for mitigation of cumulative impacts at the Noyes Road/�q�iestrian Way and Highway 22'�/Noyes Road intersections ($531.00). Tl�is results in a new traffic impact fee totaling $1069.22 per residential uilit. Based upon tl�e implementation of the proposed mitigation rneasures, all impacts can be mitigated. -2-
