PC R 96-1564RLSULU'1'IOIV `NO. 9G-1564 A R�SOLUTION Or TI-I� PLANNING COMMISSION OF THC CITY OF ARROYO GRAIVDE APPROVING PLANN�D SIGN PROGRAM CA5� NO. 96-120, APPLI�D TOR BY MICI-IAEL G TI-IOMAS, AT 122 LE FOINT STREET WIIEREAS, the Planning Commission of tl�e City of Arroyo Grande has considered an application by Michael C, Thomas, for a Planned Sign Program at 122 Le Point Street in the Village Commercial, VC Zone; and ` WH�R�AS, the Planning Commission has found that this planned sign program is consistent witl� tlle General Plan and tl�e Environmental Documents associated therewitll; and WIi�R�AS, the Planning Commission has reviewed this project in compliance with the California Environmenlal Quality Act (CEQA); and WH�REAS, lhe Planning Commission finds, after due study, deliberation and public l�earing, tl�e following circumstances exist: 2. 3. Tlie proposed signs are consistent witil the goals, objectives, policies and progratns of the Arroyo Grande General Plan. The goals of tiie General Plan are to encourage economic vitality and business activity, protect investments while preserving tfie environment and character of the City. Said signs are important to the success of this businesses and are not out of scale or character witl� otlier signs in tl�is zone and vicinity. Tlie proposed signs conform to applicable development standards and provisions of the Development Code and will not be detrimental to the public health, safety or welfare. The physical locatio►1 or placement of tt�e signs are compatible with tl�e surrounding neighborl�ood and do not pose a safety risk. NOW, TIII+�ItErOR�, BE IT RI:SOLV�D tl�at tl�e Planning Commission of ttie City of Arroyo Grande hereby adopts a l�egative declaration, instructs tlie Secretary to file a Notice of Determination and approves said Planned Sign Program, with the above findings and subject to the conditions as set forth in Attaci�ment "A", attaclied hereto and incorporated herein by this reference. TfIOIbIAS 122 LePoint Street GENERAL CONDITIQNS COMMUNITY DEVELOPMENT DEPARTMENT This approval authorizes eonstruction and placement of one (1) monument sign, one (1) directory sign, and five (5) tenant signs as depacted on Amended Exhibit "B". The monument sign shall be placed as shown on Ex�iibit "A". Tlie tenant signs sl�all be placec� on the doors of the office ur�its and the directory sign shall be placed on the east facing wall of the building as shown on Amended Exhibit "B". 1. The applicant shall ascertain and comply with all Federal, State, County and City requirements as are applicable to tl�is project. 2. Tl�e applicant sl�all comply witl� all conditions of approval for Conditional Use Permit Case No. 96-544. 3. This application shall automatically expire on June 20, 1998 unless a building permit is issued. Tllirty (30) days prior to tl�e expiration of the approval, tl�e applicant may apply for an extension of one (�) year from the vriginal date of expiratton. 4. Development s}�all occur in substantial conformance with tl�e plans presented to the Planning Commission at the meeting of Jw�e 20, 1996 and marked Amended Exhibit �� 5. The applicant shall agree to defend at I�is/l�er sole expense any action broug}�t against tlie City, its present or former agents, officers, or e►nployees because of t}te issuance of said approv�l, or in anyway relating !o tl�e implementation thereof, or in the �'Iternative, to relinqUish sucli approvat. Tlie applicant sliall reimburse the City, its agents, officers, or employe+es, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own exgense in the defense of any such action but sucl� participatio�l sl�all not relieve applicant of his/her obligations under this condition. DEVELOPMENT Cd1�E 6. Development s}�all conform witl� the Village Comme�cial zoning requirements except as otherwise approved. 7. Prio�• to issuance of a cert.ific�te of occupancy, all ligl�ts for the signs, shall be screened from public view with materials architecturally compatibl� with the main structure. 1
