PC R 96-1559RESOLUTION NO. 96-1559 A RTSOLUTION OP' TIiE PLANNING COMMISSION OF THE CITY OT ARROYO GRAND� RE-�VALUATING THE INT�RPRETATION �STABLISI-IED BY PLANNING COMMISSION RESOLUTION NO. 95-1524 WHER�AS, tl�e Development Code was adopted by the City Council on May 14, 1991, and became effective on June 3, 1991; and WI�EREAS, Section 9-01-110(G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities in the Title; and WkI�REAS, tl�e sign oi•di»ai�ce was not changed by adoption of the Development Code; and WI Seclio�� 9-�3.050 of the Developu�ent Code proliibits the use of certain types of signs; and WII�R�AS, Sectio�� 9-13.040 of the Development Code, "Sign Exceptions to Permit Requirements", allows certain temporary signs prohibited on a permanent basis per Section 9- 13.050; and WIiERrAS, the Planning Com►nissioii resolved the discrepancy between Sectio�is 9- 13.040 and 9-13.050 by adopti►�g Resolution No. 95-1524; and WHEREAS, Resolution No. 95-1524 states that: 1. Certain prohibited signs idenlified in Section 9-13.050 may be permitted on a temporary basis if they meet the criteria uncier Section 9-13.040, as follows: A. Speci�l �vent Displ�y 1) Banners, flags and pennants,are permitted for 30 days prior to an event and seven (7) days after; � 2) Gas and liot air balloons are permitted for a three (3) day period, not to exceed four times a year, unless approved by the Planning Director; and WI the Planning Commission has received a request to re-evaluate the interpretation established by Resolution No. 95-1524; and WHrREAS, the Planning Commission after due research and deliberation finds that: l. Gas and hot air balloons may be considered temporary signs provided they do not exceed a three (3) day period for a maximum of twelve (12) weekends a year, unless approved by the Community Development Director for special events; 2. The Development Code does not specify a time limit for d1e display of gas and liot air balloons as temporary signs; and d: /reao/signa-96. rw.mel Resolution No. 96-1559 May 21, 199G Page 2 3. The display of gas and hot air balloons for a three (3) day period not to exceed twelve (12)_ weekends a year is no more objectionable than the display of similar temporary signs permitted for 30 days prior to an event and seven (7) days after. NOW, THERL'FUR�, I3E IT RL+'SOLVED that the Planning Commission of the City of Arroyo Grande hereby makes the interpretation that gas and liot air balloons are permitted for a tliree (3) day period, not to exceed twelve (12) weekends a year, unless approved by tlie Community Development Director for special events.
