PC R 96-1548RESOLUTION NO. 96-1548 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMIVIENDING THAT THE CITY COUNCIL C�RTIFY THAT THE ENVIItONMENTAL IMPACT REPORT FOR THE RANCHO GRANDE SUBDIVISION AND THE ADDENDUM FOR AN AMENDMENT TO VESTING TENTATIVE TRACT MAP NO. 1834 AND SPECIFIC DEVELOPMENT PLAN NO. 90-01 HAS BEEN PREPARED IN COMPLIANCE WITH THE CALITORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the City of Arroyo Grande has received applications from Ottse, Inc. to amend Amended Vesting Tentative Tract Map No. 1834 and Specific Development Plan No. 90- O1; and WIiEREAS, an Addendum to the Rancho Grande Subdivision EIR was prepared to update information about potential traffic impacts from payment of a revised traffic impact fee and pursuant to the California Environmental Quality Act (CEQA), and State CEQA Guidelines, and the City's Rules and Procedures for Implementation of CEQA; and WHEREAS, the Planning Commission of the City of Arroyo Grande has reviewed the draft Addendum Environmental Impact Report (AEIR) for the amendment to Vesting Tentative Tract Map No. 1834 and Specific Development Plan No. 90-01; and WHEREAS, a duly noticed public hearing was held by the Planning Commission of the City of Arroyo Grande, on February 20, 1996, at wliich time all interested persons were given the opportunity to be heard; and WHEREAS, said draft AEIR meets the requirements of state and local environmental laws, addresses the concerns raised during the review period and at public hearings,adequately addresses the potentially significant environmental impacts, and recommends suitable mitigation measures for said impacts; and WHEREAS, tl�e Planning Commission makes tl�e following findings of fact: 1. Based on the information set forth in the EIR, Addendum, and in the Statement of Significant Environmental Effects and Mitigation Measures, attached to the Resolution for approval as Attachment "A" and incorporated herein be reference, the Planning Commission determines that changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the adverse environmental effects identified in tlie EIR for traffic and circulation. 2. No additional adverse impacts will have a significant effect or result in a substantial or potentially substantially adverse cl�ange in the environment as a result of the proposed amendment. 3. All significant environmental effects identified in the EIR and Addendum have been reduced to an acceptable level in that all significant environmental effects that can be feasibly avoided have been eliminated or substantially lessened as determined through the findings set forth in paragraphs (1) and (2) above. NOW, THEREFORE, B� IT RESOLVED that the Planning Cornmission of the City of Arroyo Grande hereby recommends that tl�e City Council certify that the Environmental Impact Report for Rancho Grande Subdivision with the addendum for the amendment to Vesting Tentative Tract Map No. 1834 and Specific Development Plan No. 90-01 has been prepared and completed in compliance with CEQA, the State CEQA Guidelines, and the City's Rules and Procedures. On motion by Commissioner Soto, seconded by Commissioner Beck, and by the following roll call vote, to wit: AYES: Commissioners Soto, Beck, Deviny, Tappan and Keen NOES: None ABSENT: Commissioners Carr and Lubin the foregoing Resolution was adopted tl�is 20th day of February, 1996.
