THE CITY OF ARROYO GRANDE ADOPTING A
NEGATIVE DECLARATION WITH MITIGATION
MEASURES; INSTRUCTING THE SECRETARY TO FILE A
NOTICE OF DET�RMINATION; AND APPROVING
AMENDED CONDITIONAL USE PERMIT CASE NO. 95-536,
AND ASSOCI�TED ARCIiITECTURAL REVIEW FOR
REVISIONS TO 'I'HE LOCATION AND HOUSING OF A
STAND-BY GENERATOR, APPLIED FOR BY DR.
MICHAEL LIMI3ERG, AT 303 SOUTH HALCYON ROAD
WHEREAS, on July 20, 1993 the Planning Commission of the City of Arroyo Grande
approved Conditional Use Permit Case No. 95-536, filed by Dr. Michael Limberg, to construct
a 3385 square foot out-patient surgical center, in the Office Professional Zone, subject to 39
conditions of approval; and
WHEREAS, the applicant has applied for an amendment to said conditional use permit
and architectural review for revisions to the location and housing of the project's stand-by
generator; and
WHEREAS, the Planning Commission has held a public hearing on this application in
accordance with the City Code; and
WHEREAS, the Planning Commission has found that this amended project is consistent
with the General Plan and the Environmental documents associated therewith; and
WHFREAS, the Planning Commission has reviewed this amended project in compliance
with the CaliFornia Environmental Quality Act (CEQA); and
WI-IEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances exist:
Conditional Use Permit Tindings:
1. The proposed use is permitted within the subject district pursuant to the provisions of
Section 9-03.050 of the Development Code, and complies with all applicable provisions
of the Development Code, the goals and objectives of the Arroyo Grande General Plan,
and the development policies and standards of the City. The generator housing will
provide noise attenuation consistent with the Noise Element of the General Plan.
2. The proposed use will not impair tlie integrity and character of the district in which it is
to be established or located. The generator will be screened from public view.
3. The site is suitable for the type and intensity of use or development that is proposed.
4. There are adequate provisions for water, sanitation, and public utilities and services to
ensure the public }�ealth and safety.

5. The proposed use will not be detrimental to the gublic health, safety, or welfare, or
materially injurious to properties and improvements in the vicinity.
Architectural Review Findings
1. The proposal is consistent with the "General Arehitectural Review Guidelines" for the
City of Arroyo Grande.
2. The proposal is consistent with the text and maps of the Arroyo Grande General Plan,
and the City of Arroyo Grande Development Code.
3. The proposal will not be detrimental to the health, safety, comfort and general welfare
of the persons living or working in the neighborhood of the proposed project.
4. The general appearance of the proposal is in keeping with the character of the
neighborhood.
5. The proposal is not detrimental to the orderly and harmonious development of the City.
6. The proposal will not impair the desirability of investment or occupafion in the
neighborhood.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City
of Arroyo Grande hereby adopts a negative declaration with mitigation measures, instructs the
Secretary to file a Notice of Determination, and approves said revised conditional use permit and
associated architectural review with the following conditions of approval: �
GENERAL CONDITIONS:
l. The applicant shall comply with all conditions of approval of Canditional Use Permit
Case No. 95-536.
2. The location and size of the enclosure shall be as shown on Exhibit "A", attached hereto
and incorporated herein by reference.
MITIGATION MEASURE: �
3. Noise treatment for the generator shall be as shown on Exhibit "B", attached hereto and
incorporated herein by reference. Overall noise level at 40 feet from the unit shall not
exceed 50 dB.
Time Frame: Prior to installation of the generator plans shall be submitted
to the Building and Fire Department reflecting this mitigation.
