Page 4 of 97 11.OLD BUSINESS None. 12.NEW BUSINESS 12.a Consideration of Selection of Council Member Barneich as Mayor Pro Tem (MATSON) Recommended Action: Appoint Council Member Barneich as the Mayor Pro Tem for the next one-year period, pursuant to Council policy. 12.b Discussion and Consideration of Appointment of Council Members to Regional and Local Boards and Committees (MATSON) Recommended Action: 1) Make appointments for the next two-year period to the regional and local boards and committees with Council representation; and 2) Direct the City Clerk to update Fair Political Practices Commission (FPPC) Form 806 (Agency Report of Public Official Appointments) for posting on the City website. 13.COUNCIL COMMUNICATIONS Any Council Member may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council policies and procedures, Council Members may request staff to report back to the Council at a subsequent meeting concerning any matter or request that staff place a matter of business on a future agenda. MEMORANDUM TO: City Council FROM: Jessica Matson, Legislative & Information Services Director/City Clerk SUBJECT: Declaration of Results of the November 8, 2022 Consolidated General Municipal Election DATE: December 13, 2022 SUMMARY OF ACTION: Adoption of a Resolution declaring official results of the City’s General Municipal Election. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There is no fiscal impact associated with the recommended action. An invoice for the costs to conduct the election has not yet been received from the County of San Luis Obispo; however, anticipated expenses estimated at $30,000 have been included in the FY 2022-23 Legislative and Information Services Department Budget. RECOMMENDATION: Adopt a Resolution declaring the official results of the General Municipal Election held on November 8, 2022, and the final Certificates of the Canvass. BACKGROUND: On November 8, 2022, a General Municipal Election was held in the City for the purpose of electing a Mayor, one (1) District 1 City Council member, and one (1) District 4 City Council member, and voting on one (1) ballot measure ("Measure D-22") asking voters if the City shall be authorized to increase the Transaction and Use (“Sales Tax”) by 1% to fund maintenance and repair of streets, sidewalks, stormwater and drainage facilities, and for other City programs and facilities. This was the City’s first by-district election. In accordance with City Council Resolutions Nos. 5187 and 5188, the City’s election was consolidated with the Statewide General Election that was conducted on the same day by the County of San Luis Obispo. The County Clerk-Recorder was responsible for canvassing all votes cast and certifying the election results. Page 6 of 97 Item 6.d. City Council Declaration of Results of the November 8, 2022 Consolidated General Municipal Election December 13, 2022 Page 2 ANALYSIS OF ISSUES: Total voter registration for the City of Arroyo Grande was 13,196. The number of total ballots cast was 9,170 resulting in a 69.49% voter turnout. Results of the election are as follows: Mayor (Vote for 1): Caren Ray Russom received 5,241 votes (62.40%) Gaea Powell received 2,308 votes (27.48%) Dale T. Hanson received 850 votes (10.12%) Based on these results, Caren Ray Russom received the highest number of votes and is the candidate elected to the office of Mayor. City Council District 1 (Vote for 1): Kathleen Secrest received 1,728 votes (100%) Kathleen Secrest ran unopposed and is the candidate elected as District 1 Member of the City Council. City Council District 4 (Vote for 1): James Robert Guthrie received 991 votes (63.20%) Ben Franco received 577 votes (36.80%) Based on these results, James Robert Guthrie received the highest number of votes from voters in District 4 and is the candidate elected as District 4 Member of the City Council. Measure: Measure D-22 did not pass. 45.64% of the votes were a “Yes” vote, which did not meet the majority voter approval required to authorize the City to increase the Transaction and Use Tax (“Sales Tax”) by 1% to fund maintenance and repair of streets, sidewalks, stormwater and drainage facilities, and for other City programs and facilities. The County Clerk-Recorder has conducted the official canvass of the returns of the votes cast in the election and has certified the results. In accordance with California Elections Code Section 10262, the City Council is requested to adopt a Resolution declaring the results of the General Municipal Election and the final Certificates of the Canvass . As of the date and time of this report, the Election has been certified by the County Clerk - Recorder, however, the City Clerk has not received the Certificates of Canvass. Once received, they will be added to Exhibit A of Attachment 1. Page 7 of 97 Item 6.d. Adopt the Resolution; or 2. Provide other direction to staff. ADVANTAGES: Adoption of the Resolution will ensure the City complies with State law as it relates to the declaration and acceptance of the election results. DISADVANTAGES: No disadvantages have been identified at this time. ENVIRONMENTAL REVIEW: No environmental review is required for this item. PUBLIC NOTIFICATION AND COMMENTS: The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2. Attachments: 1. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held in the City of Arroyo Grande, California, on Tuesday, November 8, 2022, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and ma nner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution Nos. 5187 and 5188, the San Luis Obispo County Clerk-Recorder canvassed the returns of the election and has certified the results, which are attached hereto and made a part herein as “Exhibit A”. NOW, THEREFORE BE IT RESOLVED, by the City Council of the City of Arroyo Grande, California, that: 1. All of the above recitals are true and correct and incorporated herein by reference. 2. The whole number of ballots cast in the city was 9,170. 3. The names of the persons voted for at the election for Mayor are as follows: Caren Ray Russom, Gaea Powell, and Dale T. Hanson. 4. The names of the persons voted for at the election for District 1 Member of the City Council are as follows: Kathleen Secrest. 5. The names of the persons voted for at the election for District 4 Member of the City Council are as follows: Ben Franco, and James Robert Guthrie. 6. The Measure voted upon at the election is as follows: Measure D-22: To provide funding for general governmental use in Arroyo Grande, including maintenance and repair of streets, sidewalks, stormwater and drainage facilities, and for other City programs and facilities, shall an ordinance establishing a one percent sales tax be adopted, providing approximately $5,600,000 annually until ended by the City Council and requiring annual reports on revenues and expenditures, and review and public hearing by the City Council every five years on its necessity? 7. The whole number of ballots cast and the number of ballots cast for the above- named offices are listed in “Exhibit A”, attached hereto and made a part hereof. 8. The City Council does declare and determine that as a result of the election: Page 9 of 97 RESOLUTION NO. PAGE 2  Caren Ray Russom was elected as Mayor for a full term of two (2) years;  Kathleen Secrest was elected as District 1 Member of the Council Member for a full term of four (4) years;  James Robert Guthrie was elected as District 4 Member of the City Council for a full term of four (4) years.  A majority of the voters voting on Measure D-22 relating to the City’s authority to increase the Transaction and Use Tax (“Sales Tax”) to fund maintenance and repair of streets, sidewalks, stormwater and drainage facilities, and for other City programs and facilities did not vote in favor of it, and that the measure was not carried, and shall not be deemed adopted or ratified. 9. The City Clerk shall enter into the records of the City of Arroyo Grande a statement of the results of the election, showing: (1) The total number of ballots cast in the City; (2) the names of the persons voted for; (3) for what office each person was voted for; and (4) the total number of votes given to each person, and for and against the measure. 10. The City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the Office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. 11. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There is a $983,835.20 fiscal impact that includes the following items:  Accounts Payable Checks $566,646.87  Payroll & Benefit Checks $417,188.33 RECOMMENDATION: Ratify the attached listing of cash disbursements for the period of November 1 through November 15, 2022. BACKGROUND: Cash disbursements are made weekly based on the submission of all requ ired documents supporting the invoices submitted for payment. Prior to payment, Administrative Services staff reviews all disbursement documents to ensure that they meet the approval requirements adopted in the Municipal Code and the City’s Purchasing Poli cies and Procedures Manual. ANALYSIS OF ISSUES: The attached listing represents the cash disbursements required of normal and usual operations during the period. The disbursements are accounted for in the FY 2022-23 budget. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There is no funding impact to the City related to these reports. However, the City does receive interest revenue based on the interest rate of the investments. No or minimal future staff time is projected. RECOMMENDATION: Receive and file the attached report listing investment deposits of the City of Arroyo Grande as of October 31, 2022, as required by Government Code Section 53646(b). BACKGROUND: The Administrative Services department has historically submitted to the City Council a monthly report, providing the following information: 1. Type of investment. 2. Financial institution (bank, savings and loan, broker, etc). 3. Date of maturity. 4. Principal amount. 5. Rate of interest. 6. Current market value for all securities having a maturity of more than 12 months. 7. Relationship of the monthly report to the annual statement of investment policy. Page 50 of 97 Item 9.b. City Council Consideration of Statement of Investment Deposits December 13, 2022 Page 2 ANALYSIS OF ISSUES: This report represents the City’s investments as of October 31, 2022. It includes all investments managed by the City, the investment institution, investment type, book value, maturity date, and rate of interest. As of October 31, 2022, the investment portfolio was in compliance with all State laws and the City’s investment policy. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Approve staff’s recommendation to receive and file the attached report listing the investment deposits; 2. Do not approve staff’s recommendation; or 3. Provide other direction to staff. ADVANTAGES: Safety of principal is the foremost objective of the City. Investments are undertaken in a manner that seeks to ensure the preservation of capital in the overall portfolio. DISADVANTAGES: Some level of risk is present in any investment transaction. Losses could be incurred due to market price changes, technical cash flow complications such as the need to withdraw a non-negotiable Time Certificate of Deposit early, or even the default of an issuer. To minimize such risks, diversifications of the investment portfolio by institution and by investment instruments are being used as much as is practical and prudent. ENVIRONMENTAL REVIEW: No environmental review is required for this item. Carmel, City Attorney SUBJECT: Consideration of Adoption of a Resolution Declaring a Continued Local Emergency Related to the COVID-19 Pandemic and Authorizing the Continuance of Remote Teleconference Meetings of the Legislative Bodies Pursuant to Government Code Section 54953(e)(3) DATE: December 13, 2022 SUMMARY OF ACTION: Adoption of the Resolution will continue the declared local emergency related to the COVID-19 pandemic and will also enable the City to continue to comply with the requirements of legislation, AB 361, to authorize the continued use of teleconferencing for meetings of the City’s legislative bodies. IMPACT ON FINANCIAL AND PERSONNEL RESOURCES: There are no direct fiscal impacts related to the proposed action; however, adoption of the Resolution will facilitate the ability for the City to request resources including financial support and reimbursement from the State Office of Emergency Services and the Federal Emergency Management Agency for costs incurred in preparation and/or response to the COVID-19 pandemic. RECOMMENDATION: Adopt a Resolution declaring a continued local emergency related to the Coronavirus (COVID-19) pandemic and authorizing the continuance of remote teleconference meetings pursuant to Government Code Section 54953(e)(3). BACKGROUND: As the City Council is aware, in accordance with Section 8.12.060 of the Arroyo Grande Municipal Code, the former City Manager, in his capacity as the Dire ctor of Emergency Services, proclaimed a local emergency on March 16, 2020, regarding the COVID -19 pandemic. The City Council ratified the proclamation at its regular meeting on March 24, 2020, and adopted resolutions declaring a continued local emergency since that time as the pandemic has persisted. Page 67 of 97 Item 9.d. City Council Consideration of Adoption of a Resolution Declaring a Continued Local Emergency Related to the COVID-19 Pandemic and Authorizing the Continuance of Remote Teleconference Meetings of the Legislative Bodies Pursuant to Government Code Section 54953(e)(3) December 13, 2022 Page 2 In addition, AB 361 amended Government Code Section 54953, adding a new subsection (e) that permits legislative bodies, when there is a proclaimed State of Emergency declared by the Governor pursuant to Government Code Section 8625, to make a determination to authorize meeting remotely via teleconferencing as a result of the emergency. To do so, a resolution would need to be adopted in which the legislative body finds that meeting in person would present imminent risks to the health or safety of attendees, or that State or local officials have imposed or recommended measures to promote social distancing. The City Council first adopted a Resolution making findings in accordance with AB 361 and Government Code Section 54953(e) at its September 28, 2021 meeting. The Resolution is valid for thirty (30) days after teleconferencing for the first time under the new regulations. If the State of Emergency remains active after that 30 day period, the local agency may act to renew its resolution authorizing remote teleconferenced meetings by passing another resolution which includes findings that the State of Emergency declaration remains active, the local agency has reconsidered the circumstances of the State of Emergency, and the local agency has either identified: A) ongoing, direct impacts to the ability to meet safely in-person, or B) active social distancing measures as directed by relevant State or local officials. In the past, the City has adopted separate resolutions related to the continuing emergency declaration and the continuance of remote teleconference meetings pursuant to Government Code Section 54953(e)(3). Staff has combined the two items into one resolution to eliminate the need for separate agenda items. ANALYSIS OF ISSUES: Arroyo Grande Municipal Code Section 8.12.065(C) provides that the City Council is to “Review the need for a continuing emergency declaration at regularly scheduled meetings at least every twenty-one (21) days until the emergency is terminated.” Accordingly, the City Council has adopted the appropriate Resolutions declaring a continued local emergency related to the COVID-19 pandemic within the required 21-day time period since the ratification of the proclamation at its March 24, 2020 meeting. This item is being presented to the City Council to satisfy the requirements of Section 8.12.065(C) given the ongoing State of Emergency proclaimed by the Governor, the ongoing public health orders issued by the State, and the ongoing work requi red of City staff to respond to the pandemic and these proclamations and orders. In addition, the Resolution will allow the City to continue conducting its public meetings via teleconference. The Resolution includes continued findings based upon a determin ation that, as a result of the proclaimed State of Emergency in California due to the COVID-19 pandemic and its continued spread in San Luis Obispo County and Arroyo Grande Page 68 of 97 Item 9.d. City Council Consideration of Adoption of a Resolution Declaring a Continued Local Emergency Related to the COVID-19 Pandemic and Authorizing the Continuance of Remote Teleconference Meetings of the Legislative Bodies Pursuant to Government Code Section 54953(e)(3) December 13, 2022 Page 3 through the Omicron, BA2 and other variants of SARS-CoV-2, which are far more transmissible than prior variants of the virus and, as even fully vaccinated individuals can spread the virus to others, holding meetings in person would present imminent risks to the health or safety of attendees. While the Resolution provides authority for the City to continue conducting public meetings remotely for the next thirty (30) days, the City has also determined to resume meetings in-person prior to the expiration of that thirty-day period, and conducted the City Council meetings beginning on March 8, 2022, as in-person meetings at Council Chambers while also retaining an option for the public, staff, and consultants to participate via Zoom. It is recommended that the proposed Resolution be adopted to continue to provide flexibility for future meetings of the City Council and its advisory bodies in the event that guidance from the State or County Health Officers changes within the next thirty (30) days. This flexibility will also allow members of the City Council or advisory bodies to attend meetings remotely if they also desire or if they are required to quarantine due to exposure to COVID-19. Based upon the foregoing, it is recommended that the City Council adopt the Resolution declaring the need to continue the emergency declaration and also au thorizing the continuance of remote teleconference meetings pursuant to Government Code Section 54953(e)(3). ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Adopt the Resolution declaring the need to continue the declared local emergency and authorizing the continuance of remote teleconference meetings; 2. Do not adopt the Resolution; or 3. Provide other direction to staff. ADVANTAGES: Adoption of the Resolution will satisfy the requirement of the Arroyo Grande Municipal Code regarding the periodic review of the declared local emergency related to the COVID- 19 pandemic. It will also satisfy the requirements of Government Code Section 54953(e)(3) and allow the City to safely continue carrying out its business in a manner that will minimize the risk of contracting COVID-19 for everyone involved. PAGE 2 WHEREAS, subsequently, in March 2020, in response to the COVID-19 pandemic, Governor Newsom issued Executive Orders N-25-20 and N-29-20. These orders suspended certain elements of the Brown Act and specifically allowed for legislative bodies as defined by the Brown Act to hold their meet ings entirely electronically with no physical meeting place. On June 11, 2021, Governor Newsom issued Executive Order N - 08-21 which provided that the provisions in Executive Order N-29-20 suspending certain elements of the Brown Act would continue to apply through September 30, 2021; and WHEREAS, on September 16, 2021 Governor Newsom signed AB 361, which added subsection (e) to Government Code section 54953 of the Brown Act, and makes provision for remote teleconferencing participation in meetings by membe rs of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and WHEREAS, a required condition of AB 361 is that a state of emergency is declared by the Governor pursuant to Government Code section 8625, proclaiming the existence of conditions of disaster or of extreme peril to the safety of persons and property within the State caused by conditions as described in Government Code section 8558; and WHEREAS, the City Council has adopted a Resolution making findings in accordance with AB 361 and Government Code Section 54953(e) authorizing remote teleconference meetings on September 28, October 26, November 23, and December 14, 2021, and on January 25, February 22, March 22, April 12, May 10, June 14, June 28, July 26, August 23, September 27, October 25, and November 22, 2022; and WHEREAS, the COVID-19 pandemic continues to spread rapidly worldwide and in the U.S., continuing to present an immediate and significant risk to public health and safety, and resulting in serious illness or death to vulnerable populations, including the elderly and those with underlying health conditions. BACKGROUND: On June 28, 2022, the City Council awarded a construction contract to perform the Wood Place, Farroll Avenue/Sandalwood Avenue, Sandalwood Avenue/Cameron Court, and Woodland Drive Back Yards Sewer Lining Project to Nu Line Technologies in the amount of $132,270 and authorized the City Manager to approve change orders amount in the amount of $19,840. The contractor’s final construction cost for the project was $135,409. Page 75 of 97 Item 9.e. City Council Consideration of Acceptance of the Wood Place, Farroll/Sandalwood, Sandalwood/Cameron, and Woodland Back Yards Sewer Lining Project, PW 2021 - 10 December 13, 2022 Page 2 The project consists of the rehabilitation of sewer pipes that run beneath the back yards of existing homes using a cured in place pipe (CIPP) method. CIPP is a trenchless (or no-dig) process where a flexible tube is inserted and pulled through the existing pipes from maintenance holes or clean outs and is then cured using either hot water under hydrostatic pressure or steam pressure to expand the tube to tightly bond with the interior of the existing pipes. This trenchless method allows the pipes to be rehabilitated in place without having to perform excavation and pipe replacement which would be ext remely disruptive and expensive, if not nearly impossible, due to the locations in existing back yards. The 2012 Wastewater System Master Plan lists a number of back yard sewers to be rehabilitated using the trenchless CIPP method. To determine which sewers were in the most need of reconditioning, a video inspection of each pipe segment was performed. This information was used to select which segment s to complete based on the funds avalible. ANALYSIS OF ISSUES: The contractor has completed the work in accordance with the approved plans and specifications within the contract time frame, under the available budget, and there are no outstanding issues. It is, therefore, recommended that the City Council accept the Wood Place, Farroll/Sandalwood, Sandalwoo d/Cameron, and Woodland Back Yard Sewer Lining Project and begin the one-year warranty period for defects that may arise. BACKGROUND: Public Contract Code (PCC) Section 22050 allows a public agency, in the case of an emergency, to repair or replace a public facility, take any directly related and immediate Page 79 of 97 Item 9.f. PCC Section 22050 requires that after proceeding with an emergency project, the City Council shall review the emergency action at its next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the emergency action is terminated, and if it is determined that there is a need to continue the action, authorize continuation of the emergency action by a four-fifths vote. On September 27, October 11 and 25, and November 22, 2022, the Council adopted Resolution Nos 5225, 5231, 5239, and 5243 respectively, determining a need to continue work under emergency contracts to replace the emergency generator at the FCFA Station 1. ANALYSIS OF ISSUES: Since the November 22, 2022 City Council meeting, the status of the project as of December 7, 2022, is as follows:  The building permit has been issued for the Project.  The construction bid package has been sent to local electrical contractors f or a bid. Since this is an emergency project, construction bidding does not have to follow the formal bid process. Bids are due back on January 9th and the project will be awarded to the responsive low bid shortly after the bids are received. While a portable generator has been brought on site that allows for the opening of the apparatus bay doors and some lighting at the fire station, it does not provide power to the server room or the station alerting system, which are critical needs. Therefore, there remains an imminent danger to public health and safety as this situation may cause delay of emergency 9-1-1 services during the event of a power outage . Because of this, staff recommends that the emergency action be continued. As required by statute, staff will continue to bring a similar item to the Council on subsequent agendas until the necessary emergency work has been completed or until the emergency action is terminated. Until this future item, staff will continue to work with the design consultant and selected contractor to complete the improvements on an accelerated basis. Page 80 of 97 Item 9.f. In 2005, the policy was modified to include additional language to address circumstances in which two members have the same tenure on the City Council. If this situation exists, the order of rotation is then based upon time served on a City Council appointed Commission and/or Committee prior to being elected to the City Council. In January 2014, the policy was again modified so that newly elected and/or appointed Council Members become eligible to serve as Mayor Pro Tem after servi ng on the City Council for a period of one year (Attachment 1 – Section 2.3 of the City Council Handbook). ANALYSIS OF ISSUES: Council Member George has served as Mayor Pro Tem for the 2022 calendar year. Council Members Secrest and Guthrie are newly elected City Council Members as of the November 8, 2022 General Municipal Election. Based on Council policy regarding seniority of those members who have not yet served as Mayor Pro Tem and the eligibility of newly elected Council Members to serve after one year on the City Council, Council Member Barneich would be the next in line for the position of Mayor Pro Tem for the 2023 calendar year. The City Council adopted Resolution 5142 adopting a Diversity, Equity, Inclusion, and Justice Policy as a commitment to support diversity, equity, inclusion, and justice in all facets of society and to model and implement the objectives within the community and City organization (Exhibit G). 2.COUNCIL ORGANIZATION & DUTIES 2.1 City Council Districts On April 12, 2022, the City Council adopted Ordinance 713 establishing a by- district election system and created four (4) district boundaries (Exhibit H). By 2024, each Councilmember will be elected by voters within their district boundary for a four-year term. The Mayor continues to be elected at-large for a two-year term. The City Council wishes to remain united in its service to the community and will govern on an at-large basis, considering the needs and interests of the entire community. Professional management of the City will continue to be a Council-Manager form of government under the policy leadership of the City Council as a governing body. City resources will be allocated to address priorities and needs on a citywide basis with a budget adopted by the City Council as a governing body. As customer service is a priority, any Council Member will help any member of the community who contacts them. Current practices regarding invitations of City Council Members to events and activities and appointments to committees and various bodies will remain in effect. 2.2 Newly-Elected Members Newly-elected Council Members are sworn into office generally at a r egular meeting in December following a regular municipal election. Immediately upon election (even before being sworn into office), newly- elected Council Members are subject to the provisions of the Brown Act. A reception is traditionally held immediately following the reorganization meeting. 2.3 Appointment of Mayor Pro Tem The City Council appoints a Council Member as Mayor Pro Tem to serve the duties of Mayor in his/her absence. The Mayor Pro Tem shall serve a term of one year. The appointment of the Mayor Pro Tem takes place at the first meeting in December of each year. It is the City Council’s policy to rotate appointment of the Mayor Pro Tem based upon the seniority of City Council Members that have not yet served in the position of Mayor Pro Tem. City Council Members become eligible to serve ATTACHMENT 1 Page 87 of 97 CITY COUNCIL HANDBOOK PAGE 9  as Mayor Pro Tem after serving on the City Council for a period of one year. If two Members of the City Council have the same seniority, the order of rotation will be based upon time served on a City Council appointed Commission and/or Committee prior to being elected to the City Council.  2.4 Meeting Duties of Mayor and Mayor Pro Tem The Mayor shall preside at the meetings of the Council. If he/she is absent or unable to act, the Mayor Pro Tem shall serve until the Mayor returns or is able to act. In the absence of the Mayor and Mayor Pro Tem, the City Clerk shall call the Council to order, whereupon a temporary Chairperson shall be elected by the members of the Council present. 2.5 Seating Order Following the Council reorganization, the City Clerk shall designate the seating order for the Council dais. The Mayor Pro Tem shall sit to the Mayor’s left. 2.6 Signing of City Documents The Mayor, unless unavailable, shall sign all ordinances, resolutions, contracts/agreements and other documents which have been adopted by the City Council and require an official signature, except when the City Manager has been authorized by Council action to sign such documents. In the event the Mayor is unavailable or has a conflict of interest, the Mayor Pro Tem’s signature may be used. 2.7 Representation at Ceremonial Functions The Mayor shall represent the Council at ceremonial functions. The Mayor may, at his/her own discretion, ask the Mayor Pro Tem or another Council Member to represent the Council at the function. Voluntary attendance at ceremonial functions by Council Members is encouraged. 2.8 Issuance of Proclamations, Commendations, Special Recognition PROCLAMATIONS AND COMMENDATIONS: All requests for proclamations are subject to the review and approval of the City Manager or his/her designee, or Mayor. Proclamations and commendations are signed by the Mayor, and are prepared in response to the type of recognition requested (which may include recognition of individuals, groups, and events of significance to the Arroyo Grande community). Proclamations and commendations may be presented at a City Council meeting or at an outside event or meeting. Typically, requests are honored for presentation at a Council meeting only if a local representative from the requesting party can appear to accept the proclamation or certificate. Most of the regional agencies listed require the appointment of a primary representative and an alternate representative to its board or committee. There are a few exceptions in which the Mayor is required to serve as the primary representative on the board, and for which an alternate is n ot required. In September 2020, Council approved a Council rotational schedule for attendance at the South County Chambers of Commerce monthly Arroyo Grande Business Meeting. A proposed rotational schedule for 2023 has been included as Attachment 3. Once all primary and alternate appointments are made, it is recommended the City Council authorize the City Clerk to update FPPC Form 806, Agency Report of Public Official Appointments, which is used to report additional compensation that public officials receive when appointing themselves to positions on committees or boards of a public agency. ALTERNATIVES: The following alternatives are provided for the Council’s consideration: 1. Make various appointments, reappointments, and/or reassi gnments to the regional and local boards and committees; or 2. Provide other direction to staff. By partnering with the local communities and businesses, the APCD Board implements regulations and programs to reduce air pollution and assist the county in reaching all outdoor air quality standards. The Board is comprised of all five County Supervisors and an elected official from each of the seven incorporated cities. Audit Committee In order to comply with the Statement of Auditing Standards (SAS) No. 114, the City of Arr oyo Grande has established an Audit Committee. Brisco/Halcyon Interchange Subcommittee This is a City Council subcommittee to coordinate with staff and report back to City Council regarding efforts related to the Brisco/Halcyon Road Route 101 Interchange improvement project. California Joint Powers Insurance Authority (CJPIA) Board The CJPIA is governed by a Board of Directors, consisting of one elected official appointed by each Member Agency. The Board elects a President, Vice President and seven Members of the Executive Committee, which meets monthly to supervise and conduct CJPIA affairs. The Executive Committee has an advisory City Managers Committee that meets monthly and a Finance Officers Committee, which meets quarterly. The CJPIA Board of Directors meets annually at the CJPIA offices in La Palma or at the annual risk management seminar. The Board Director must be an elected official. The Alternate(s) may be either an elected official or staff and may serve as the Voting Delegate in the Director's absence. Staff recommends appointing the City Manager and Human Resources Manager, along with one Council Member, as Alternates to ensure that a staff representative is available to attend the annual meeting if the Council representatives are unable to attend. Central Coast Blue (CCB) Regional Recycled Water Authority Board The Policy Board was formed as part of a Joint Powers Agreements (JPA) between the Cities of Arroyo Grande, Grover Beach, and Pismo Beach for a regional recycled water project, Central Coast Blue. It is comprised of elected officials and meets as needed and at various locations. Central Coast Community Energy (CCCE) Policy Board The Policy Board is comprised of elected officials and meets quarterly to decide high level policy decisions. Per the MOU, the seats rotate between the Cities of Arroyo Grande, Grover Beach, and Pismo Beach. (Note: Arroyo Grande is on the rotation schedule for the alternate seat in 2022- 2024 and the primary seat in 2025). City Selection Committee (Mayors) The City Selection Committee is comprised of the Mayor of each of the seven incorporated cities. The City Selection Committee makes appointments to the Airport Land Use Commission, California ID System Advisory Board, Local Agency Formation Commission (LAFCO), and Supplemental Law Enforcement Oversight Committee. Council of Governments/Regional Transit Authority (SLOCOG/RTA) Board SLOCOG is a regional governing body organized through a joint powers agreement that has responsibility for regional transportation planning, preparing the Regional Housing Needs Allocation and the Sustainable Communities Strategy as part of the Regional Transportation Plan. Page 94 of 97 ATTACHMENT 2 Page 2 The Board is comprised of all five County Supervisors and an elected official from each of the seven incorporated cities. RTA is operated through a joint powers agreement with SLOCOG responsible for regional rideshare programs and outreach activities offering alternative modes of transportation. SLOCOG and the RTA share the same board of directors and trade off meeting times every month. In South County, local fixed-route service levels (days, hours, routes, etc.), marketing efforts, and operating/capital budgets for local fixed-routes are controlled through the RTA South County Transit Committee (SCTC). The SCTC is comprised of the RTA Board members from the cities of Arroyo Grande, Grover Beach, and Pismo Beach, as well as one member from the Board of Supervisors. The SCTC meets at least annually to address public transit issues of interest to the SCTC members and to consider the following year’s budget for local public transit services in the Five Cities Area. County Water Resources Advisory Committee (WRAC) This organization is involved with water supplies and availability of water on a Countywide basis. The purpose is to advise the County Board of Supervisors concerning all policy decisions relating to water resources of the SLO County Flood Control & Water Conservation District, to recommend specific water resource programs, and to recommend methods of f inancing water resource programs. (*Appointed representatives to the Committee need not be a Council Member, but do need to be individuals knowledgeable regarding water issues. According to WRAC staff, cities may appoint a Council Member as the lead representative who would be available when policy issues are discussed, with a staff member as the alternate for attending most of the meetings.) Note: Council appointed representatives require approval by the Board of Supervisors. Five Cities Fire Authority Board Provision of fire protection services provided through a joint powers agreement with the Cities of Grover Beach, Arroyo Grande and Oceano. The Authority Board consists of an elected official from each member agency. The Fire Chief serves as the Executive Officer of the Authority. Homeless Services Oversight Council (HSOC) The HSOC was created by the San Luis Obispo County Board of Supervisors and its purpose is to lead, facilitate, and provide oversight for implementation of the 10-Year Plan to End Homelessness. The HSOC is an advisory committee that discusses the Countywide approach to homelessness and services for the homeless, including both housing and supportive services. Membership is comprised of a broad spectrum of representatives from the County Board of Supervisors, each City, certain County government departments (health, planning, social services, veteran services, and probation), law enforcement, business organizations, academic institution, faith community, as well as interested community members. Integrated Waste Management Authority Board (IWMA) The San Luis Obispo County Integrated Waste Management Authority (IWMA) combines the powers of the member agencies to achieve State-mandated waste diversion goals, satisfy the requirements of the Integrated Waste Management Act, and develop waste management facilities for the benefit of the County and all its cities and special districts. The Board is comprised of all five County Supervisors, an elected official from each of the seven incorporated cities, and one representative from all authorized Community Service Districts. (Note: Approval by the Board of Supervisors is not required for these assigned representatives.) REACH SLO Advisory Commission REACH is a nonprofit regional economic action coalition which strives to unite public private and civic leaders across the Central Coast. The SLO Advisory Commission is responsible for discussing regional issues and advising the Board. A representative of the Arroyo Grande area serves on the Commission. Page 95 of 97 ATTACHMENT 2 Page 3 South County Chambers of Commerce Meetings A Council Member is selected to attend the monthly South County Chambers of Commerce Governmental Affairs Committee and Arroyo Grande Business Meeting to provide a brief update on upcoming business-related items or issues, as well as to provide general City updates and highlights of City programs, services, or special events. The Council Member is not a voting member. South San Luis Obispo County Sanitation District (SSLOCSD) Board The City contracts with the Sanitation District for wastewater collection and treatment. The District is governed by a Board of Directors composed of the presiding officer from the Cities of Grover Beach and Arroyo Grande and the Oceano Community Services District, or their respective alternates (per Memorandum of Understanding between the City and the Sanitation District, as well as Health and Safety Code sections 4730-4735). Tourism Business Improvement District (TBID) Advisory Board The Arroyo Grande TBID was formed to provide revenue through an assessment levied on all lodging businesses within the District to promote scenic, recreational, cultural and other attractions in the District as a tourist destination. The Advisory Board makes recommendations to the City Council on the expenditure of the revenues derived from the assessments for the purpose of tourism marketing and promotional efforts. The Council representative does not sit on this Board; however, the representative attends the Advisory Board meetings in order to provide the Council with monthly updates on the activities of the Board. Visit SLO CAL Advisory Committee Visit SLO CAL promotes Countywide tourism opportunities and complements the efforts of local communities and organizations. It is a private, non-profit organization with membership comprised of local businesses, chambers of commerce, County government, and most incorporated cities in the County. The Visit SLO CAL Advisory Committee is comprised of elected officials and city managers, who participate in semi-annual meetings and liaise back to the communities they represent with programming updates and overall metrics demonstrating the impacts of the Tourism Marketing District on the County and cities. Zone 3 Water Advisory Board This is a County organized committee to handle the operation of Lopez Lake for both recreation and water facilities.
