PC R 95-1519RTSOI,UTION NO. 95-15�9 A RI:SOLUTION OT TIIC YLANNING COMMISSION Or TI-I� CITY Or ARROYO GRANDE APPROVING 'I'II� ARCIIIT�CTURAL RCVIL��V TOR I-IOLLYWOOD VID�O LOCA'1'�D A1' 1GSU GRANll AVrNU�, PAll "B" WIIEREAS, on June 6, 1995, the Planning Commission approved Conditional Use Permit Case No. 95-537 for a shopping center located at 1650 Grand Avenue; and W�IER�AS, said conditional use permit allowed construction of buildings on five pads subject to tl�e conditions of tl�e conditional tise permit and subject to arctiitectural review of the buildings to ensure compatibility witl� tl�e sl�opping center arcliitecture; and WHEREAS, Hollywood Video (W. L. Butler, Inc.) has submitted an architectural review application for Pad "B" of tl�e siiopping center; atid WIIERCAS, the Planning Commission of the City of Arroyo Grande lias considered the arcliitectural review submitted by Hollywood Video; and WHEREAS, tl�e Planning Commission has found tliat this project is consistent with the General Plan and the Environmental docurnents associated tl�erewith; and WHEREAS, the Planning Commission has found that this project is consistent with Conditional Use Permit Case No. 95-537 and the Environmental documents associated t}�erewith; and WHEREAS, tl�e Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. The proposal is consistent witl� the "General Architectural Review Guidelines" for the City of Arroyo Grande and is consistent witli the approved architecture of tl�e sliopping center at 1650 Grand Avenue. 2. The proposal is consistent with the text and maps of the Arroyo Grande General Plan, and the City of Arroyo Grande Development Code. 3. The proposal will not be detrimental to tl�e health, safety, comfort and general welfare of the persons working in the neighborhood of the proposed project. 4. Tl�e general appearance of tl�e proposal is in keeping with the cl�aracter of the neighbor}�ood and ttie approved architecture of tlie sl�opping center. 5. The proposal is not detrirnental to tlie orderly and harmonious development of tt�e City. 6. The proposal will not impair the desirability of investment or occupation in the neighborl�ood. NOW, TI BE IT RrSOLVED that the Planning Cvmmission of the City of Arroyo Grande hereby approves said architectural review, stibject to the standard conditions of tlie City and those conditions listed below: Resolution No. 95-1519 Associated Architectural Review Hollywood Video (W.L. Butler, Inc.) June 6, 1995 Page 2 General Conditions 1. The applicant sliall ascertain and comply witt� all State, Cour�ty and City requirements as are applicable to t}�is project. � 2. This application shall autornatically expire on June 6, 1997 unless a building permit is issued. Thirty (34� days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. 3. Development shall occur in substantial conformance with the plans presented to the Planning Commission at the meeting of June 6, 1995 and marked "Exhibit A", except as modified by elimin�'ting the neon accents on either side of the main entryway and the neon accents above tfie entryway but retaining the neon that is part of the front facia. 4. The applicant shall agree to defend at iiis/i�er sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and att�orney's fees whicll the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant shall comply with all conditions of approval of Conditional Use Permit Case No. 95-537. 6. Prior to occupancy of the building, all public improvemec�ts and the drainage concept (Attachment "B") shall be installed and operational. Architectural Advisory Committee Conditions 7. The extra windows proposed by the applicant on the soutll elevation are approved, and the Committee recommends that the applicant consider adding extra windows on the east elevation. 8. The drop box may be allowed if colored similar to the building and screened with landscaping where it will not interfere witli emptying the box. Planning Depai-tment Conditions 9. Signs shall comply witl� Chapter 9-13 of the Development Code unless otherwise approved. 10. The applicant sl�all submit necessary applications for the proposed signs. 11.
