PC R 95-1518RCSOLUTION NO. 95-1518 A R�SOLUTION OF THE YLANNING COMMISSION OF THE CITY OI�' ARROYO GRANDE APPROVING THE ARCHITECTURAL REVIEW FOR BOSTON MARICET LOCATED AT 1650 GRAND AV�NUE, PAD "D" WHER�AS, on June 6, 1995, the Planning Commission approved Conditional Use Permit Case No. 95-537 for a shopping center located at 1650 Grand Avenue; and WIIER�AS, said conditional use permit allowed construction of buildings on five pads subject to the conditions of tlle conditional use permit and subject to architectural review of the buildings to ensure compatibility with tl�e shopping center architecture; and WHER�AS, Boston Market (Boston West, L.L.C.) has submitted an architectural review application for Pad "D" of tlle shopping center; and WHEREAS, the Planning Commission of tl�e City of Arroyo Grande has considered the architectural review submitted by Boston Market; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and the Environmental documents associated therewith; and WHEREAS, the Planning Commission has found tliat this project is consistent with Conditional Use Permit Case No. 95-537 and the Environmental documer�ts associated therewith; and WI the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: 1. Tlie proposal is consistent witl� the "General Architectural Review Guidelines" for the City of Arroyo Grande and is consistent with the approved arcl�itecture of the shopping center at 1650 Gr�d ,�venue. 2. The proposal is consistent �+uith the text and maps of the Arroyo Grande General Plan, and the City of Arroyo Grande Development Code. 3. The proposal will not be detrimental to tlie health, safety, comfort and general welfare of the persons working in the neighborhood of the proposed project. 4. The general appearance of the proposal is in keeping with tlie character of the neighborhood and tiie approved arcliitecture of the shopping center. 5. The proposal is not detrimental to the orderly and liarmonious development of the City. 6. The proposal will not impair the desirability of investment or occupation in the neighborhood. � NOW, TH�REFOR�, BE IT RESOLVED that [lie Planning Commission of the City of Arroyo Grande hereby approves said architectural review, subject to the standard conditions of the City and those conditions listed below: Resolution No. 95-1518 Architectural Revie�v Boston Marlcet (Boston West, L.L.C.) June 6, 1995 Page 2 General Conditions 1. Tlie applicant shall ascertain and comply with all. State, County and City requirements as are applicable to this project. � 2. This application sliall automatically expire on June 6, 1997 unless a building permit is issued. Thirty (30) days prior to the expiration of t}ie approval, tlie applicant may apply for an extension of one (1) year from the original date of expiration. 3. Development sliall vccur in substantial conformance witl� tt�e plans presented to the Planning Comrnission at t}ie meeting of June 6, 1995 and marked "Exl�ibit A". 4. The applicant sl�all agree to defend at his/I�er sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant sha(1 reimburse the City, its agents, officers, or employees, for any court costs and attorney's fee's wt�ich the City, its agents, officers or employees may be required by a court to pay as a result of suc}i action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. 5. The applicant sl�all comply with all conditions of approval of Conditional Use Permit Case No. 95-537. 6. Prior to occupancy of tl�e building, all public improvements and the drainage concept (Attachment "B") shall be installed and operational. Architectural Advisory Committee Conditions 7. The overhead trellis at the drive-through may be constructed. S. If a wind-screen is added to the patio area, it sliall be transparent. Plauning Departrnent Conditions 9. Signs shall comply with Chapter 9-13 of the Development Code unless otherwise approved. 10. The applica�lt shall sub►nit necessary applications for tlie proposed signs. 11. Prior to issuance of a Certificate of Occupancy, trash recepticals, complementary to the center arc}iitecture, shall be located at ti�e exit to the drive-up aisle. At least two other trash receptacles sl�all be.placed in the parking lot, subject to review and approval of tl�e Planning Director. 12. Submit an exterior lighting plan for Police Department review prior to issuance of building permits.
