ACIiADJIAN, AT 525 TRAFTIC WAY WIiER�AS, the Planning Coinmission of the City of Arroyo Grande has considered an application by Khatchik H. Achadjian, for an amended Planned Sign Program at 525 Traffic Way in the Highway Commercial, HC-D-2.11 Zone; and WHER�AS, the Planning Com►nission has found that this planned sign program is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, the Planning Com►nission has reviewed this project in cornpliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQl1 Guidelines Section 15311(a); and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: � , 1. The proposed signs are consistent witl� tl�e goals, vbjectives, policies and programs oF the Arroyo Grande General Plan and any applicable design guidelines. The goals of t}�e General Plan are to encourage economic vitality and business activity, protect investments while preserving the environment and character of the City because said signs are important to the success of this and similar businesses but are not out of scale or character with other signs in this zone and vicinity. The design of the signs is consistent with the design guidelines for tlie D-2.11 district. 2. The proposed signs conforrn to applicable development standards and provisions of tl�e Development Code except as approved by arnended Variance Case No. 94-186 and will not be detrimental to tl�e public healtl�, safety or welfare. 3. The pl�ysical location or placernent of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, TH�R�rOR�, BE IT RE.SOLVCD that the Planning Commission of the City of Arroyo Grande hereby approves said Planned Sign Program, stibject to the following conditions of approval: General Conditious 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to tl�is project. 2. This application shall automatically expire on June 6, 1997 unless a building permit is issued. Achadjian June 6, 1995 . Page Two 3. Development shall occur in substantial conformance with tl�e plans presented to the Planning Commission at the meeting of June 6, 1995 and marked "Exhibit A". 4. The applicant shall agree to defend at l�is/lier sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or ecnployees, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall iiot relieve applicant of his/her obligations under this condition. Architectural Advisory Committee Conditions 5. The applicant shall comply with all conditions of approval of Conditional Use Permit Case No. 94-524 and Planned Sign Program Case No. 94-114a. Planning Department Couditions 6. Prior to installation of tl�e sign, the applicant shall determine if the proposed sign overhangs the public right-of-way or private property and present that information to the Planning Director in writing. 7, If the proposed sign overliangs tlle Public right-of-way or private property, the applicant shall obtain necessary encroachment permits and/or easements and/or a letter from the adjacent property owner autliorizing the overhang prior to installation of the sign. Building Department Conditions S. The applicant sl�all apply for necessary building permits, submit plans, and pay necessary fees prior to starting construction of the signs.
