PC R 95-1496RCSOLUTION NO. 95-149G A R�SOLUTION OF T'I-I� PLANNING COMMISSION OF THE CITY OF ARROYO GRAND� PROVIDING AN INT�RPR�TATION Ri:GARDING SETI3ACIC AND LOT COVERAG�STANDARDS � L� WIIEREAS, the Development Code was adopted by the City Council on May 14, 1991, and became effective on June 13, 1991; and WII�R�AS, a footnote at the bottom of Tables 9.05.040-A, 9.06.050-A and 9.06.050-B states if a lot was created before June 13, 1991, buildings may conform with the setback and lot coverage standards of tlie previous zone, as outlined in Appendix C.W.D.2.19 of tlie Development Code; aiid WIICR�AS, Section 9-01.110 (G)(3) of the Development Code provides the Planning Commission with the authority to clarify ambiguities; and WI-IEREAS, the Planning Commission has been requested to make a formal interpretation of tl�e applicability of saicl footnote to lots created prior to June 13, 1991, which are suUsequently reconfigured through a lot ]ine adjustment. WI-i�REAS, a lot line adjustment does not technically create new lots. �� NOVV, TIICRCFORE, BC I'I' RCSOLVED that the Planning Commission of the City of Arroyo Grande hereby makes the interpretation tliat the footnote at the bottom of Tables 9.05.040-A, 9.06.050-A ancl 9.06.050-B of the Development Code applies to lots legally createcl prior to June 13, 1991 which are subsequently reconfigured through the lot line adjustment process.
