PC R 94-1468R�SULU1'ION NO. 94-14G8 A RESOLUTION OF TIIE PLANNING COMMISSION OF TI CITY Or ARROYO GRANDE RECOMMENDING THE CITY COUNCIL APPROVE PLANNED SIGN PROGRAM CAS� NO. 94-113, APPLICD FOR BY LEVITZ TURNITURE CORPORATION, AT 1450 WE,ST BRANCH STREET WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application by Levitz Furniture Corporation, for a Planned Sign Program at 1450 W. Branch Street in the Planned Development, PD 1.1 District; and WH�REAS, the Planning Commission has found that this planned sign program is consistent with the General Plan and the Environmental Documents associated lherewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and I�as determined that the project is categorically exempt per CEQA Guidelines Section 15311; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: l. The proposed signs are consistent with the goals, objectives, policies and programs of � the Arroyo Grande General Plan. The proposed signs balance the need for identification of businesses with tlle rural small town character of the community. 2. The proposed signs conform to applicable development standards and provisions of the Development Code as modified by approval of Variance Case No. 94-183, and will not be detrimental to the public health, safety or welfare. 3. The physical location or placement of the signs are compatible with the surrounding neighborliood and do not pose a safety risk. NOW, THEREFORE, BE IT RF�,SOLV�D that the Planning Commission of the City of Arroyo Grande hereby recommends that the City Council approve said Planned Sign Program, subject to the following conditions of approval: General Conditions 1. The applicant shall ascertain and comply witti all State, County and City requirements as are applicable to this project. 2. This application shall automatically expire on (insert date of City Council meeting�,, 1996 unless a building permit is issued and substantial construction is commenced and diligently pursued toward completion, or a final inspection is conducted. Tl�irty (30) days prior to the expiration of the approval, the applicant may apply to the Planning Commission for an extension of one (1) year from the original date of expiration. 3. Development shall occur in substantial conformance with the plans presented to the City Council at the meeting of (insert date of City Council meetin,g), 1994 and marked "Exhibit A". The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such apprvval. The applicant shall reimburse the City, its agents, officers, or employers, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of sucli action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Planning Department Conditions 5. All banners shall be removed after permanent signs have been installed, but prior to final inspection of tl�e signs. Building and Fire Department Conditions 6. The applicant shall apply for and be granted permits for the signs; shall pay necessary fees; and call for necessary inspections.
