WH�R�AS, the Planning Commission of the City of Arroyo Grande has considered
Conditional Use Permit Case IVo. 93-515, filed by Thor Ourston, for a accessory structure tl�at
exceeds the 14 foot height limitation, in tt�e Planneci Development (PD l.l) District; and
WHEREAS, the Planning Commission has held a public hearing on this application in
accordance witl� the City Code; and
W��EREAS, the Planning Commission has found [hat this project is consistent with the
General Plan and the Environmental doctiments associated therewith; and
WH�REAS, the Planning Commission has reviewed this project in compliance with the
California Environmental Quality Act (CEQA) and determineci that it is Categorically Exempt
per Seclion 15303 of the CEQA Guidelines; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances exist:
1. The proposed use is permitted witliin tt�e subject district pursuant to tl�e provisions of
Section 9-03.050 of the Development Code, and complies with all applicable provisions -
of the Development Code, tlie goals and objeclives of tl�e Arroyo Grande General Plan,
and the development policies and standards of tlie City.
2. The proposed use will not impair the integrily and characler or the district in which it
is to be establislied or locatecl.
3. The site is suitable for the type and intensity of use or development that is proposed.
4. There are adequate provisions for water, sanitation, and public utilities and services to
ensure the public heallh and safety.
5. The proposed use will not be detrimental to the public healtli, safety, or welfare, or
materially inj�irious to properties and i►nprovements in the vicinity.
NOW, TIIER�FORE, I3E IT RCSOLVED that the 1'lanning Commission of the City
of Arroyo Grande hereby recommends lhat the City Council approve said conditional use permit,
subject to the following conditions:

Ge��eral Conditions
l. The applicant shall ascertain and comply with all State, County and City requirements
as are applicable to this project.
2. This application sl�all automatically expire on March S, 1996 unless a building permit is
issued. Tl�irty (30) days prior to tlie expiration of the approval, the applicant may apply
for an extension of otie (1) year from the original date of expiration. .
3. Development shall occur in substantial conformance with the plans presented to the City
Council at tlie meeting of March 8, 1994 and marked "Exhibit A". �
4. The applicant shall agree to defend at his/her sole expense any action brougl�t against tl�e
City, its agents, officers, or ernployees because of the issuance of said apprvval, or in
the alternative, to relinquish sucli approval. The applicant shall reimburse tiie City, its
agents, officers, or employees, for any court costs and altorney's fee's wl�ich tl�e City,
its agents, officers or employees may be required by a court to pay as a result of such
action. The City may, at its sole discretion, participate at its own expense in lhe defense
of any such action but sucli participation sliall not relieve applicant of I�is/her obligations
under this condition.

5. Development shall conform witl� tlie PD l.l zoning requirements with the exception of
the 14 foot height lirnit for an accessory structure. This approval allows the proposed
barn to be constructed to a heiglit of 19.5 feet.
On motion of Commissioner Reilly, seconded by Commissioner Keen, and on the following roll
call vote, to wit:
